Dave Holloway Asks Courts to Declare his Daughter Natalee Holloway Deceased

 

Dave Holloway, the father of missing Natalee Holloway, has asks the courts to declare her dead.

It has been more than six years since Natalee Holloway went missing in Aruba on a class trip in May of 2005. Dave Holloway is asking the probate court to declare her dead. Natalee Holloway has not been seen not heard from since she left Carlos N’ Charlies in a car with Joran Van der Sloot, Deepak Kalpoe and Satish Kalpoe. The initial court date is set for September 23, 2011. Dave Holloway is looking for an official declaration of death for Natalee Holloway.

Holloway wrote in a sworn statement that it was his “painful” belief that his daughter is dead and recounted the years spent investigating her baffling disappearance in 2005. He said there was no evidence to suggest Natalee is either alive or that she had run away from home.

“Prior to her trip to Aruba, Natalee had no medical issues, psychological issues or family issues,” the statement said.

Dave Holloway’s lawyer, Karen Hennecy, said Dave “is seeking closure for this family.” However, it appears that his ex-wife Beth Holloway was not aware of the legal proceedings.  That may not be the best direction. Beth Holloway, said she was surprised her ex-husband filed the request.

“I only learned about this when I was handed the citation by a process server while addressing a large audience at a conference in Georgia,” she said in a statement. “I don’t know what this is about, or why Dave is taking this action at this time.”

A spokeswoman for Beth Holloway declined comment on whether she would oppose the petition.

The declaration of death, “order on legal presumption of death,” will take several court appearances and according to reports, the court papers reference homicide.

The process, which requires multiple hearings and publication of notices seeking information that she is alive, is expected to last into early 2012. Fewer than a half-dozen such cases are filed annually in Jefferson County, court officials said.

The petition makes several references to the homicide investigation conducted by Aruban authorities and the ongoing focus on Joran van der Sloot in connection with Holloway’s disappearance.

      Dave Holloway’s desire to have Natalee declared dead after six years is understandable and his reasonings in were solid but the “surprise” citation served to the mother of his daughter was not the way to go. It was cruel.

      Anyways… as with other issues … I trust that Beth will work through it all with grace.

      Out of consideration for the mother of his daughter … why did Dave Holloway not instruct his attorney to give a heads up to John Q. Kelly regarding the citation and its contents?

      I know this has got to be hard for Dave and Robin to do this. This is the first time I have heard of this, and it needs to happen. Time for the last step in closure and healing.

      This is the only way for it to end for everyone that has grown to know Natalee and feels the pain of her gone. God bless to all

      It should be remembered that Robin is not Natalee Holloway’s mother. Natalee’s stepmother should not be part of this equation. The decision to begin the heartbreaking process of declaring Natalee deceased should have been an issue between Beth and Dave. IMO

      My comment was not about BETH or Jug or anyone else, only Dave and Robin. I don’t know the full story, and it was not up to ME on what to do or who needed to be told. Maybe they tryed to get hold of Beth and could not. Dave and Beth do not have good communcations between each other. Beth never contacted Dave on the shows or movies she had done, which made Dave out to be a loser in one of the movie’s, which was totally false. Dave stayed on the island looking all over it. in land fills, lakes and ponds, you name it, he even looked from the air. Beth never came close to this, but was in the camera’s eye, and that was important too.

      And your comment about Robin NOT being part of this…wow.

      Robin is one of the parents in Natalee’s life that HELPED raise her. Please think about what you say before you post it because it could hurt and open a terrible wound that was caused on Aruba.

      It’s been awhile since I’ve posted. I’m again in a very remote location. With only an I-phone and 1 bar, make that 3 bars of reception.

      This case saddens me to the core of my soul. I can’t help but think that if some one had been able to penetrate that dark cold soul of Joran Van DerSloot, Natalee would still be alive today, healthy, happy, educated, and helping those in need.

      I’ve seen many children with dark souls. I hope my wife and I made a difference in their lives when we taught 5th. And 6th grade Sunday School. I fear not.

      When my son was in scouts, I saw many more dark souls. As assistant scout master, I reached out to these boys with the scout law and oath. I have seen many of them fail. I have seen some go to prison. I haven’t seen any of them hurt or kill anyone, other than themselves.

      Truly, I should have helped more.

      Waterboy: I know what you mean.
      I coached JH girls softball and put in a lot of time since two of my daughters where on my team.
      Some girls; perhaps of the gender difference just would not respond as the others.
      Unfortunately; three of my girls I coached are in prison.
      Two on drugs and one for murder.
      These were my darkest hours; but I don’t believe I could have prevented this from happening.

      In so far as Dave and closure:
      I sincerely hope he could go back to Aruba with Fred and his dogs and search the Acacia Cemetery in Orangestad; about a kilometer from The Mementomori Funeral Home.
      I feel she is there in with another body’s coffin.
      JMHO: But that is what I believe and I believe Rene put her there.
