Breaking – Kalpoes Sue Dr. Phil – Holloway Family and John Q Kelly Answer With Wrongful Death Suit

 

We are getting reports in that there has been a flurry of legal activity in the Natalee Holloway disappearance. This is all breaking rather quickly and we will update when we get solid information in. First Satish and Deepak Kalpoe filed a lawsuit against Dr. Phil for playing the edited video tape created by investigator Jamie Skeeter. This is where Deepak allegedly said that they all had sex with Natalee “you would be surprised how simple it was”. Then in a surprise move, John Q Kelly filed a suit on the behalf of Natalee Holloway’s family against Deepak and Satish Kalpoe for wrongful death in a California court.

“All we want is justice for our daughter,” Twitty said in a press release issued about the civil case. “There is no doubt in my mind that Deepak and Satish played a role in my daughter’s death and should be held accountable. It’s unconscionable that they have not been punished so far.” Allegations against the Kalpoes, who are residents of the Caribbean island where Natalee Holloway was traveling on a class trip when she vanished without a trace, say the brothers caused her death by “intentionally, negligently, wantonly … unlawfully conducting themselves,” bringing about injuries that proved fatal.       My first thought…..Hot damn!! The Kalpoes filed suit in California so they are subjecting themselves to California’s jurisdiction!!!!!! Remember the NY case where Joe Taco Sloot had the case thrown out ON A TECHNICALITY because NY did not have jurisdiction….there was nothing tying Joran Sloot Slime to NY so it was thrown out???

      Hopefully this leads somewhere positive, resulting in Beth and Dave getting the answers they deserve. (Hear that splashing sound??? That’s Aruba’s apathy and corruption sinking them further in the ocean)

      Why would Satish be involved in the suit? Skeeters interviewed Deepak only. I don’t think Satish was ever brought up…except for the line, “We all did…you don’t know how easy it was that night.”

      Second…how can they PROVE the tape was altered? A non-biased judge or jury should listen to the original tape to make that decision. I personally don’t think it was altered. It was ‘edited’ for TV time.

      Great!!! I have ALWAYS felt that Deepak was the instigator in this whole thing. I got a whole different slant on the conversation that the Kalpoe brothers had with Joran in jail. I got the impression that Deepak was baiting Joran and told him that they gave up Joran’s father as payback for confessing about Natalee and taking the police to where the body was suppose to have been buried (but the police “null and voided” Joran’s confession and someone had moved the body.

      Anyway, that’s beside the point — Deepak and Satish are filing in California. This is the state where many of the advanced sound techniques and the latest computer software has been developed. So this is a good state to review this. (None of this crap from Holland!!)

      Also, the fact that the Kalpoe’s are filing this lawsuit in California will tie them into this state — so won’t that make it legal for the Holloway/Twitty’s to file a wrongful death suit against them here?

      Remember, once the state of California get’s its teeth into something ….. Look at the Laci Peterson case and a few others!!!

      I certainly hope that the Kalpoe brother’s get what they deserve.

      We are coming down to the conclusion of this case. In the legal world, when you are cornered like a badger you come out fighting.

      Clearly that is what is happening. Toe Tacopina – who has nothing to do with the criminal proceedings – and amazingly is viciously fighting on behalf of his past clients (or is someone still paying him on a retainer to do what he is currently doing!?).

      Now, the Kalpoe’s are throwing their shots in a last ditch attempt to tell anyone that is going to come after them that they are going to fight like hell. WHO IS PAYING FOR THEIR ATTORNIES???

      It is becoming very clear. Things are falling apart fast and they have to scramble to deflect attention away from the crime. This is how the final steps of a blown cover-up ends up — everyone suing everyone — pointing fingers everywhere— in order to distract from the business that needs to be done.

      AND REMEMBER — UNTIL PAULUS VAN DER SLOOT’S TIMELINE IS COMPLETE FOR THE NIGHT OF NATALEE’S MURDER, THIS CASE WILL NOT BE SOLVED. VOID ALL CORRUPT JUDGEMENTS NOW ARUBA!!!

      As I think about this more….this is really bizarre news. Why would anyone from Aruba open themselves up to jurisdiction as the Kalpoes have?

      Can the Kalpoes pay their attorneys on one suit, but default on another stating they have no money for attorneys?

      I find it very, very hard to believe that a lawfirm would take this case on on a contingent basis. No way….too risky…a lot of time put in only to not win. Maybe they are like the ‘flying imams’ and they are just expecting a quick settlement to fund their drugging and raping of girl’s in Aruba.

      Soooooo, the Kalpoes are a poor family from Aruba. Who is paying for their legal bills to do what they are doing. Why would they stick their necks out with something as stupid as this?

      Further, this just brings everything out for Fox and the tabloids to have material for the next six months. Why would the Kalpoes benefactors (either drug lords or Aruba Tourism Authority) be so stupid as to bring more attention on to Crime Island?

      The only logical explanation I can come up with, based on everything that has gone on is that Aruban & Dutch Investigators are attempting to drag out and obfiscate their duties to get the criminal case wound up down in Aruba by setting up some diversions in the US. This is about the only thing that makes sense.

      This one has me big time puzzled….but should make things interesting over the next few months as attorneys rangle……md

      You are wrong. The NY case has nothing to do with this suit. It was thrown out due to lack of jurisdiction. Joran was sued and the only thing that gave a prayer of jurisdiction was that he was served on American soil.

      The Kalpoes have filed the lawsuit on American soil and have opened themselves up to litigation in the jurisdiction where they filed.

      It will cost the Kalpoes at least $100,000 to get this dismissed. Where is the money going to come from???

      As I keep thinking about this….it all comes back to this is another diversion to take the focus off of the responsibilities of Aruban and Dutch investigators who are under intense pressure right now due to the enormity of the cover-up in Aruba.

      It was worth taking the risk of a lawsuit to get DeVries & co off of their backs.

      Nice try Aruba….board up your businesses….we ain’t coming! md

      Minnesota dad..how are you so sure that they going to lose this case..This is fraud..so could be a easy case for the Kalpoes to win..dr Phil didn’t want to settle..but knows that the tapes are tampered with..I heard that his own people took a look at this tape and confirmed that the tape was false..Dr Phil even offered to do 5 shows about Aruba and to apoligize to its people for the boycott and the tape etc..so we all know the tape is false..now we have to see how well your system works…I hope its better then ours…

      The Kalpoes will have to come. They created jurisdiction. They need to be deposed. Since they created jurisdiction in CA, they have to be deposed in CA. Keep in mind, they are the PLAINTIFFS in the Dr. Phil suit.

      As PLAINTIFFS, they need to show up for depositions or else Dr. Phil’s attorneys can have the case thrown out. (which…will happen when all is said and done). Yes, if they refuse to come to the states there will be a default.

      Again, someone is paying for the Kalpoes and this is all part of a scheme to deflect from the real work that needs to take place (but won’t be) over the next five months in Aruba, as well as deflect from the current immense pressure being placed on Aruba. You can bet on it.

      I don’t know who has been paying for the Kalpoe’s attorneys thus far, but I have a pretty good idea of who will be offering to pay for them right now. The Kalpoe’s have the power to incriminate Joran and Paulus. The VdS’s will make sure they get involved, just wait and see.

      If I was the Kalpoe’s I would be watching my back!! They are a couple of lose cannons at the moment…..that can be a very dangerous thing!!

      This is very good news. I could give a rat’s arse what happens to Dr. Phil. I don’t know if the tapes were altered or not, but I do know that Dr. Phil, the drama queen, used this case to beef up his ratings and I find him to be very disgusting. He is so melodramatic and I think he used Beth Twitty in a very sick way. I have refused to watch his program since he had Beth on the show because of the way he handled the situation. On the other hand, I think the K-2 or guilty as hell and I’m hoping all of this will lead to answers and the justice Natalee’s family deserves.

      In civil suits, they have to take the stand and answer questions. Anything they said and did can be used against them. They won’t win a lawsuit against Dr. Phil. More lawyers going after big money people. Dr. Phil was on Larry King last year and said the tape was edited to show the parts they wanted on his show. No way could they play his entire tape and have the guests and all on in a 1 hour show. I’ve seen different experts on shows listen to it and one says Deepak said we did and another says he said we didn’t. It’s a matter of how you interrupt it. They would have to show Dr. Phil’s intent to mislead what it said. How are they going to get inside his head and know how he heard it? All of those police statements can be used against the 2 of them. I assume JQK would be entitled to have a copy of all the police files for a suit.

      I also have to agree that I can’t figure this one out. Either Kalpoe’s US attorneys are pulling a fast one on them or they have the world’s dumbest attorneys. Yes, they are now opened to the US jurisdiction. You can’t sue in US courts and then claim no jurisdiction when someone sues you back.

      Let’s say for a moment that the Skeeters’ tape was doctored. (I don’t Jamie Skeeters is dumb enough to dump his career in the crappier for this, but let’s just go with this for a minute).

      There’s a little thing in the US courts when you sue for damages called proving your damages. I discuss this at my blog but the base question is: where are their damages?

      Deepak for a long time has looked for a way to make money off of natalee. He mentioned it in those same tapes. He was most interested in finding out from skeeters how he could bank big money from oprah or dr.phil and that is one of the reasons he showed up. Writing a book is not a good option as Joran has his own book coming out soon. He obviously thinks that these tapes were altered or he would not have filed the lawsuit. He knows what he said.

      Truth is he looked alot smarter than skeeters in that tape and skeeters was easy to figure out. He wanted the lie detecter and deepak wanted to fish for information and make contacts for a book/tv deal to make big money.

      He knows that they all confessed and they did so 18 months ago!! His own justice system covered up the crime and he can deny everything since he is being protected and evidence has vanished.

      I think deepak hates Joran now and it wouldnt surprise me at all if he wants this to end. At first Joran said he was being set up by the kalpoes. Then deepak may have killed the girl. Then Joran lied as best he could to keep the K2 brothers out of it as he knows they would turn on him. Last time they were all in jail they were all pointing fingers at each other and it was getting heated. He knows Joran is a spoiled punk who got away with murder.

      In his own admissions he said he lied for himself. He would probably do a few years for the rape,kidnapping and drugging of natalee. But he knows who killed her and disposed of her. He knows he will hurt alot of people including his relative Gerald Dompig. Would not surprise me at all if he has received death threats and it wasnt from the holloway supporters.

      The deal I am sure was to lie for himself,satish and joran and all his lawyers fees would be covered. He would be a free man as long as he stood by the sloots plan.       Maybe someone from Aruba can explain what Hammer pointed out. Deepak went home on Sunday night after letting out Joran and Natalee. He went home and chatted with John Croes. He told John Croes the girl(Natalee) put her hands down his pants. When he was asked by police about it. He said he did it to mess up the investigation and throw the police off. However Sunday night noone had any idea that Natalee was missing, or dead.. There was no investigation on Sunday night. The cops didn’t even know until 3am early Tuesday morning when Beth arrived at the VDS’s with them. How much clearer does it need to be, that they knew something was wrong and there would be an investigation. Or is he like Paulus and has esp also, no body, no case?

      Deepak June 11th said he went home and talked to John Charles Croes on Sunday night after dropping off Natalee and Joran.

      To your question as to how late we got home, I can say the following. We arrived home approximately 02.20 hours.

      When we got home Satish immediately went to bed. I had switched on the television. I had also turned on the computer in my room. I went and chatted with a friend of mine on “MSN”. His name is John Chartes Croes. I had told the afore mentioned CROES during the chat that we had gone out and that I was waiting for a friend of mine because I had dropped him off on the street together with a girl.

      To your question as to why I was waiting for Joran, I can say the following. We always do that if one of us has stayed on the street we wait. To your question as to what does that waiting comprises of, I can say the following. Waiting means that we call each other and say everything is fine.

      Natalee was last seen alive in a grey Honda with the Kalpoe brothers and Joran van der Sloot on the morning of May 30, 2005 in Aruba during a school trip. The Kalpoe brothers were both arrested and charged with her murder, but have yet to be brought to trial by prosecutors in Aruba. Due to their conflicting, and admittedly fabricated, accounts of what happened to Natalee, as well as strong circumstantial evidence, the Kalpoe brothers have remained two of the prime suspects in her disappearance and presumed death.

      This past week an Aruban court denied the Kalpoe’s request to be cleared as suspects, and Aruban prosecuting attorney Karin Jansen recently returned from Holland where a new team of Dutch investigators is reviewing all evidence against the Kalpoes and others.

      In a civil action such as this one, nine out of twelve jurors need to conclude, by a preponderance of the evidence, that the Kalpoes were responsible for Natalee’s disappearance and death.

      From what I have heard and seen, the basic idea of this lawsuit is to do what (we are told) Aruban law does not allow … to give the Kalpoe brothers the equivalent of a plea bargain: help provide information that will lead to the conviction of Joran van der Sloot and you will be, essentially, off the hook.

      I’ve been told that once the Kalpoes had this lawsuit filed in California, some legal provision allowed Natalee’s family to file their own lawsuit. I’m not a lawyer, so obviously can’t comment on the ins and outs of this.

      I suspect that the Kalpoes, and whatever passes for their legal advisors, never reflected that coming to the United States might open them up to some kind of countercharges. You would think that what happened to the van der Scums would have cautioned them … on the other hand, perhaps they misinterpreted the jurisdictional issue as signifying that they were beyond the law altogether.

      My understanding is that the Holloway Twitty lawsuit is not seeking heavy monetary damages; rather, it is seeking to enlist their testimony against JvdS. I could be wrong.

      A few concerns I have:

      1. Could the legal advisors for the Kalpoes, faced with this new development, suggest that they drop the lawsuit against Dr. Phil, in return not having to show up for or respond to the family’s lawsuit? I could care less about Dr. Phil (who has denied vehemently that the tapes were altered), but I want Natalee’s family to get answers.

      2. What happens if the Kalpoes provide false or misleading information in return for a deal, and that a subsequent suit against van der Scum collapses on the basis of false evidence? Does that mean that all of them are legally free?

      3. If JvdScum was indeed left alone with Natalee (which I don’t believe, but which is possible), then presumably the Kalpoes would seek to gain from this chance to turn against him. So would some sinister force on Aruba seek to have them eliminated beforehand?

      If there is a God, may He/She be on the side of the Holloway Twitty family as these developments play out….

      Both the Kalpoes suing in an American court of law, could mean several things:

      - Satish is a plaintiff because the edited version of the tape insinuated that he was a co-participant in the rape, so he seeks restitution for being morally injured.

      - Two seeking compensation have a chance for a better loot than just Deepak on his own.

      - The unedited version of the tape must convey a message different than what was portrayed on the show. They could be looking for an out of court settlement.

      - The brothers probably feel safer speaking in a US court, even if submitted to the third degree. They will not suffer the prejudicial social consequences of being immigrants and outsiders, or having their immigration status threatened as a way to keep them quiet.

      From the perspective of justice, the Kalpoe action is good for the case. It will bring information out in the open that has been kept backstage. I bet the van der Sloots are not very happy with this move. During the pre-trial stage a lot of information, statements, and evidence will be exchanged within the parties, and Joran may end up in the witness list, if the suit ever goes to trial.

      Inter alia, it’s surprising to me that Beth Twitty will appear on Greta van Susteren’s show. Surprising in that … if I were her, knowing how Greta said she “now is inclined” to believe Joran … I wouldn’t give GvS the time of day.

      I would think there would have to be some concerns for committing perjury in a California court. Based on what appears to be glaring inconsitencies in the police statements I would think that the Kalpoes would want to be very careful of the ground on which they tread. The crime of perjury could extend to them if it is proved they lied to material facts to the California courts.

      This is great, I can’t believe the Kalpoes filed a lawsuit in California, they or their attorneys had to know that would open them up to the jurisdiction of the California court in a counter suit. I expect they will not respond to the wrongful death suit and will drop the Dr. Phil suit, to avoid being deposed. I hope that doesn’t happen, I would like to see the Dr. Phil tapes examined by experts, and the results made public. I personally don’t believe the tapes of the Deepak interview were altered, but I would like the truth to come out in a court of law, whatever the truth is, even if I’m wrong. And, of course, if the Kalpoes could be deposed in a US court proceeding regarding Natalee’s disappearance, that would be incredible.

      Very interesting…..just read the complaint.

      The lawsuit is not only against the two perps, but also against DOES 1 through 100 (‘John Does’ as all of the actors are still unknown). Essentially, what they are saying is they are suing Paulus, Joran, and everyone else that participated and covered up this murder…but they can not name them until additional information comes out in discovery.

      Once discovery begins….the DOES can be added when they are ‘outed’ in discovery. This is kind of a backdoor to get Paulus and Joran back into court…..

      This is pretty humorous….the Kalpoes have provided jurisdiction through their action. The Van Der Sloots…though having their case dismissed in NY can now be pulled into this case based on the discovery that is ultimately uncovered…..they lose their jurisdiction arguments that they used in NY! The Kalpoes have done a big favor in opening up the door to bring the Van Der Sloots back to America!

      Yep, that’s right. The K2 have now submitted to the court’s jurisdiction in CA. They can cancel their suit all they want but they are now under the court’s jurisdiction.

      You have to know that John Q. has a darn good sources that he was able to get into court right behind them with his suit. He was cocked and loaded which means he was tipped off.

      It is true that the K2 could just not show up in the US, but it’s not like they have a lot of places to go. Aruba would be digging a deeper grave if they refused to extradite them and I guarantee, Aruba is no longer a safe place for K2! Heck, even innocent tourists get murdered there. Imagine what happens to snitches.

      My bet is that K2 didn’t get enough money to satisfy their greed from PVDS and so they searched for a way to get rich in the USA. I can’t imagine for a minute that their attorneys didn’t advise them on the jurisdictional issues. I mean that’s simply elementary law. They had to be warned that eventually the Twitty’s would file something in CA – though they may have been surprised as just how fast.

      So you really have to wonder what’s up. Have they really convinced their US attorneys that they are as pure as the snow? Or is it that they are so sure no other version of the story is available except theirs?

      Do any of us really believe the that VDS family will stay out of this? Nah, Joran can’t keep his mouth shut. Before you know it, we will have jurisdiction over him too.

      Through the courtesy of a friend, I heard part of the Greta vS show last night. (Watch red-faced Greta, she who was “inclined to believe” Joran, try to catch up with the rest of the media now that there are new developments in the case.)

      The stable of lawyers that she has on the show said that with the Kalpoes’ suit opening up the jurisdictional issue, the Holloway Twitty family will be able to proceed with their suit even if the Kalpoes withdraw their own one vs. Dr. Phil.

      What I’m wondering is, if the Kalpoes never set foot in the U.S. (and many of the lawyers on that show said they didn’t think they would proceed with their lawsuit, given that they’d have to submit to questioning, etc.), can the HT family get anything more than a U.S. court victory?

      In other words, if they win a suit that is uncontested, can they then force Aruba to send the Kalpoes here? Or would it provide the new evidence that supposedly Aruba is waiting for?

      I certainly don’t know … but let’s hope for the best. I bet that Paulus vdScum didn’t sleep too well last night … Joran, let’s hope, has the mother of all hangovers.

      Anyway, what matters right now is that, as JQKelly said last night (hope I’m quoting him correctly), if the Kalpoes have nothing to hide, then they should be willing to come here and be questioned. The family lawsuit would give them the chance to escape prosecution in return for providing what evidence they have, or so I take it. It’s the chance for plea bargaining that Aruba law supposedly doesn’t offer (though at least one Dutch law professor says that plea bargaining is indeed allowed there).

      But I think we all know they DO have lots to hide.

      #121 – naming Does 1 to 100 is a rather normal procedure when filing a suit and knowing that other suspects can come to light from the testimony of those you sue. It’s the way to leave the door open to add additional parties when you either know or suspect there are others involved.

      What I’d like to know is where are the K2′s. It seems impossible that they could still be in Aruba because it simply would not be a safe place to be.

      I’m sure the Kalpoes’ US attorneys knew they were subjecting their clients to US jurisdiction. They may have anticipated a suit would be filed by the family. Perhaps they are prepared for that. Attorneys in the Chicago firm representing the Kalpoes do handle wrongful death litigation. I have two questions:

      1. Who is paying for the attorneys? The Dr. Phil suit might be contingency, but fees and expenses still have to be paid and defending the wrongful death suit is another matter entirely. We’re not talking small sums of money collected from neighbors, friends or other supporters.

      2. What would happen to the Kalpoes if they admitted in a US court to committing a crime in Aruba? I don’t think US authorities could do anything. The Kalpoes might not want to return to Aruba afterwards, but I don’t think they could be incarcerated here even with a confession. Any experts here know?

      Joe taco can only HOPE the Kalpoe’s drop the suit. But I think there’s a problem with that. I think that the suit was brought as the final phase before a book and that the lawyers get paid through the follow on book deal.

      No suit, no book. No book, no pay-off for Deepak. Also, any way it goes, Kalpoes are in deep doo-doo in Aruba because just filing the suit was an open threat to Paulus, Joran and others involved in the cover-up.       Boycotting Aruba requires no character, sacrifice, lifestyle change or effort on the part of Americans. Oh my, you might have to go to Belize or Barbados or Bahamas instead. What a sacrifice! NOT. What is the goal of the boycott anyway? Will it have a long term impact on tourism to Aruba? I think not, but it gets everyone all fired up and it makes people FEEL like they are making a difference-even though it will make little difference in the long run, imo. Aruba was already a very safe place. Little to no violent crime. Will it be a safer place, post boycott? Doubtful. Can it get much safer, really? Their crime statistics are far lower than almost anywhere in the U.S.. maybe we should be taking lessons from them intead of boycotting them? The Holloway case appears to have been mishandled to some degree-to what degree we will probably never really know. Maybe some changes in the rank and file with the police departments and they will be much more media savvy from now on if there are similiar occurences, and maybe closer chaperoning of kids on school trips, as well. I don’t believe the Kalpoe’s were directly involved in what happened to Natalee. They are pawns in whatever actually happened to her. If there was any real evidence that they were involved whatsoever, they would have been charged, period. If there was/is a big cover up to protect the Kalpoes (which is not believeable-what would be the motive for that, really?) there could also just as easily be frame up job done on them as well to make it all go away. Charging them, having a trial, would have gone a long way to getting the heat off of Aruban officials. but no dice. why? The island of Aruba is not going to suffer economically to cover up for the Kalpoes’or Van der Sloots. There is a much bigger picture here, I am convinced.

      Per our Murder & Crime thread (see my sig line), Aruba seems to have at least 7 homicides for 2005 (counting Natalee), and 6 as of December 3, 2006.

      The Federal Bureau of Investigation found that Southern states have the highest murder rates.

      Alabama has a homicide rate of 10.4 per 100,000.

      SM:   Wrong, Alabama had 8.2 murders per 100,000 in 2005 and 5.6 in 2004.   Hawaii had 1.9 murders in 2005 and Hawaii has beautiful beaches and is a tourist destination like Aruba (klaasend)

      I just hope these scum of the earth don’t get all the media attention that scumbag Casey what’s her name got for murdering and trashing her child. I would like to see justice for Natalee but after the Casey…what’s that skank’s last name?? anyway, I am not at all sure I trust the system.
