Defense lawyers on Wednesday appealed a judge’s ruling that Aruban authorities could share information with the FBI about missing Alabama teen Natalee Holloway.
Last week, a judge struck down a motion by the defense to prohibit file sharing with the American law enforcement agency, which is acting in an advisory role in the high-profile case.
“It’s not a question of having something to hide but about the legality of their (FBI) involvement,” said defense lawyer David Kock.
I guess when a defense attorney states, “its not about having something to hide”, it most likely is all about having something to hide?
Kock, one of three lawyers who argued the appeal Wednesday in a closed court session, said a decision was expected Monday.
FBI agents have been on the Dutch Caribbean island as observers since Holloway disappeared May 30. They were granted access to material last month at the urging of the Aruban prime minister.
It would appear that this was one of those scenarios that if this decision was ever overturned Aruba would have a severe PR relations nightmare on their hands. As it presently stands many have questioned the investigation including the Holloway’s and Twitty’s, to suddenly have the the access of material by the FBI overturned would simply cause problems beyond mention.

Sean: I guess the biggest development we had yesterday Dave,…I am a father, I know this is hard for you. Apparently, you guys have had information for some time that you believe that authorities have known and that there was admission of forced sexual contact with your daughter.
Dave: Well, I would rather not get into any details. But, we do know that Joran admitted to some sexual…aggravated sexual assault or whatever the term was used. We were aware of that and he was behind bars at the time. The Deepak brothers, I am not so sure if they were in jail at the time or not. When they were getting ready to let them go, I thought to myself jeez, isn’t that enough to hold them? The laws are a lot more lax there than they are here.
Alan: In light on the information that was revealed here last night, could you press charges for sexual assault?
Dave: Well, based on his statement, he has already admitted to at least that charge. We are looking at possible kidnapping, and as the police have indicated…a possible murder charge. I still hold out hope that maybe they are wrong, maybe they have missed it somewhere. Try to hold out for a miracle.
Alan: There was concern that if he didn’t speak and was told no body, no case he could just wait it out and be released. But, with this information, that the authorities and you know there would be reason to hold him beyond the 63 days on these other charges. Wouldn’t you think?
Dave: That is what you would think, but he was in position to be let go the last time. I think the judge may have ruled because he told so many lies that there may be something there.
Alan: Dave, Beth has said that she got documents and statements from witnesses that lead her to believe the investigators may be on the wrong track. Any idea what she means?
Dave: I didn’t talk to her about the documents. Those documents have been floating around, all the defense attorneys have all the documents they need. We are not allowed to have any evidence as the victim, so to speak. The news media purchased some, I don’t know how they fell into her hands. They would have had to come from the defense side somewhere. Beth indicated that some documents had been altered, some may have been shredded or torn up. I just don’t have all the details, all are in Dutch and have to be translated.
Alan: Any idea who would be altering or destroying them?
Dave: Well, I just don’t know, it may be typo errors, there could be a plausible explanation for it. It could be an error, someone throwing it in the trash can, someone retrieving it…not real sure where she obtained these documents.
Alan: The question is cover up or incompetence? Is the person working with you getting to the bottom of it?
Dave: I spoke to him today, he is as perplexed about all of this as we are. Seems like every time someone speaks out or comes forward. Just like the gardener, he is supposed to appear in court Thursday then be immediately deported. That is the work of the defense of course. Some witnesses may be scared to come forward for fear of repercussions.
Sean: I want to go back to this issue of Joran’s admission of a crime of assault on your daughter. Also, if we go back, he had made comments that have been widely reported…about Deepak…about killing her…his earlier admissions. This goes back to one of the LE saying there are ten different stories.
What are we to make of this Dave?
Dave: We were looking for the Deepak or the Kalpoes to be rearrested.
They have to have more evidence before they arrest them. It wouldn’t do any good to bring them in, they won’t tell the truth.
Alan: When we discussed this with Jug last night, he said that Joran admitted this crime against your daughter. What are the things you know that are as bad that we don’t know?
Dave: There are some declarations out there that point the fingers to Deepak. I think there is a document out there that he admitted that he killed her. But, to get our hands on those I have not yet been able to do that. Don’t know if Beth has.
Alan: Have you just heard it, or is it just rumor…is this something the FBI has?
I think the Mansur family may have some information on that part of it. I really couldn’t say. There are a lot of things I am hesitant to say . I am a very patient person, I want the police to crack this thing. I think they have the skills and opportunity now to do that. I am just going to wait it out and see if they can. If not, that will be my time to talk.

Ok, seeing that Dave Holloway has now said it … I guess Red can chime in. I had been holding off on some stuff in respect of the family’s wishes.
To answer some of the questions from above, yes the declarations are in Dutch and were translated to me as well. There are rather long written and detailed declarations out there that point the finger at Deepak; however, from my understanding they are not admissions but rather state by other individuals that Deepak was the perpetrator of the crime. The Mansur’s have done much investigative work behind the scenes but that would only make sense as they are the owners of the most read paper on Aruba and would in turn make them a natural source to investigate.
After seeing some of this stuff I have really questioned why Deepak was walking the streets. I think some of you may have remembered me making that comment. Also, what came to mind was if this type of info is out there and Deepak is out of prison and Joran is in? One must begin to wonder that maybe, just maybe they have more evidence on Joran in this suspected crime and that is why he remains in jail.
Let’s just hope that the prosecution has been holding information back and keeping very tight lipped about it.
Calling All SAR’s; Search More, Talk Later
I have been an advocate of anyone who is willing and able to help in the searches for Natalee Holloway. It does not matter whether it be with Texas EquuSearch or with any of the many other SAR’s (Search & Rescue) teams out there. I am sure the The Holloway and Twitty’s would welcome most any help that is provided to them to help find their daughter, Natalee Holloway.
That being said, maybe many of the SAR teams that wish to go to Aruba or are going to Aruba should put their priorities in place first before they set foot in Aruba. There is an old saying when you are about to do charity or volunteer work for organizations, “leave your ego at the door.” Today on WPBF News, channel 25 out of West Palm Beach, FL comes the following story: Team Heads To Aruba To Search For Missing Teen. I would commend any search team that takes time to help out the Holloway-Twitty family and search; however, before you even set foot on Aruba you are already criticizing others that have searched and the Aruban Government?
A team of searchers from Lake Park are heading to Aruba in search of Natalee Holloway, an Alabama teenager who has been missing there since May.
Fred Golba said he has a plan to find Holloway.
He will use specialized techniques to search the sandy beaches of Aruba.
Search dogs, Astro and Rhino, who Golba trained will be with him. Golba thinks they will help him succeed where everyone else failed.
“It’s been searched, but it hasn’t been properly searched. Not out of arrogance out of confidence. I have a lot of confidence that I’ll find that body from what I’ve seen,” he said.
In my opinion the more the merrier and if some one can help bring closure to the Holloway’s and Twitty’s the better. However, this idea of in-fighting or SAR’s politics that is going on is very much in poor taste. I am sure that the family cares not who finds Natalee, but that she is found. Criticizing searchers that have come before you when one has no concept of what may or may have not been done is puzzling at best. To also criticize the Aruban Government before you even have a dog on the ground is in my opinion just plain ridiculous.
“There’s only so many options and so many places she could be,” Knox said. “They’ve spent the least time in the obvious places — the beach.”
Knox agreed to send Golba and his dogs to Aruba because of his global experience with cadaver searches including Ground Zero after the Sept. 11, 2001 terrorist attacks.
Knox and his crew are highly critical of the paid search team that’s already on the island and the Aruban government.
Aruba is not the United States folks, as we have learned along the way in the many weeks that we have been following this story. If one thinks its as simple as just searching a beech in Aruba whenever one feels like it, you may be sorely mistaken. One may want to get their search & rescue dogs through Aruban customs before you start criticizing the Aruban Government. That would just seem like the wise and reasonable thing to do.
I wish this group of searchers the best for Natalee’s family sake. However, let’s just hope they keep their eye on the the ball and that is to find Natalee, not criticizing others that have come before you when you have no idea what the island politics is like. Once again, good luck and stay on point.

Harassment? Profiles in Courage from Deepak
While Beth Holloway Twitty tries to find answers, clues and leads into the disappearance of her daughter, Natalee Holloway; her confrontation his suspect Deepak Kalpoe yesterday is said to be harassment? Deepak Kalpoe, a 21-year-old Suriname national, “who had been detained in the disappearance of Natalee Holloway complained to authorities Tuesday that her mother has been harassing him.”
A man who had been detained in the disappearance of Natalee Holloway complained to authorities Tuesday that her mother has been harassing him.
Deepak Kalpoe, a 21-year-old Suriname national, asked that Beth Holloway Twitty stay away from him, said police Inspector Carlos Sarge.
Sarge said police would ask her to stay away from Kalpoe.
Holloway Twitty declined to comment on the complaint. “I’m just going to try to continue getting answers about my daughter,” she said.
Holloway Twitty has repeatedly said she believes the three young men were involved in Natalee’s disappearance — allegations that they have denied.
The complaint came after Holloway Twitty confronted Kalpoe Monday and asked him about her daughter’s disappearance. The scene was filmed by television.
This is an amazing turn of events from Deepak Kalpoe in dealing with this situation. It is my understanding that Deepak was still a suspect even though he had been let out of prison according to the Prosecutor’s office. I will say this, first Deepak threatens a lawsuit when Beth Holloway-Twitty made the reference that the Kalpoe brothers were criminals and knew what happened to her daughter. Now he complains to the authorities that he is being harassed? Every legal expert in Aruba stated on the MSM shows last night that there is no grounds for anything that Deepak claims. From Scarborough Country (full transcript) last night comes the following from Holloway -Twitty family attorney, Benvinda De Sousa:
SCARBOROUGH: Get us up—get us up to date with this complaint that has been filed against your client, Beth Holloway Twitty.
DE SOUSA: Yes.
Deepak Kalpoe filed a complaint today with the Aruban police, based on harassment. He obviously felt harassed by her visit to him, and he felt not at ease by her questions. And he wants to prevent her from visiting him again.
Well, I can tell you one thing, that anybody who thinks that he has been harassed or is not as ease by anybody’s questions—we live in a free country—it is a democratic country—can file the complaint, but the complaint has to be based on truth. It is my understanding that Beth went to visit. She developed some pictures. Deepak was there. And she just asked him some questions, and that is a far cry from harassment.
So, I am not worried about that at all.
SCARBOROUGH: What is the standard in Aruba? You talk about living in a free country. Obviously, Beth is free to go develop pictures in an Internet cafe, if she wants. And at one point does it become harassment? At what point does it become stalking? Obviously, this is in a public setting. So, is the standard, if she goes in and she is peaceful and she doesn’t threaten him, she can keep going back as much as she wants?
DE SOUSA: Well, basically, she can.
I mean, she is free to talk to anybody she wants, and if the person she is talking to doesn’t want to talk to her and feels harassed or threatened in any way, is free to file a complaint. But, then again, like I told you before, it is a far cry from that. It is a public place. It is an Internet cafe, where everybody can go and sit behind a computer and surf the Web or chat or do whatever they want.
SCARBOROUGH: What has her response been to this harassment charge being filed against her by Deepak, again, a guy who many people believe may have had something to do with Natalee’s disappearance and possible murder?
DE SOUSA: I agree.
Why should we believe what he stated in his complaint? I mean, he has lied before. He was one of the last three persons to be seen with Natalee. And he has no credibility whatsoever, so why would he have credibility in his complaint? I think the mother is much more to believe. And if—I would say completely to believe, and she is honest in trying to find answers as to where her daughter is at.
And I understand perfectly that a mother would want to talk to one of the last persons to have been seen with her daughter, for all we know, alive.
I would think it is rather embarrassing for Aruban’s that this kind of behavior be Deepak is what the world is seeing that represents the island. Not just standing up and answering some questions of a desperate mother, but rather to hide behind harassment charges. True profiles in courage.

ORANJESTAD, Aruba — Deepak Kalpoe filed a complaint against Natalee Holloway’s mother Tuesday, claiming he felt he was threatened by her actions at his place of work, Fox News has confirmed.
Beth Holloway Twitty confronted him Monday at the Internet cafe where he works, spending about 90 minutes peppering him with questions.
Kalpoe’s lawyer has sent her a letter warning that if she does it again, he will file for a restraining order against her.
It is interesting for all to see the drastic comparison of two individuals. In one corner Beth Holloway Twitty who has against all odds managed to keep her daughter’s disappearance in the forefront of the media and has acted with all the vigor and courage that any of us would be proud of. As I said to her personally last Thursday, “Beth, what you have done has simply been amazing and know that there are so many people back in the US and everywhere that admire what you have done, that are behind you, and are proud of your selfless actions to find Natalee.” Compare that position with that of Deepak’s who runs to an attorney and claims harassment charges instead of just answering simple questions. The contrast between the two could not be greater. A mother willing to do anything to find answers as to the disappearance of her missing daughter and Deepak running and hiding behind harassment charges and his attorney. One wonders why Deepak would just not say he knows nothing as compared to he does not need the money as was reported?
