Judge Kenneth Lester Jr. Out, Florida Appeals Court Orders New Judge for Zimmerman Murder Trial of Trayvon Martin
Circuit Judge Kenneth Lester Jr., is out …
An interesting situation just occurred in the George Zimmerman murder trial. A Florida appeals court granted Zimmerman’s attorneys request and ordered that a new judge be seated to preside over the Zimmerman murder trial in the death of Trayvon Mrtin. The 5th District Court of Appeal determined that Circuit Judge Kenneth Lester Jr. could not be impartial due to past actions and statements with regards to defendant George Zimmerman. Judge Lester wrote a scathing decision with regards to Zimmerman’s second bond hearing where Lester made the prejudicial comment that Zimmerman, “manipulating the system for his own benefit.” Mark O’Mara, the defense attorney for George Zimmerman previously filed a 17 page motion disqualifying Judge Lester from this case. O’Mara asserted that the judge and court “departed from its role as an impartial, objective minister of justice” and should therefore be removed from the case. It would seem that the appeals court has agreed. Lester is out.

A Florida appeals court has granted George Zimmerman’s request for a new judge to oversee his trial for second-degree murder in the Feb. 26 shooting death of Trayvon Martin, the Orlando Sentinel is reporting.
A three-judge panel of the 5th District Court of Appeal found that Circuit Judge Kenneth Lester Jr. cast doubt on his impartiality when he wrote in his July 5 order setting $1 million bail that Zimmerman showed “blatant disregard for the judicial system” and that he was “manipulating the system for his own benefit.”
I have to admit this decision came as a surprise, although it was the correct one. The Zimmerman-Martin case has been more political than it has been judicial since the outset. However, made this will be the sign that the murder trial will now be based on evidence and the rule of law rather than emotions, misrepresentations, media bias and those with an agenda fanning the flames of racism.

George Zimmerman’s Attorney Mark O’Mara Won’t Use “Stand Your Ground” Defense … Instead will Use “Self Defense” in Death of Trayvon Martin
Mark O’Mara, the defense attorney for George Zimmerman who has been charged with the second degree murder of Trayvon Martin, stated that he will not use the “Stand Your Ground” defense. O’Mara said, “I don’t’ like ‘stand your ground’ because I’m not sure it’s a ‘stand your ground’ case.” Zimmerman’s defense team seems to think that the traditional “self defense” is is appropriate because the facts suggest his client couldn’t retreat from a beating Martin was giving him. The facts that have been released to the media seem to agree with O’Mara’s defense; however, facts and evidence have been hardly the order of the day in this highly controversial case where racial fires have been fanned by the MSM and the usual race-baiters.
Mark O’Mara, who is defending George Zimmerman against a second-degree murder charge in the fatal February shooting, said the traditional self-defense approach is appropriate because the facts suggest his client couldn’t retreat from a beating Martin was giving him.
Zimmerman’s attorneys had said last week that they would use Florida’s controverial “stand your ground” law, which allows people to use deadly force – rather than retreat – if they believe their lives are in danger.
“The facts don’t seem to support a ‘stand your ground’ defense,” O’Mara said.
Zimmerman’s defense team is also filing an appeal to remove Seminole County Circuit Judge Kenneth Lester from the case. Defense attorney O’Mara believes that his client cannot get a fair trial with Lester because of comments that Lester has made against Zimmerman.
Lawyers for George Zimmerman, the Florida man charged with murder in the death of teenager Trayvon Martin, said Monday that they are appealing a judge’s decision not to step aside in the controversial case.
In a one-sentence order issued August 1, Seminole County Circuit Judge Kenneth Lester said that defense lawyers’ July request that he recuse himself was “legally insufficient.”
The same team announced Monday on a website they’ve set up that they’d since filed a petition for writ of prohibition asking Florida’s fifth district appeals court to try to remove Lester from the case. The office of lawyer Mark O’Mara later confirmed to CNN that the appeal was filed Monday.

George Zimmerman Defense Team Seek ‘Stand Your Ground’ Hearing in Death of Trayvon Martin … Could Potentially Clear Zimmerman … But Can Zimmerman Win Such a Hearing?
Could George Zimmerman, the neighborhood watch man who shot and killed Trayvon Martin in Sanford, FL be cleared of all charges?
The defense team for Zimmerman is seeking a “Stand Your Ground” hearing claiming that his client shot Trayvon Martin in self defense. That might be some what hard to prove seeing that Martin was unarmed; however, pictures and accounts of Zimmerman showed that he was beaten up rather badly. Although, due to the political and racial nature that this case has taken, I find it almost impossible to believe that a lone judge would dismiss the case even though there does not appear to be enough evidence to prove second degree murder.
Zimmerman’s defense attorney Mark O’Mara announced on his website Thursday that there will be a “Stand Your Ground” hearing based on his client’s claim he shot the unarmed teen in self-defense. A finding in Zimmerman’s favor would end the criminal case against him, as well as immunizing him from civil action.
“Now that the State has released the majority of their discovery, the defense asserts that there is clear support for a strong claim of self-defense. Consistent with this claim of self-defense, there will be a ‘Stand Your Ground’ hearing,” said O’Mara in a statement.
The law allows people to use deadly force, rather than retreat, if they believe their lives are in danger.
O’Mara described the hearing as a “mini-trial,” with arguments, witnesses, experts and evidence that would be included in a criminal trial, but without a jury.

Zimmerman, the man charged with the second degree murder of Trayvon Martin has relaunches the web site in hopes of providing his side of the story of what happened that fateful night. Zimmerman also hopes to combat the misrepresentations of a bias media and the rumors and lies of the Internet. I can’t say I do not blame him for wanting to put forth his version of occurrences over a media that appeared to have an agenda from day one. The liberal MSM wanted to portray the shooting as a hate crime from the beginning, even thought there was little evidence pointing to it during the investigation and the law enforcement even stated that Zimmerman was not a racist.
George Zimmerman and the case against him has been grossly misrepresented in the media. Rumors and lies are rampant on the Internet. This website is dedicated to providing a voice for George Zimmerman, identifying and correcting misinformation, and it is used as a venue where George’s supporters can offer words of encouragement and financial support.

George Zimmerman and his attorney have been on a PR media blitz recently discussing the events of that night of the confrontation between Martin and himself. Zimmerman appeared on Fox News and Sean Hannity in an exclusive interview (VIDEOS). Since Zimmerman was charged with second degree murder, many have questioned, like Alan Dershowitz, the severity of the charge and whether the prosecution has the goods to get a guilty verdict.

Tonight Fox News Sean Hannity scored the exclusive interview with George Zimmerman, the neighborhood watch man in Sanford, FL who shot and killed Trayvon Martin. Did you think that Al Sharpton and MSNBC would get the interview? The case has become a polarizing news story of racism, media bias and anti-gun law agenda. Sadly, once the bias liberal media attached themselves to the case, the facts became irrelevant.
However, as the prosecution has released information in the case under Florida Sunshine laws, some of which should never have been released and was only done so to sway public opinion and inflame prejudice against Zimmerman. Tonight George Zimmerman flanked by his attorney Mark O’ Mara went on their own PR offensive. Amazingly Zimmerman went through the events of the evening where he followed Trayvon Martin, got into a scuffle with Martin while getting his nose broken and eventually shooting Martin dead. Some will call it a crazy legal move for a man facing second degree murder charges, others will say that the case is being tried in the court of public opinion, why not present your side to the public. During the interview George Zimmerman said, “I am sorry that they buried their child. I can’t imagine what it must feel like. I pray for them daily.”

Martin soon turned to confront Zimmerman and “asked me what my problem was” before the exchange escalated into violence, Zimmerman told Hannity in his first TV interview, conducted in an undisclosed location in Florida. The 28-year-old, with his attorney sitting by his side, said he reached into his pocket to find his phone to call 911 for a second time, and “I looked up and he punched me and broke my nose.” At one point Zimmerman said he heard Martin “telling me he’s going to kill me.”

The case drew intense national attention as speculation grew about the motives for the shooting, especially given that Martin was black. Zimmerman has white and Hispanic heritage. He dismissed suggestions by some that he acted out of racism. “I don’t think it’s fair that they rushed to judgment to assume that,” he told Fox News.
