Portugal Officials Open Missing Madeleine McCann Case File … Detectives Lied about DNA Evidence

Madeleine McCann went missing on May 3, 2007 while her family was Madeleine_McCannvacationing in Praia da Luz, Portugal. The Portuguese police name Maddy’s parents, Kate and Gerry McCann suspects in her disappearance.

Now after all this time and an investigation that provided no answers as to the whereabouts of Madeleine McCann, the Portuguese police are releasing Maddy’s file containing almost 30,000 pages of evidence from the investigation into the disappearance of  the little British girl. Presently, the case is closed, Portuguese prosecutors announced on July 21 that they were shelving the case due to lack of evidence.

The case of missing Madeleine McCann was a fiasco from day one. The mistakes, errors and bungling by Portuguese police put the investigation on par with that of the Natalee Holloway case in Aruba. According to released documents,Portuguese detectives lied to Gerry McCann about DNA evidence three days before they interviewed them and made them suspects in their daughter’s disappearance. It is obvious from the outset that the police looked to pin Madeleine’s disappearance on the parents as cops claimed this room contained the “smell of death” and traces of Maddie’s blood — allegations scientists found completely unfounded.

But detectives went on to tell Mr McCann, during an eight hour interrogation, that his daughter’s DNA had been found in the boot of the vehicle, which was rented more than three weeks after she vanished.

A friend of the couple said: “It was pretty clear they were seeking a confession and were prepared to do this (put forward false information) to achieve that.

“Serious questions need to be asked about why this was put to Gerry as fact. It was sloppy at best and deliberately manipulative at worst.

“A number of senior officers went down the route of making assumptions and suppositions and trying to force a confession to something that didn’t happen.”

This makes me so darned angry!! I said from DAY ONE!!! this sounds just like Aruba and what they did to Beth and Jug!
I was so shocked at how many people thought the parents had caused Mady’s demise. It shocked me.

I think the moral of the story is, be very vigilant when traveling abroad. We assume the same rights and liberties when traveling outside of our own Country but it just is not so.
Read Beth’s website Safe Travels and become educated and prepared when leaving your own soil for vacation.

So Madeleine vanished from the same room in which two siblings were also sleeping, but they were left unharmed. Sounds something like another case here … I THINK it was Danielle van Dam, but I may have the name wrong.

Too many horrors to keep in mind.

In the van Dam case, it was a neighbor, name of Westerfeld or something similar, who took her.

In this case, who knows? But I suspect that she was targeted … could she still be alive?

    3. brie. on August 5th, 2008 6:41 am

Another case of trying to accuse the family and placing them as suspects when the police knew better, I’m glad she didn’t answer their questions…lying and with holding evidence and DNA….that gave the abductor even more time to get away….I think Madelyn may be alive but who has a clue as to where…

Also the police lying about the blood when there wasn’t any…someone was closely watching that night and maybe previous nights as well…

    4. Rob on August 5th, 2008 6:47 am

I’ve probably followed this case as closely as anyone. Those defenseless seem to get my attention just a bit more than others.

My theory has always been that Madeleine was abducted. And I’m sticking to it.

I never believed that Kate and Gerry or any of their friends killed or abducted Madeleine. There were quite a few that spread disinformation in an attempt to convince many that the McCanns were indeed responsible. The McCanns are absolutely responsible for some of the events that led to the current situation – but I DO NOT BELIEVE THEY KILLED MADDY.

I have always contended that Maddy was abducted by a seasoned pedophile. A pedophile still roaming under the radar and unidentified. I believe time will prove me correct.

      Here’s what we know.

Robert Murat – an official arguido – knew about a pedophile ring operating in the area and told the police just that. That alone probably got him locked up. He’s a suspicious character – but there is no evidence he committed any crimes against Maddy or anyone else.

Sergei Malinka – a close associate of formal suspect Robert Murat – is a computer expert from Russia who wiped out several hard drives as police were about to kick in his door for a formal search. Both Malinka and Murat lied about knowing each other and their cell phone conversations – one of which took place on the night in question and was time stamped at 10 minutes after Maddy was reported to have disappeared.

There have been other abductions in Praia Da Luz – most notably – Joana Ciprino – who’s mother and uncle were framed and tortured by the same police that attempted to frame Kate, Gerry and the Tapas 9.

      - this case is simple – protect tourism in Praia Da Luz and frame anyone who might expose the pedophile ring. This pedophile ring runs deep and wide. An exclusive expose revealed that several years ago there were government officials that were not only involved in that specific ring, but were in fact abusing children that were placed in a government foster care facility.

      - some day the truth will come out here -

#1: “I think the moral of the story is, be very vigilant when traveling abroad. We assume the same rights and liberties when traveling outside of our own Country but it just is not so.”

That’s the moral of the story for you? Are you f-ing kidding me – That’s your “take away”?

How ’bout this: Never leave your 3 children all under the age of 4 alone in a hotel room in a foreign country while you go out to have a good time in a restaurant.

madeline is such a beautiful child. I am sure she was stalked for days prior to her disapprarance… possibly she was taken by perverts..

I never thought the parents were guilty.. like in aruba… the officials were incompetent… whats up with these countries are they not as trained as the united states is in criminology and forensics….

I hope they find her… I pray she is fine.. somewhere with someone that is taking care of her… you just never know..and maybe someday she will be given back to her parents.. they must be living a nightmare… I wouldnt be able to function… if It was me… its so sad…

YoYo is back…great…NOT…crawl back into your hole will you???!!!!!!

And I suppose the moral of Natalee’s story is don’t get drunk and in a car with 3 strangers right?

OK…you moron!!! QUIT BLAMING THE VICTIMS!!!!
Natalee most likely was given a date rape drug and thought she was getting a ride back…possibly even in a taxi!!! with joranasshole who was hanging out at the hotel all week and who the MB kids thought was a tourist from Holland staying at their hotel!! But in fact…he is a friggin’ sociopathic predator who had done it “20 times before”!!!

Maddie’s parents were no farther away from her and the twins than most people are when they put their kids to bed and then head out to the back yard for a nightcap with friends.

      A PREDATOR….ONCE AGAIN!!! stole a daughter!!!

And whether the parents were in the condo or not….if he wanted Maddie, which apparently he did…he would have found a way to get her…even if he had to wait until the parents were asleep. We have seen story after story of children being abducted from their OWN homes while their siblings slept beside them and their parents slept in the next room.

So NO…yoyo…I am NOT F-ing kidding you!!!

QUIT!!!! blaming the victims instead of the sociopaths!!! These F-ING PREDATORS!!! will get what they want one way or another…and nothing will stop their evil drives….so quit blaming the victim!! If the cops had done their jobs correctly…instead of using the victims as an excuse for their own ineptitude…I have NO DOUBT both Natalee and Maddie would be home right now and not lost in some foreign soil!!!

    12. Maggie on August 5th, 2008 5:56 pm

I too think she was the victim of a pedophile.. Always thought the cops blamed their lousy investigation on the parents. Never did think the parents did anything to Maddie. Never saw anything that would indicate that. The cops were insinuating that they hid a body for days and then drove around trying to get rid of it. Imagine the stench from keeping a body around. They should’ve called in someone right away, that could investigate it.

ldstlou, I agree.. When my kids were growing up we had 6 families that all lived close , one ran a catering business, we would all help out or get together at each other’s houses for cookouts etc. We would be outside in the yard or around the pool and the kids would be inside asleep and we would take turns checking on them.

Richard, never watched many cases on Court TV, but I did watch the trial for Danielle Van Damme and the sicko.. David Westerfield. They had all been out for the evening, they thought he got in through an unlocked garage door before the Van Damme’s came home and was in Danielle’s bedroom, when they got home, they went to bed and he then took her out the side glass doors, which was found unlocked. She was in her bedroom alone. You might be thinking of Poly Klass with the slumber party and the creep her out the window. These creepy predators usually watch for days before they hit.

Westerfield’s defense attorney was cutting a deal for David, guilty plea, he was going to tell where her body was, in exchange for life in prison, cops found her body first. The deal was off. What was really sickening was the attorney going to trial defending David as innocent after that and even trying to blame the crime on his son. Spending tax payer’s money for a trial, when he knew his client was guilty. Bill O’Reilly did a lot of shows about that. Now Westerfields doing time with Scott Peterson on Death Row. The defense attorney tried to trash her family over and over like they were to blame for what happened.

Once a predator always a predator, lock them up, and stop blaming the victims.

    13. richard on August 5th, 2008 8:43 pm

Rob (#4) … All the accusations against the girl’s parents, in my eyes, fall before this simple question: Assuming that they had malignant intentions toward their daughter, why would they wait until they went on this trip to carry them out?

To me, it makes no sense at all to blame the parents.

Maggie (#12) … You may be right; I could be thinking of Polly Klaas. If I remember, the abductor barged in on her sleepover party, bound and gagged the two other girls there, and carried her off.

In both cases, and probably with Madeleine too, the victim was under watch and some animal was plotting. I wonder if the key to Madeleine’s disappearance might be back in Britain … whether someone who knew the family there had targeted the girl for abduction?

I know it’s horrible to think about … unfortunately, that’s the world we live in.

Here’s another news story out recently; this Ohio woman took pity on her neighbor, a convicted sex offender. See the result:

Missing Woman Found Tied Up In Shed
      04 Aug 2008, 11:54 AM CDT

ST. CLAIR COUNTY, IL (KTVI — myFOXstl.com) —

A hidden camper became a torture chamber in St. Clair County, IL, early Monday, authorities said.

The man suspected of beating and tying up a woman in that camper, got a beating of his own.

The suspect remained hospitalized Monday night, after the victim’s son beat that suspect and held him until authorities arrived.

It happened in the 1200 Block of Scott-Troy Road outside of O’Fallon.

St. Clair County Sheriff’s investigators searched the camper Monday night; the camper hidden by a tall patch of weeds behind a home on the property; weeds so thick, the camper wasn’t even visible from the sky.

Neighbors and the victim’s son followed a foot-path to the camper and heard the 65 year old victim calling for help.

“And so then her son … he busted through the glass and unlocked the door and it was a rape in progress,” said the victim’s friend, Angie Swinford. “She was tied up. Her hands were tied up above her head tied to a table in the camper. Her feet were tied together. She was beat up. Her eyes were black and blue. She was bruised all over.”

44 year old John J. Burton lives on the property. Authorities have not yet named Burton as a suspect.

Fox 2 has learned Burton is a registered sex offender; going to prison in 1995 for raping and beating a woman in Madison County.

“Our victim was transported to a local hospital, along with the suspect and the suspect had extensive injuries from this altercation,” said Captain Steve Johnson of the St. Clair Coutny Sheriff’s Department. He is currently in sheriff’s department custody at the hospital … initial indication that this is an unlawful restraint, maybe even a kidnapping, very suspicious, a very serious crime.”

Investigators worried this might not have been the first incident in the camper. They did not say whether Monday night’s search turned up evidence of any other crimes there.

Authorities said the victim’s son would not likely face charges for beating the suspect.

Her friends said they were glad her son got to the suspect when he did. They hoped he had more coming than just a beating.

“I hope they really send him to jail this time,” said the victim’s friend, Jeanie Jeffries.

“She’s just the sweetest woman in the world. She’d do anything for you. I just can’t believe anybody did this to her.”

Friends said the victim knew the suspect well; she lives nearby.

One neighbor said she saw the victim get into the suspect’s van around 12:30 A.M., Monday, so they knew where to start looking when she didn’t come home.

#7 – I am 100% positive that you will not be given “Parent of the Year” believing it is OK to leave a 3 year old and two 2 year olds (toddlers) alone in a hotel room, in a foreign country, for 2 1/2 hrs while you dine 30+ yards away (even if they were checked on every 1/2+ hr). Example – So in your warped mind it’s OK to leave toddlers in a locked car in a parking lot while you dine 30yrds away for 2 1/2hrs – as long as you peeked at them every 30+mins? Unreal. I could go on with scenario after scenario. It is negligence on any scale. Leaving 3 toddlers alone in a hotel room in a foreign country is gross negligence and irresponsible beyond belief – defending that is sickening!!

“And whether the parents were in the condo or not….if he wanted Maddie, which apparently he did…he would have found a way to get her…even if he had to wait until the parents were asleep. We have seen story after story of children being abducted from their OWN homes while their siblings slept beside them and their parents slept in the next room.”
That is a “theory” of yours, not a fact. You are using this “theory” to defend the indefensible – leaving 3 children (two toddlers) alone in a hotel room for 2 1/2 hrs (only checking on them every 30+min), in a foreign country, out of earshot and eyesight range. Pathetic.
If you are a parent and you actually believe it’s ok to leave your 3 children all under the age of 4 in a hotel room by themselves in a foreign country while you dined 30 yds away then YOU are one sorry excuse of a parent.

Let me cite you Section 5106 (g)2 of Title 42 of the United States Code-Child Abuse Prevention and Treatment Act: “Any recent act or failure to act on the part of a parent or caretaker, which results in death, serious physical or emotional harm, sexual abuse, or exploitation, or an act or failure to act which presents imminent risk of serious harm.”
If this happened in the US, and any of the above was found to have happened to Maddy, these parents would be in jail.

and why would you inject aruba into this? The world doesn’t revolve around aruba, in case you didn’t know that.

Oh, and btw, I read Beth’s website The Safe Travels Foundation. You wanna know what it says regarding children? “Never leave the children alone, even for a minute.” That’s what it says and that should be your “take away” from the McCann disappearance. Maybe YOU should read the site before you call someone a moron.

If the parents of Madeleine McCann are not responsible for her disappearance, then someone else is. So why not focus on that someone?

Then again, I’m sure that Yoyo is going to blame Natalee Holloway for her disappearance. Why did she get in that car? She shouldn’t have gotten in that car. She’s to blame for getting in the car.

      (Note to Yoyo:

Getting in a car is not a crime.
Drugging a drink is a crime.
      Kidnapping is a crime.
      Sexual assault is a crime.
      Murder is a crime.
Disposing of a body is a crime.
Lying as a witness is a crime, or so the Arubans tell us … not that they do anything about it.

I agree that leaving children of that age is not a good idea … though I’m told that in Europe, it is a frequent practice.

But even if the parents let their guard down, the crime was committed by Madeleine’s abductor.

      Got it?

    21. yoyo muffintop on August 6th, 2008 8:47 am

    22. Maggie on August 6th, 2008 5:21 pm

Why wasn’t the Mcanns charged with neglect and child endangerment in Portugal if what they did is a crime in Portugal?

Jessica Lunsford, Danielle Van Damme, Elizabeth Smart, Polly Klass, Jon Benet Ramsey, the Lindbergh baby just to name a few of the high profile cases where a child has disappeared with parents or grandparents in the home at the time.

    23. yoyo muffintop on August 6th, 2008 9:58 pm

      Maggie:
      - Small children are vulnerable
      - People who become parents take on enormous responsibilities
      - The McCann’s chose to have children
      - The McCann’s chose to take them away to Portugal
      - The McCann’s chose to leave them alone while they went out to dinner
      - Responsible parents don’t leave their children alone in a foreign country
      - Being a parent is a 24 hour responsibility

Maggie – Care to disagree with any of the above points?

If the McCann’s wanted to have romantic holidays in the Algarve without having their fun evenings spoiled by children they shouldn’t have had any children.

If no charges are filed against the McCann’s for neglect/abandonment, it just goes to show you that it’s ok to be negligent even if it means exposing children to harm…as long as you have good barristers, lots of money, and the best marketing firms money can buy.

The McCann’s chose pallela over their children. Sad.

Anyone who defends the McCann’s actions and calls it anything but negligence is not fit to be a parent. Period.

Oh, btw, the McCann’s left the patio doors UNLOCKED. They didn’t just forget, they purposely left them unlocked.

How can one possibly say there’s no criminal negligence (these are 3 very young chilren) on the parents part when they:
Left 3 children ages 3 and under in an unlocked ground floor street side villa in a foreign country while they wined and dined for 2 1/2 hours 30+ yrds away out of sight/out of earshot of their children, checking on them only every 30 minutes.
      ________________
SM: Do you know how many people have done the same thing and nothing happened? Doesn’t make it right; however, it happens. I grew up in a house where there was never a locked door.

I think the point here is that the police targeted the parents and put blinders on to all else. One really must question why borders were not closed immediately and road blocks set up.

    27. Maggie on August 7th, 2008 3:53 pm

I am sure if the Mccanns knew then what they know now, they would have not went outside to eat that night.. Romantic evenings of fun every night without their children spoiling it? Haven’t read that anywhere, but here. I am sure they had a false sense of security friends staying in a group at the location. Didn’t say I would do it, but customs are different like England then the USA.. Portugal could’ve charged them with child neglect if they desired, whether they had money or not. I’ve read 30 yards away, 50(which the Mccanns say) and 60. How often they checked on them, I don’t know how often they checked on them.

When my kids were growing up at times 20 kids would be at my house..Anyone with small kids knows when the kids go to sleep or nap, that’s the time you can get things done around the home or yard work… Not sure at all what that has to do leaving a kid locked in a parked car in public at all. Young kids come home to empty houses everyday, due to parents working. Being in the home does not guarantee your child will not be the victim of a predator. Should’ve would’ve could’ve.. My focus remains on the predators, not the parents who screwed up one time.

Another case I remember is Shasta Groene.. the freak that broke into their home, killed the mother and her husband and son and took Shasta and Dylan, molesting him and killing him. Focusing on the victims does nothing, it’s the predators that need the focus on them. The cops chose to focus on the parents.. even telling them Maddie’s dna was in the trunk, when it was nothing but a lie. Little Maddie is still gone and the predator(s) are still on the loose for their next victim.

Like the BTK killer said he would watch his victim for days and dream about what he was going to do to them. Just like I believe Natalee was watched for days along with the other MB girls.

I too grew up in a home where the doors were never locked.

As for not reporting your daughter missing..for 1 day… Casey stated her daughter wasn’t just missing, but kidnapped..

AS 11.56.765. Failure to Report a Violent Crime Committed Against a Child.

      (a) A person, other than the victim, commits the crime of failure to report a violent crime committed against a child if the person

I know that in a lot of resorts in Europe they offer a “Baby listening” service, this entails employees walking through resort and listening at the door of apartments where people have requested the service, this is really what the McCanns were doing, although they were entering the apartment. Believe me I would NEVER feel comfortable doing this, i go on holiday with my family and we stay together, kids come out for meals and entertainment, it seems obvious to me, my problem is it seems exceptable for the resort to offer this service but the McCanns are villified for doing the same thing themselves.

I think a LOT of mis-information was given by the police but a HUGE section of the Brittish “GUTTER” press are just as guilty, it was disgraceful, and please dont believe that the whole Brittish public didnt see it for what it was, i really wish we could get back to “REAL” journalism!!! i just wonder how our cultures lead us down the path that these people, who really do have an important part to play in society, can put any-thing in their papers and get away with it, and more importantly, take the focus off the missing child.

Yoyo is right, the truth hurts guys. IT IS AGAINST THE LAW TO LEAVE A MINOR UNATTENDED; bottom line. That should be the one lesson that every parent learns from the Madeleine McCann scenerio. What is also sad is that the resort where the McCanns were staying also offered babysitting services, the kids didn’t need to be left alone.
