James Pacenza, Sex Addicted Man Sues IBM for Chat Room use … Blame it on Vietnam

 

Just when you think you have heard it all, along comes another heading spinning Surfing_pornlawsuit. 58 year old James Pacenza is suing IBM for wrongful termination. Seems that James would frequent adult chat room on IBM work time. His lawyer claims that Pacenza has violated no IBM rule and “did not surf the Internet any more or any differently than other employees. He also says age discrimination contributed to IBM’s actions”. They claim that Pacenza needs therapy, not a dismissal. How is this IBM’s problem or anyone else’s?

The excuses gets even better or more pathetic as the case may be. Seems that James Pacenza blames his “sex addiction” on Vietnam post traumatic stress and the development of the internet. Dude, you were surfing porn at work, bu-bye!

WHITE PLAINS, N.Y. – A man who was fired by IBM for visiting an adult Surf_porn1chat room at work is suing the company for $5 million, claiming he is an Internet addict who deserves treatment and sympathy rather than dismissal.

James Pacenza, 58, of Montgomery, says he visits chat rooms to treat traumatic stress incurred in 1969 when he saw his best friend killed during an Army patrol in Vietnam. (Yahoo News)

In papers filed in federal court in White Plains, Pacenza said the stress caused him to become “a sex addict, and with the development of the Internet, an Internet addict.” He claimed protection under the American with Disabilities Act.

 Blaming Vietnam and the internet? Seems that this guy should be suing The Pentagon and Al Gore. After all, All Gore did invent the internet.

      So should I sue for being too young and female to be drafted for Vietnam? I am so sick of hearing about the glory days of Vietnam which gave rise to Jane Fonda and her ilk. I think that those from WWI and WWII probably suffered terrible atrocities as well, but for the love of all that is good,they came home and functioned. Of Course that may have had something to do with the fact that Jane Fonda et. al weren’t busy saying horrible and later to be found, untrue, things about them. I can’t decide if he deserves to get money or be slapped…. as always, JMHO

      When will we start making those that lose these types of cases to pay for opposing councils legal fees?

      That will put an end to these frivolous law suits.

      Attorneys that take such cases should be reprimanded.

      is this guy from aruba? never have i heard such off the wall excuses and attempts to slough off responsibility for what he has allowed himself to do, except for arubans. maybe he owns a timeshare on aruba, there has to be a connection there.

      The guy has 19 years in IBM. People had sex on their desks and were not fired! Give him a second chance.

      the employee loses his pension rights over a stupid web surf? He didnt break any laws. He’s fighting big business for a second chance. IBM should think twice before taking such a serious final action.

      Who said anything about losing pension rights? If it’s a federally approved plan, he’s fully vested in 5 years.

      Just because IBM is big doesn’t mean he’s “fighting big business.” He is full of lame excuses. He’s not a sex addict because of Vietnam; he’s a sex addict because that’s what he’s feeding. When you have a problem, get someone to hold you accountable. There is some good software for that. My guess is that he spends a lot of time at home feeding his addiction. Isn’t there a “Sex Addicts Anonymous?”
