While you were sleeping through the so-called bipartisan health care summit that was nothing more than an attempted photo-op show for President Obama, his band of merry Democrats attempted to slip in provisions into an intelligence bill under the cloak of darkness that would have made it a crime to use tactics, effective or not,  in obtaining potential life saving information and that are not necessarily considered torture.

Aren’t sneak attacks supposed to come from terrorists, not Democrats? One would think so. Not these days.  These are the types of things that must be remembered on election day. Why is a political party trying to sneak in legislation that would undermine the safety of the United States?

More great work from  Obama and his band of merry men, give American civil rights to the terrorists and put in jail for life the very heroes that keep the United States safe behind the scenes. Because that would make us just so much safer against terrorists. UNREAL!

While the country and the Congress have their eyes on today’s dog-and-pony show on socialized medicine, House Democrats last night stashed a new provision in the intelligence bill which is to be voted on today.  It is an attack on the CIA: the enactment of a criminal statute that would ban “cruel, inhuman and degrading treatment.”

The provision is impossibly vague — who knows what “degrading” means? Proponents will say that they have itemized conduct that would trigger the statute (I’ll get to that in a second), but it is not true. The proposal says the conduct reached by the statute “includes but is not limited to” the itemized conduct. (My italics.) That means any interrogation tactic that a prosecutor subjectively believes is “degrading” (e.g., subjecting a Muslim detainee to interrogation by a female CIA officer) could be the basis for indicting a CIA interrogator.

The act goes on to make it a crime to use tactics that have been shown to be effective in obtaining life saving information and that are far removed from torture.

Democrats go after against the CIA again.

“Late last night, Democrats in the House of Representatives inserted a provision dubbed “The Cruel, Inhuman, and Degrading Interrogation Act of 2010” into the intelligence authorization bill. This new language targets the US intelligence community with criminal penalties for using methods they have deemed necessary for keeping America safe. These methods have further been found by the Department of Justice to be both legal and in keeping with our international obligations. more…

UPDATE I: Thankfully this bill was pulled and this disgusting attempt to sneak an anti-CIA intelligence gather punishment provision was stopped.

Democrats inserted an 11-page addition into the bill late Wednesday night as the House Rules Committee considered the legislation.

The provision, previously not vetted in committee, applied to “any officer or employee of the intelligence community” who during interrogations engages in beatings, infliction of pain or forced sexual acts. The bill said the acts covered by the provision would include inducing hypothermia, conducting mock executions or “depriving the [detainee] of necessary food, water, sleep, or medical care.”

The language gave Congress the discretion to determine what the terms mean, and it would have imposed punishments of up to 15 years in prison, and in some cases, life sentences if a detainee died as a result of the interrogation.

      Officers should not be held criminally responsible for following orders unless those orders are in obvious conflict with standing policy. In other words, if their superiors tell them to let dogs bark at prisoners they should do so, but they shouldn’t follow an order to castrate someone.

      Somewhere in the middle are things like waterboarding….yes the DOJ (of the time) said it wasn’t torture, but the fact that I can get someone on my own payroll to agree with me on something doesn’t make it correct.

      And, to his credit, Obama has refused to prosecute/witch-hunt these issues of the past; it is within his domain to set policy going forward.

      Well, theyll insert it again, sometime in the future. Maybe one of the reps will get his ass of the chair and work on a compromise then.

      For your information: To make these practices illegal is meant as a protection of the agents, not to criminalize them. When it is illegal, not even a President like Bush who didn’t care shit about human rights could force it on them. They’d be protected. There are other examples of this method, we all know them from law enforcement, but there are more. Perspective.
