JUSTICE SERVED? Federal Jury Finds AZ Rancher Roger Barnett Did not Violate Illegal Immigrants’ Rights … However, Did Find Liable on Claims of Assault $77,804 in Damages

Talk about a crime …

Only in America can an “ILLEGAL” sue for having their rights violated. Talk about your oxymorons. It was determined that their rights were not violated; however, that did not stop a jury from awarding them money. That is correct, an “illegal” was awarded money for entering the United States illegally? What every happened to property owners rights?

Illegal Immigration Crossing … Your Private Property

A federal jury found Arizona rancher Roger Barnett did not violate the civil rights of a group of illegal immigrants who said he detained them at gunpoint in 2004 on his own property. The jury also found that Barnett was not liable on claims of battery and false imprisonment. However, jury did find Roger Barnett liable on four claims of assault and four claims of infliction of emotional distress.

A federal jury found Tuesday that a southern Arizona rancher didn’t violate the civil rights of a group of illegal immigrants who said he detained them at gunpoint in 2004.

The eight-member civil jury also found Roger Barnett wasn’t liable on claims of battery and false imprisonment.

But the jury did find him liable on four claims of assault and four claims of infliction of emotional distress and ordered Barnett to pay $77,804 in damages — $60,000 of which were punitive.

…All six plaintiffs are citizens of Mexico, five of whom are living in the United States with visa applications pending, and the sixth resides in Mexico but was allowed into the U.S. for the trial, said Nina Perales, an attorney with the Mexican American Legal Defense and Educational Fund. She declined to say where in the U.S. they’re residing.

It appears that Obama’s stimulus package and soon to be home mortgage bail out bill is not the only place where bad behavior is rewarded. As reported at Town Hall.com, now stopping illegals who are tresspassing and detaining them until the US Border Patrol arrives on your property is now considered against the law. Tresspassing illegals who let’s repeat this again were in the United States illegally were awarded $77,804 in damages, $60,000 of which were punitive. HUH?

How is anyone in the United States illegally allowed to sue for anything?

So not only were the plaintiffs in this case in the US illegally, they were also tresspassing on private property. Maybe some one in politics could actually grow a set and pass some illegal immigration laws and enforce them to protect American citizens so that they do not have to patrol their property and detain illegals.

Why is deporting illegal aliens such a foreign concept to our government? Why are politicians such cowards to address the issue in fear of being called a racist? One would say that rancher Roger Barnett should sue the federal government for having his civil rights violated in that they have failed to protect him as a citizen from enemies domestic and abroad.

This is absolutely absurd. They were on this man’s property. He has every right to defend himself and his property. I’m sick of catering to these illegals. They should not get one dime and should be sent back home. They were trespassing for Pete’s sake. If you want to live here, then follow the proper procedures. This country is going down the drain quickly when illegals have more rights than our own citizens.

This kind of stuff pisses me off

The saying goes: If you find a burglar on your property DONT SHOOT HIM !!! You have to kill him or he could sue you.

When viewed from the point of view of the socialist secularists, this makes perfect sense.

The progressives do not care about Americans’ rights. What they DO care about and are trying to do, is change the voting demographic to a more ILLEGAL immigrant base.

In so doing, the socialist secularists will get an electorate that will vote everytime for the Democratic party for providing them the ‘favor’ of giving them the rights that used to be solely reserved for this country’s citizens and permanent residents.

Federal judges in instructions to the
jury may have paved the way for this
illogical award of the property owner’s
money. Easier to suspect a liberal loon
of a Federal Judge than condemn an
entire jury (unless that jury of ‘peers’
consisted of locally selected illegals too!).

Please pass the common sense soup.

      Post 1-4, I agree.

The current administration hints they feel they know what is “best” for the citizens of America because we are not able to make these decisions for ourselves. why? do they not come from the same general population we do? What makes their ideas any more American or better for us than our ideas for our own lives and futures? Isn’t that what freedom was about, freedom from oppression? freedom from wrong to do right IMO…and we are being forced to just TAKE IT when we punish good people as if they did anything wrong.

Very concerned for us as a nation.

Perhaps this farmer (or illegals, if you will)could qualify for part of the stimulous package. Our government doesn’t see a problem giving our tax dollars to white collar criminals. Perhaps they’ll fork some over for these illegals too. When they go to deposit their check, maybe one of these bankers will guide them to the best off-shore location, to watch their money grow,………….until they get their next windfall of U.$. money.

Guess the old saying about ‘your home is your castle’ only applies if you leave the draw-bridge down and allow everyone free reign.

This has to be fodder for an SNL or Mad comedy skit.

      Assault?
They were not invited, they were tresspassers at the least and could have been home invaders or worse.

      Emotional distress?
For what, not speaking their language?

I may be wrong but if I were the farmer I would have been the one distressed at the advent of seeing a group of strangers on my property that were not invited to be on it.

what we need to do is find where the judge lives that allowed this case to proceed and send these illegal scum to his house.

“Only in America can an “ILLEGAL” sue for having their rights violated.”

No, not ONLY in America. The same thing actually happens in other countries that respect and enforce the rule of law. It’s crazy!

You might not believe it, but there are actually other places in the world that actually believe all human beings have certain inalienable rights that can’t be removed from them by any party, for any reason. And, get this lunacy: If you violate those rights, you’ll actually have to go to court, where your case will be argued, and a jury of your piers will decide your guilt or innocence! Damn! The world is going all pussy!

What is the world coming to when things like justice extend to people that I don’t particularly like?

What’s America coming to? Wasn’t this country founded on the idea that only certain people deserve to be treated in a lawful and just manner?

    10. baboy on December 22nd, 2009 5:08 pm

      vanHammersly, you’re an idiot.
This country is the absolute leader in treating people with fairness and dignity. And it is now being used against us by those who, instead of dealing with the US with fairness and dignity, rob us and illegally move here by the droves.
This man did nothing wrong. He kept people committing criminal acts immobile while the law arrived. In a fair world, they would have been deported immediately, any visa applications they had would be filed in the “Do Not Process – Ever” file, and they could rot the rest of their lives in the cesspool that they and their kind have created in Mexico.

I am sorry but illegal people in this country who entered uninvited are invaders and should be treated like any other group that invades our country yet they have groups fighting for them trying to get them housing jobs and all the assistance they can it has to stop we need to build a complete fence along our southern border and eletricify it and have a kill zone if any illegal is found on this side it and strickly enforce it Obama wants to create jobs put people to work building and patroling the border fence

    13. Gabby on February 9th, 2011 1:28 pm

This is absolutely ridiculous! Our country is being invaded on a daily basis. I would like to send $$ to assist this man in his fight for justice and the right to protect his property from these trespassers.
The recent strike down of the Dream Act is only the beginning. I wrote my Senator only to receive a response from him that maybe “special visas” can be issued for those minor children here through no fault of their own. HELLO???Who will take care of these children? Their illegal parents that’s who. This is just another smoke screen by those in power to push amnesty down our throat and make us take it. I say NO WAY. You enforce our laws on the books now or prepare to clean out your office and find another job. It is just that simple. I disagree with this and will continue to vote incumbents out of office every chance I get. The people of the USA have the power to get this problem solved it will just take time and determination.

Roger Barnett is a patriot and hero, serving on the front line of this war agains Americans! Our current administration, and a lot of our congress, are only too glad to look the other way, and provide attractive incentives to keep the freebie seekers coming. They are domestic enemies in this war.

These lowlifes coming across the border have no limits to their “me me me” attitudes, and “what are you going to give me” expectations. They do not deserve amnesty or citizenship in any form.

I welcome LEGAL, law abiding immigrants, from Mexico, or elsewhere. But I’m beyond sick of all the special treatment of ILLEGAL aliens with the tax dollars of hard working, patriotic Americans.

Not only should Roger Barnett not have to pay these criminals a dime, he should countersue ALL responsible for this great injustice. He should be paid for the damages done to him and his property, including the threats, perceived or otherwise, from the known drug traffic.

Seal our borders NOW! Send illegal aliens home now–NO AMNESTY! These costs would be minimal compared to the billions of taxpayer dollars that would be saved on food stamps, health care, welfare, and other benefits handed out like candy to illegal aliens. Rubberstamp Mexico’s immigration policy, and let them know we mean business.

Having said that, I support immigration reform, making it easier for those who apply legally, respect our laws, and wait their turns, to have a path to citizenship. These are the true patriotic immigrants in waiting, and I welcome them to this great country. Allow outlaws to stay and get free stuff, and more outlaws will come to get free stuff.
