Stephen Tober, Chair of the ABA Judiciary Committee will Testify Thursday at Roberts Hearing

ToberThe Senate Judiciary Committee has been meeting the past week to determine whether to pass John Roberts to the full Senate as a candidate for the seat of Chief Justice of the Supreme Court. They have spent the past 3 days interviewing Roberts, and determining whether he is worthy of the position.

On Thursday, the committee will hear from Stephen Tober, chairman of the American Bar Association’s Standing Committee on the Federal Judiciary, who has given Judge John Roberts the highest rating, “Well Qualified”. Roberts will have the opportunity to present the findings of the ABA to the committee, and explain how they came up with this recommendation.

Stephen Tober is one of the most respected attorneys in the country, practicing out of Portsmouth, New Hampshire. He has a successful practice specializing in civil litigation, professional negligence, and domestic relations.

Tober’s resume is extensive, having served as president of the New Hampshire Trial Lawyers Association in 1977 and as member of the board of governors of The Association of Trial Lawyers of America from 1980-1986. He was a delegate to the New Hampshire Constitutional Convention in 1984 and on the New Hampshire Board of Bar Examiners from 1997-2000.

This path has led Stephen Tober to the seat he will take in front of the Senate tomorrow. He will have the opportunity to explain the grueling review that the ABA puts the nominees through, how they come to the rating they give them, and explain the ABA’s role in the process.

Dave Holloway Returning to Aruba Tomorrow

I spoke with Dave Holloway on the eve of his return to Aruba in his quest for answers. Having kept silent as to the exact time of his return until todays call when I was given the OK; Dave Holloway stated that this would be a fact finding mission and that he wanted to get answers to certain questions. In Dave’s words,

I want to get answers to questions that need answers. I want to follow up on some tips and you never know when there is some area you just may want to look again.

Dave Holloway plans on being in Aruba for 4 or 5 days, but as he said, “you never know the plans may change.” Dave will meet with his attorney Vinda de Sousa and will probably want to meet with investigators and maybe the Prosecutor’s office. I am sure after the release of Joran and the Kalpoe brothers and todays court ruling that even the restrictions are being lifted against the three suspects, Dave must have plenty of questions he wants answered.

In talking with Dave today he did reference that he was not surprised at the Judge’s decision. I guess I would have to admit I was not either, except for the lifting of the restrictions against the three suspects. We did both discuss the fact that it is truly amazing that they last three people to ever have been seen and admittedly been with Natalee are now just free to walk about as the Judge stated there was a “lack of sufficient grounds and serious suspicions” to keep the restrictions. We both did a collective sigh. However, Dave remains positive, focused and determined. Dave is willing to take the slow and methodical approach if necessary. For all involved, when speaking to Dave it is tough to get discouraged at the events of the day when he remains so determined.

Dave Holloway later went on to say that he thought that the pond area/Racquet Club location Pondand the landfill were still points of interest. When asked whether he or the family was ever told that the landfill witness was ever deemed not credible by the LE or Prosecutors office Dave made it a point to say that he was present when the witness under went a voice analysis and passed it as telling the truth.

We wish Dave Holloway safe travel and hope he finds the answer that he is looking for.

Aruban Appeal Verdict is In On Joran Van der Sloot and the Kalpoe Brothers

Decision of the Superior Court

This afternoon, the Superior Court announced the decision of the appeal presented last week in the case of the three suspects Joran van der Sloot, Satish Kalpoe, and Deepak Kalpoe.

The Superior Court terminated the suspended detention completely for all three suspects. The Superior Court is in the opinion that there is not strong enough evidence or serious motive to continue the detention.

The three persons will remain suspects in the case of the Natalee Holloway disappearance.

This is the short version from the prosecutors office. Curacao will be sending a more detailed version including the DNA appeal results shortly.

Update: From the AP; Aruba Court Lifts Curbs on Three Suspects in Missing U.S. Teen Case

A court ruled Wednesday that three suspects in the disappearance of a U.S. teenager can remain free without conditions – overturning an earlier decision that restricted their travel.

The appeals court ruled there was a “lack of sufficient grounds and serious suspicions” to keep the restrictions on Joran van der Sloot and two Surinamese brothers, Deepak and Satish Kalpoe, the Aruban prosecutor’s office said.

I think many people will just be scratching their collective heads on this one. Totally free and without conditions for those who were the last ever seen with Natalee Holloway.

>”They are totally free,” Kock said.

Vinda de Sousa, a lawyer for the Holloway family, expressed disappointment with the ruling.

“Of course, it’s not what we were hoping for, but I’m convinced that this is not the end of the investigation,” de Sousa said.

The Aruban prosecutor’s office did not comment beyond the brief statement.

Beth Holloway Twitty on Nancy Grace; “I certainly didn`t know they were cowards.”

After an absence from CNN’s Nancy Grace Show, Beth Holloway Twitty continued fer assault on the Aruban Justice system. From Beth Holloway Twitty:

Well, you know, Nancy, I was thinking, I knew there was corruption and cover-up involved. But I certainly didn`t know they were cowards either, and to hide beneath the cloak of Hurricane Katrina is just reprehensible. And you know, I think — I think of the Dutch government, and I want to keep the focus on this political party in place, NEP (ph). I think of this judge, Rick Smit. And I can`t imagine putting the suspects` rights or the suspects, you know, before the victim of Natalee, and that why should he choose to be concerned about Joran attending university in The Hague? It just is unbelievable.

Beth would later go on to make the following statement:

Well, Nancy, I actually think there is, and I`ve had five of Joran`s statements that are printed in Dutch translated for me. You know, he states specifically in one of his statements, he prefaced it with, well, now, my third statement was not true, now here`s the truth. We drove — I drove Natalee to my home at 1:40 a.m. on May 30th. He says he has sex with her. You know, if kidnapping — and she`s coming in and out of consciousness when — as he`s describing her in these statements.

You know, if kidnapping and rape is not a crime within the Dutch government, well, then there is — then the Dutch government is serving no purpose.
