All we can say is, why are we not surprised. There is some justice. One wonders what the three suspects were afraid of with sentences like this.

Amigoe: Mandatory support for sexual offender  

ORANJESTAD – An 18-year old father to be is convicted to four months imprisonment conditionally and 60 hours community service, because he had sex with a 13-year old girl, and at the same time, impregnated another 14-year old girl.   The 13-year old girl, M.G. lived with David Regulo Henriquez in the neighbourhood.  The two had sex with each other from March up till and included August of 2006.  When the mother of the girl learned about this, she contacted the police.  G. declared that she is in love with Henriquez and that the grandmother of the boy had encouraged her to go to the boy.  Both declared having had consensual sex.   

During a background investigation on Henriquez, it turned out that he also had a relation with another minor, who got pregnant from him and is due in April.  Both Henriquez and G. were tested for venereal disease and the result was that he has no STD , but she does.   YOUNG The Public Prosecutor decided to prosecute, due to the young age of the girl.  “This suspect needs support and guidance.  He needs to realize what the consequences are of his sexual preferences for such young girls”, said the public prosecutor. The judge admitted having a problem.  He said that only the sexual offence with the 13-year old girl will be prosecuted and not the fact that he has impregnated a 14-year old girl.  “But it is important that the OM doesn’t want to consider the two cases separately.”  The judge said that with his 18 years, Henriquez is too young to become a father, but his unprotected sexual relation with two minors is morally alarming.   GET MARRIED Henriquez said that he wants to marry his girlfriend after she gives birth.  He wants them to take care of their baby together.     The girlfriend still lives at home with her parents and Henriquez’s parents live in the Netherlands .  The girlfriend wrote a letter to the judge telling him that he loves Henriquez and wants to be with him and their baby.  She also said that her parents do not approve that and want to keep him away from her. The public prosecutor demanded a conditional imprisonment of four months and two years probation, 100 hours community service, and rehabilitation surveillance against Henriquez.

      Thats better justice than the American Judges give. Sex offenders in the USA are not even given a slap on the wrist.

      Can any Aruban posters/supporters fill us in on whether the NEW ATTORNEY GENERAL has had the letter retracted which named Paulus ‘no longer a suspect? You know, the one written by his friend Karin Janssen and used by his black robed judge buddy to declare him no longer a suspect?

      This letter makes it impossible to prosecute Paulus without reversing the judgement due to Karin and the Judges overwhelming conflict of interest. It also seals the crime scene (Paulus’ home) from ever being searched. I know how you have played with your laws, Aruba, in order to distance Paulus from his crimes. Time to bring him down.

      I understand that the US is not perfect, but it also is not our standard procedure to give sex offenders a slap on the wrist!

      Oh, and the punishment is so incredibly harsh as well…..(Not) it does make you wonder what the worthless Van der Sloots were afraid of in the first place! I’m with #3 in with the “big headed men”!

      #1…thats a silly thing to say…lenient sentences are not the norm in the US and when they are handed out usually all hell breaks out calling for that Judge to be removed from the bench.

      Something tells me that isn’t happening in Aruba right now.

      How refreshing to see some sanity from the Aruban justice system. Hopefully a change in a new direction.
      They didn’t even buy into them saying it was consensual, like a 13 year old can consent to anything sexual.
      Overly optimistic I know but lets give credit where credit is due and encourage them to keep it up, right? :)

      What we don’t understand is that these people don’t view sex the same way we do. It’s sexual gratification thing, and if it takes drugging a young American girl to satisfy their urge – and she accidently dies – just write it off. What’s the big deal?
      They just want sex and if they can’t get it consensually, they take it by force and age doesn’t matter. A 12 year old will be an adult someday.

      I wonder what it means by “conditional” imprisonment.

      The girl had sex with the guy from March to August. She also lived with him, meaning, I take it, in the same house. Presumably this was known to the mother.

      Yet it says “when the mother found out.” Can we assume that she closed her eyes to things before that? Seems very odd. Had her daughter been living at home before?

      A slap on the wrist?

      In the U.S., anyone convicted of statutory rape, the sexual assault of a minor, has to serve time, up to 20 years; and has to register as a sex offender for the rest of their life where they are not allowed to work or live around children… at least that’s the law where I live. The only problem that the U.S. has with it’s laws is that it is nearly impossible to enforce them. These people refuse to keep their registry current and reoffend all the time.

      Someone said that Egypt hangs their offenders, the first time, because they have found that sexual predators do not respond to rehabilitation… sounds like a pretty good idea to me.

      Now, I didn’t say the sentence was satisfactory. By no means do I think that. It’s just when the bar is already set so low that they do even a little something right I say let them know about it so perhaps they may be encouraged to do the right thing more often.

      I did say I was being overly optimistic, I don’t really think much will change but I feel if it’s even for 1 girl having a better time of it then we do well to encourage justice…even if it’s just a babystep.

      Can anyone tell me exactly how women are protected in any manner in Aruba?

      I remember in the very beginning of the Natalee Holloway case that some of the Aruban posters were upset because they stated that if the same happened to them as Natalee, no one would have cared, looked or attempted any types of the same searches.

      The truth is they were probably right.

      Having sex with a 13 and 14 yo and some how its considered ok. GEEZ. Why is anyone taking their daughters to Aruba on vacation?

      Is this definitely true? If so, it will be confirmed in short order, I would think.

      Why send TEN? To me, that suggests either another search party or a group that is prepared to conduct large-scale interrogations. Certainly any arrests would be left to the Aruban police; the Dutch wouldn’t have authority to do them.

      It might mean something, if it actually is the case. We’ll see.

      The 10 people coming to Aruba will be declaring this case cold.

      Aruba has done everything to distance Paulus from the crime. Legally, at this time, he is untouchable (as perfectly orchestrated by Aruban Law Enforcement and Paulus’ Justice Department buddies).

      Unless the 10 people coming are coming to influence the NEW ATTORNEY GENERAL to retract the Karin Janssen letter stating Paulus is no longer a suspect (a letter written with overwhelming CONFLICT OF INTEREST) this case is going nowhere. That letter allowed Paulus’ judicial buddies to extract him and distance him from his crimes. Without Paulus in this case, it is a cold case. He is your PERP!

      Sorry to harp on this folks, but we can rip on J2K and the corrupt island all we want. The fact of the matter is — legally, Paulus and his Aruban co-conspirators (acting under the Color of Law) have utilized the Aruban legal system to protect and isolate Paulus. It is more than blatantly obvious that extra efforts were made to make this ‘Legal Onion’ very difficult to peel.

      How ’bout it 10 Dutch investigators??? Seems to me it is very clear what needs to be done. Are you going to get the job done or perpetuate the cover-up. Are you bringing your suntan lotion…or are you going to string up all of the perpetrators in this house of cards…beginning with Paulus?

You will note, I have been harping about this for 4-5 months – not once has a AHATA shill or an Aruban, or even Yoyo Muffintop challenged the concept of retracting Karin Janssen’s letter and bringing Paulus back in. All seem intent on being trolls and diverting attention from the true perp, Paulus, to J2K. They all know that the facts of this case are irrelevant. The legal shenanigans pulled by Aruba have made it so the real facts against Paulus are untouchable.

      I am not sure who would be worthy of contacting. Any newspaper on Aruba is not going to touch this with the exception of Jossy’s paper. Jossy has been exposing these bums. It is true (to my knowledge), however, that Jossy has not touched the judicial shenanigans played out to protect Paulus. The main reason, I believe based on what goes on here in the US, is that once you go after judges and the ‘integrity’ or the system…the gloves are off. You will never win in their courtrooms in the future – regardless of the evidence. You will note where you live that you never hear about judges and their back door deals in your paper. The only time you see them hung is when they have done something externally to a case (i.e. using a penis pump while trying cases, DUI’s, etc.) that embarasses the court. Otherwise….backdoor deals are done every day. The papers do not touch judges unless they are compromised beyond the point of no return.

      I do believe that this is going on in Aruba. It all comes down to the 10 Dutch at the island. Are they there to suntan? Or, are they there to begin the path of taking down the criminals by requesting Karin Janssens letter is retracted. John Q Kelly knows this is how the system works (at least here in the US)…as you will note he never has blatantly pointed out and exposed the judicial misconduct and the blatant use of the law and Judges to distance Paulus from his crimes — it would be the kiss of death for attempting to get anything done for the Holloway’s by exposing the Judicial corruption. My money, unfortunately is on the suntans for the 10 ‘investigators’.

      Though, I believe John Q. Kelly would admit that the only way this case gets solved is for Paulus to be compromised to the point where his colleagues and the press turn on him. I do not have the power to do this….John Q. Kelly perhaps does.

      p.s. Does anyone know what happened to the Kalpoe case??? It seems to have gone very quiet. I don’t recall…did they drop their action after getting served a swift butt kick???

      If they are indeed sending the ten people over, whether to conduct more interviews (maybe they’ll re=interrogate the Kalpoes, or some of the Pimps, or maybe Papa vdS) or to do a search … let’s hope they call in Joran for questioning.

      Where are the parents? Where is the mother of the young girl that continues to run around to the point of catching a sexually transmitted disease from other partners? I think she deserves to go to jail more that the youngster that had intercourse with her 13-year-old daughter.

      This matter is intimately related to the consequences of adolescents growing up in broken, dysfunctional homes, with negative and isolating family experiences, whether in China, Aruba, Patterson, N. J., or Rome. It is a sad personal story that has no relation with investigative incompetence and negligence in the process of dispensing justice.       Alright, this is a bit bizarre. I did some research on the Kalpoe cases in LA. On April 2nd, a motion was made to add JQK as the attorney for the HT’s under a Pro Hac Vice motion (meaning that the attorney is not licensed in the state but they are asking the court to allow him to participate due to his intimate knowledge of the case). At the same time, the Kalpoes have filed a Pro Hac Vice motion to add Edmund J. Siegert to represent the Kalpoes. EJS is a product liability and toxic tort claims attorney from Chicago.

      Can someone please explain why a product liability and toxic tort attorney would be on this case? Could someone else explain why a Chicago law firm is representing these bums in a California case? Finally, who is paying for these guys??? There is no way in hell a Chicago firm would take a case on contingency that they file in a California court. Someone is dishing out cash here and it ain’t the Kalpoes…..but who?

      Then, on April 6th, the defendants file to remove Mr. Siegert from the case.

      Then, a Notice of Reassignment is filed today. I believe this is reassigning a judge. Typically, a party in the case has the opportunity to ask for a new judge. A plaintiff would ask if they had a judge who had a history of being an idiot, being corruptable, has conflict of interest, or, just being plain incompetent towards these issues. The Defendent would want a new judge if the defendants felt the judge was dumb enough to write wacko orders (and in California this happens all the time!), was incompetent, was corruptable, had conflict of interest, or had a history of ruling favorably towards loser defendents.

      The question is, who asked for the reassignment??? md

      BTW, the next hearing is May 16th, to hear a Motion to Quash regarding the service of summons on the Kalpoes. It appears that the defense is trying to quash (eliminate) the service of summons on the Kalpoes.

      I remember that the HT’s felt it was a big deal that the Kalpoes got served up in Aruba. I wonder what the Kalpoes are trying to do with regard to this service.

After the state appealed the sentence, he finally upped it to three years.       MD … What in the world IS a “toxic tort”? And is the move to quash the serving of the summons (which I always thought was just part of the bureaucratic procedures of the court system) in effect an attempt to deny the legitimacy of the Holloway Twittys’ suit?

      Could the Dr. Phil show try the same thing on the Kalpoes?

      Would appreciate your thoughts on the above. Sounds to me like the usual pre-trial maneuvering that lawyers do, but I’m a neophyte in these matters.

      As for the Dutch, who knows if the story about their being on a narcotics-related mission is true or just “cover.” It could be that the blogger heard that ten Dutch were going to Aruba, and assumed that the trip was related to Natalee.

      It goes from Aruba to Holland, back to Aruba, back to Holland, and back to Aruba.

      The final stages of the one of the worst cover-ups in the history of cover-ups is almost complete. Thank God the Dutch never tried to over-throw the Queen. The conspirators would be discovered in less than 24 hours not by the Dutch themselves, who wouldn’t recognize a conspiracy unless it was sitting under a stack of unmarked Guilders, but by the FINGER POLICE.

      The Natalee Holloway case is SOLVED. It’s not a secret what happened to Natalee. In fact is not a secret who did what afterward. The only people still undecided are the Dutch Investigators, Joran Van Der Sloot, and a dwindling handful of internet trolls.

      Joran Van Der Sloot has revealed he is still not ready to tell the truth. So, we will have to wait until that ‘someday’ arrives.

      You would think an innocent man, as Joran Van Der Sloot claims to be, would volunteer to sit down and CLEAR HIS NAME before the two year limit arrives on 6-9-2007. His name is anything but clear.

      The Dutch investigators are not investigating anything at all. They are tying up the remaining loose ends on the Natalee Holloway case. If they were serious about getting results, they would have re-interviewed Joran Van Der Sloot at least once over the 18 months seeing as how he has been residing in Arnheim Holland. He is relatively easy to find.

      The Dutch Investigators could argue that interviewing Joran Van Der Sloot is not worth the effort. He is the World’s Worst Liar, and what would be accomplished by interviewing him? He is an adult now. Interview him without his father sitting there holding his hand might actually get somewhere and he may have forgotten some of his initial lies and he may be caught in a flurry of lies that he is not smart enough to spin. That is all predicated on the fact that the Dutch would actually ask the correct follow up questions this time. He might also decide it’s time to come clean and tell what happened and the roles played by others. We will not ever know the answer to that one because the Dutch Investigators have not and do not intend to interview the last person seen with Natalee Holloway. Nothing is assured here.

      How could they ever get a conviction in the muscularly challenged Dutch Judicial System?

      A conviction in this case would come from cell phone, internet and text message traffic. It would also come from video footage of the Excelsior Casino and Holiday Inn, wiretaps, from Paulus Van Der Sloot’s banking records, and from the statements of those witnesses and NOT suspects. It should be a slam dunk, and it should have been a slam dunk a year and a half ago. It’s really not that complicated, unless you ignore everything that has been discovered (accidentally released) to date.

      Will there ever be a trial? In all likelihood, no. The reason is simple. Joran Van Der Sloot might actually get convicted. I know that sounds crazy, but in the Dutch Judicial System anything is possible. He could get convicted by accident. However, in the closed door Dutch Judicial System that operates in the cloak of darkness, it would be hard to imagine. Declarations and summary evidence would be thrown out and no one would ever be the wiser.

      Few Judicial Systems in the twenty-first century operate in a closed door fashion. Only Totalitarian Systems still screw VICTIMS. That is what we are really dealing with here. A Society that portends to be open and elects officials, but in reality is still a Monarchy. This is the clash of cultures you often wonder about. There are many that miss communism in the old USSR. And there are many that miss the good old days of nepotism, cronyism, and outright corruption in Holland. Monarchies are legalized corruption.

      You can be assured that the Dutch have a new respect for the Americans. They now realize we are not easily fooled. They thought this was going to be over in 3 weeks, they learned the hard way that things have changed. They never ever imagined we would kick the snot out of their System, their cronies, their repulsive way of life, their outright lying, and their outright protection of a murdering, raping psychopath and his father.

      Will Joran ever go to jail? Yes, he will. There will be another VICTIM down the road. A VICTIM that never needed to become a VICTIM. If the Dutch would have done the right thing in this case, there would not have been a ‘future VICTIM’ for at least 15 years.

      And we’ll all be back to do it all again.

      Lastly, remember when the Dutch sent their Investigators to Aruba in months past? Remember they never interviewed any of the suspects or witnesses. What makes anyone think at this late date they all of a sudden decided to do the right thing?

      #69 – Actually Richard, this is not ‘pre-trial’ maneuvers, but rather ‘pre-discovery’ maneuvers to attempt to get the case dismissed.

      Typically, when serving someone, you would serve them on/in the jurisdiction of the court where the suit is taking place.

      JQK and company are trying to use the Kalpoe’s volunteer jurisdiction in suing Dr. Phil as their jurisdiction.

      I believe the significance of serving the perps in Aruba was that it means that they have received the complaint and summons to appear in court. The motion to Quash probably is pleading that California is an inconvenient forum for this case and that these folks don’t even live in the United States.

      It is a grey area – does the suit against Dr. Phil open up jurisdiction in California for the Kalpoes. The joke of our legal system is that there is definitely case law to support either position. If there isn’t case law, but a judge wants to stick it to a party in a suit…they just write up a judgement the way they want the suit to come out. It is then appealed and if the appellate court also wants to support the lower court not following established case law, they affirm and present an ‘unpublished opinion’. An ‘unpublished opinion’ cannot be utilized as case law on future cases with similar characteristics — thus, through backdoor dealings, our legal system can screw someone they want to screw by backdooring with an ‘unpublished opinion’.

      So, hopefully we have a judge with the guts to hang the Kalpoe’s even if there isn’t any case law supporting. Then, if that happens, hopefully we have an appellate court that is equally inept that will affirm with an ‘unpublished opinion’…..then, the Kalpoe’s are screwed…as are the people who are financing their Chicago attorneys. md

      Thanks for the info, MD. What you say almost seems to support my private belief: that there are so many laws out there, the judge can basically steer things whichever way he feels like. What can be done to the Kalpoes is another issue, and I certainly don’t have a clue.
