Nifong Asks Off Duke Lacrosse Rape Case Just Before 60 Minutes Airs Episode on Misconduct

The sad story of Michael Nifong looks like it is taking the final turn as he asks the North Carolina Attorney General Roy Cooper to have his office take over the  prosecution of the remaining charges against the Duke lacrosse players. Mary_ellen_finnertyCombined with a scathing 60 Minutes episode that die to air on Sunday night, Nifong is in a terrible box after his ill conceived decisions on the case.

… spokeswoman for Roy Cooper, North Carolina’s attorney general, confirmed that the office had received Mr. Nifong’s request and said it would be discussed on Saturday. If Mr. Cooper agrees to review the case, it will remove a prosecutor who has become a lightning rod for fierce and unrelenting criticism.

Defense lawyers were jubilant, openly predicting that no prosecutor in the state would continue with a case that hangs almost entirely on the shifting accounts of the alleged victim, a stripper who claims she was assaulted after performing at a team party in March. The woman, who was consulted before Friday’s recusal, remained firm in her desire for the case to go forward against the three former lacrosse players, an official involved in the case said. via the NY Times

60 Minutes is airing a show exposing in the first person some of the mistakes that Nifong made in this case,  including candid talks with Dr. Brian Meehan the forensic expert who did not disclose pertinent DNA evidence.

Nifong’s Nightmare … Duke Lacrosse Rape Accuser Changes Story Again

Can the Duke Lacrosse Rape case get any worse? The accuser has yet changed her story Duke_LAXagain. Its not like the changes impact the case though. The accuser now seems to have her account again about when the alleged gang rape occurred, who attacked her and how. What an unmitigated disater this has become. It is hard to imagine that this case will go on much longer.

Defense attorneys filed the statement in court today, arguing that it was more evidence that the woman is an unreliable witness.

The woman adjusted the timing of the assault to earlier in the evening, a time point preceding the well-documented alibi of one accused player, Reade Seligmann. The defense, however, introduced yet more alibi evidence for Seligmann: he was on the cell phone with his girlfriend during the height of the attack as the accuser now times it.

Former Duke Lacrosse Player Kyle Dowd Files Law Suit Against Duke University … Let the Games Begin

So suddenly the Duke lacrosse players are the victims? Really? Who created the environmentDukeuniversity_logo that lead to the rape allegations?

Former Duke Lacrosse player, Klye Dowd, has filed a law suit against Duke University and visiting associate professor Kim Curtis. Dowd is accusing professor Kim Curtis of failing him because he was a part of the Duke lacrosse team. This thing is now bordering on the completely insane.

Kyle Dowd filed the lawsuit Thursday against against Duke University and visiting associate professor Kim Curtis. Dowd, who graduated with David Evans in May 2006, was not indicted in the rape case but says that Professor Curtis gave him and another lacrosse player in class a failing grade in class as a form of retaliation after the Duke Lacrosse scandal broke. The two players were apparently receiving passing grades until the scandal, and Duke University revised their grades upward months after graduation. (ABC11)Innocent

So now the pendulum has swung back to the virtuous lacrosse team? However, before everyone starts praising the members of the virtuous, pious and innocent Duke lacrosse team as drummed by the MSM; let us remember some simple facts.

Duke Rape Case gets Stranger … Duke Lacrosse Accuser Gives Birth

The 28 year old accuser that states she was attacked by three Duke Lacrosse player, David Duke_LAXEvans, 20, Collin Finnerty, 20,   and Reade Seligmann, 20, gave birth today. According to the report from WRAL, “She was not due until February.”

A judge has ordered a paternity test although prosecutors and defense attorneys have said the child was not fathered by any of the players.

So according to this Paternity calculator, the accuser became pregnant after the alleged sexual assault. The Duke Lacrosse party where the 28 year old was hired as a dancer took place on March 13, 2006. It hardly seems as if the child was fathered as a result of the alleged sexual assault. However, it would appear that it took place following the alleged assault. Yet another credibility blow to the accusations.

Duke University Invites Two Duke Lacrosse Players Collin Finnerty and Reade Seligmann back to Class

According to reports, Collin Finnerty and Reade Seligmann, two of the three suspended Duke Lacrosse Duke lacrossplayers have been invited back to Duke University to attend classes. The reinstatement did not apply to Dave Evans, the third of the accused as he has already graduated from Duke.

Duke University has invited two of the lacrosse players accused of sexual assault to return to school as students in good standing, a defense attorney said Wednesday.

Collin Finnerty and Reade Seligmann had been barred from attending class during the fall semester while their case made its way through court. The third player charged in the case, Dave Evans, graduated in May, the day before he was charged with raping a stripper at a team party in March. (KABC)

The recent events that have taken place in the Duke Lacrosse rape case have obviously made those at Duke rethink that of which had been previously done to the three accused Duke Lacrosse player. DA Nifong had earlier dropped the rape charges against the lacrosse player; however, upheld the sexual assault and kidnapping charges.

Statement from Duke University:

“As circumstances have evolved in this extraordinary case, we have attempted to balance recognition of the gravity of legal charges with the presumption of your innocence,” Larry Moneta, Duke’s vice president for student affairs said in a letter to Seligmann dated Jan. 2.

“Now with the approach of a new term, we believe that circumstances warrant that we strike this balance differently. At this point, continued extension of the administrative leave would do unwarranted harm to your educational progress.” Seligmann’s attorney, James P. Cooney III, said Finnerty received the same offer.

Comments from the family of Reade Seligmann:

“We are … glad that Duke University has now made it clear that Reade is welcome to return to the university and look forward to the day that he can continue living a normal life and continuing his education as a full-time student.” (WVEC)

This case has become a complete fiasco as the North Carolina State bar has filed ethics charges against Mike Nifong and he has been asked to step down from this case. At this point stepping down is the least that Nifong can do.

What a complete disaster. DA Mike Nifong has successfully messed up future rape cases for victims and accused alike. What evidence did he ever have to go forward? What interrogations had he ever done? Nifong has successfully messed up future “legitimate” rape cases as defense attorneys will use the “prosecutorial witch-hunt” card.
