Federal Court in Pennsylvania Declared President Obama’s Executive Actions on Immigration Policy Unconstitutional
IMAGINE THAT, A FEDERAL COURT RULES THAT IT IS UNCONSTITUTIONAL FOR OBAMA TO BE AN EMPEROR …
U.S. District Court Judge Arthur Schwab has ruled that parts of Barack Obama’s executive actions on immigration policy unconstitutional. It’s a start, even though any one with any common sense or grasp of the Constitution knows Obama’s executive order was Unconstitutional. Although this decision was part of a criminal case, look for this case to make it’s way through the federal court system and ultimately to the Supreme Court.
Earlier Tuesday, a federal court in Pennsylvania declared aspects of President Obama’s executive actions on immigration policy unconstitutional.
According to the opinion by Judge Arthur Schwab, the president’s policy goes “beyond prosecutorial discretion” in that it provides a relatively rigid framework for considering applications for deferred action, thus obviating any meaningful case-by-case determination as prosecutorial discretion requires, and provides substantive rights to applicable individuals. As a consequence, Schwab concluded, the action exceeds the scope of executive authority.

Judge Arthur Schwab stated that Obama’s executive order violated separation of powers.
“President Obama’s unilateral legislative action violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional,” Schwab wrote in his 38-page opinion (posted here). “President Obama’s November 20, 2014 Executive Action goes beyond prosecutorial discretion because: (a) it provides for a systematic and rigid process by which a broad group of individuals will be treated differently than others based upon arbitrary classifications, rather than case-by-case examination; and (b) it allows undocumented immigrants, who fall within these broad categories, to obtain substantive rights.”
The Pittsburgh-based judge rejected a Justice Department legal opinion arguing that Obama’s actions fall within the traditional realm of the executive’s discretion about which cases to pursue and which to overlook. Schwab, a George W. Bush appointee, also quoted in detail from a series of public statements Obama made in recent years about the limits on his executive authority to make sweeping changes in immigration enforcement.
As Q and A opines, if this case goes to the SCOTUS, will the “ObamaCare is a tax” court manage to actually rule as this judge has, that the executive has unconstitutionally exceeded his power? Who knows anymore at this point. After Justice Roberts bent over backwards for Obamacare, one can only wonder whether the SCOTUS will get this one right.

Tonight, Americans, once hopeful that after electing the first African American president, the issue of race would be a thing of the past, are left with Barack Obama, who stokes the flames of racial hatred, resentment and divisiveness.
A man who instead of healing our nation, instead of overcoming any racial divide prefers to take sides, based not on facts but on color, to prejudge situations based not on sworn testimony and evidence but on conjecture and a one size fits all resentment, to peddle the narrative of a national problem between law enforcement and young people of color.
Every young American who loses his life should be the concern of the man in the White House. But why is it that we only hear from him when death involves a person of color?
But James Foley, an American who never committed a crime and was beheaded, is nothing more than a blip in the president’s golf game.
Mr. President, why do you send White House officials to Brown’s funeral but no one to James Foley’s memorial service?
I don’t remember you injecting yourself in the death of a young white American or sending in the attorney general on a local crime before the justice system can act – as you did with Eric Holder, sending him to Ferguson?
Why not speak about young African Americans killed by other African Americans? Black-on-black crime? The kind of crime for which your home town of Chicago is so infamous?
Instead, you see racism everywhere.
Mr. President, you say we need trust between police and the African American community, police need to be sensitive to minority concerns.
How about you teach respect for those who put their lives on the line every day, for those who protect us, for those who are the one line of defense against an otherwise barbaric and chaotic society?
How about you teach that when a police officer says “move along” or “put your hands behind your back,” you do it!
And teach that you don’t call cops derogatory names or reach into a police cruiser to grab a cop’s gun.
But then again, you’re the one who thinks cops are stupid.
Mr. President, you demand respect. Why not demand respect for police. When they issue an order, it’s not a suggestion, an invitation, a mediation or a request.
As anarchy reigned and protesters looted stores and burned buildings of hard-working Americans – many African American – where were you?
Or do you believe that those crimes are justification for a perceived injustice? Simple collateral damage – like Occupy Wall Street. That tax paying Americans need to just suffer through and then pay for?
But no, you fan the flames of resentment, trumpeting your own investigation that you could have completed by now, only prolonging the anger. Suggesting, yes, folks, this is yet another white injustice, and I’m going to reverse it with a federal civil rights investigation, when you know there isn’t a smidgeon – your word – of evidence to support the claim. It is hard to believe that Obama had an adversarial role with the media when it was basically the MSM and their lack of vetting or asking any sort of investigative questions that got him elected and reelected.

LAMB: So, off of that experience, how many other presidents were that aware of what they said to you and how many just did not pay attention at all and you had no personal reaction from them?
COMPTON: I think most presidents realize – had a personal connection. I don’t think they ever — we were ever in a confrontation-type moment where they felt the need to apologize. I have seen in the last year Barack Obama really angry twice. Both were off-the-record times. One, profanity-laced where he thought the press was making too much of scandals that he did not think were scandals. Another where he took us to task for not understanding the limits he has with foreign policy and the way he’s dealing with the Middle East and Iraq, and Afghanistan. And I don’t find him apologetic. But I find him willing to stand up to the press and look them in the eye, even though it was off the record and just give us hell.
LAMB: Does he have a point?
COMPTON: From his point of view, he may. But we cover what we are allowed to cover. And when policy decisions and presidents are inaccessible and don’t take questions from the press on a regular basis, I think they get — they reap what they sow.

Is it all perfect? No, it’s not. But there’s no acknowledgment of any progress, Chris. If you listen to these people, the president, the mayor of New York, you would think it’s 200 years ago. You would think we haven’t even started working on these problems, and that’s not true.
And I think for the president to promote this division as he just did in that clip that you said, and mischaracterize what happened here — he’s talking in large part about Ferguson and what he described did not happen in Ferguson, and what most of the media is describing did not happen in Ferguson, Missouri. There was no “hands up, don’t shoot.” It didn’t happen. And that’s tearing this country apart.
We have people to whom the truth is relative. And they’re using whatever power they have to try to redefine the truth for the advance of their own political agenda. And it’s just not productive. And the president taking sides in this in a way that further divides the country I find reprehensible and very unfortunate.

Most Americans See Race Relations Worse Under Barack Obama … Imagine That?

A new Bloomberg Politics poll shows that 53% of Americans say that race relations have gotten worse since Barack Obama was elected present, while only 9% believe that they have got better. Wasn’t Barack Obama supposed to be the first post-racial president that was supposed to bring the races together and bridge the divide? What a joke that was. Who could not have seen this coming with Barack Obama as a hindrance to racial harmony when one considers he was a community organizer and a member of the Trinity United Church of Christ that taught Black liberation theology under the guidance of Rev. How many people foolishly voted for Barack Obama thinking that he would take leadership in being a bridge, not a wedge to race relationships?

President Barack Obama had hoped his historic election would ease race relations, yet a majority of Americans, 53 percent, say the interactions between the white and black communities have deteriorated since he took office, according to a new Bloomberg Politics poll. Those divisions are laid bare in the split reactions to the decisions by two grand juries not to indict white police officers who killed unarmed black men in Ferguson, Mo., and Staten Island, N.Y.
Both times, protesters responded with outrage and politicians called for federal investigations. Yet Americans don’t think of the cases as a matched set of injustices, the poll found. A majority agreed with the Ferguson decision, while most objected to the conclusion in the Staten Island death, which was captured on video. The divergent opinions—52 percent agreed on Ferguson compared with 25 percent who approved of the Staten Island outcome—add to an ongoing discussion that was inflamed when Officer Daniel Pantaleo was seen in the July video putting what appeared to be a chokehold on Eric Garner, a 43-year-old man suspected of selling untaxed cigarettes. Garner could be heard saying, “I can’t breathe,” and died of a heart attack in what a medical examiner ruled a homicide. The grand jury decision not to charge Pantaleo came just 12 days after a similar panel in Ferguson declined to charge Officer Darren Wilson, who in August shot to death 18-year-old Michael Brown. That altercation was not captured on video, and the prosecutor presented evidence of a physical confrontation between the two men before the fatal shots were fired.
Yup, for Barack Obama Rev. Jeremiah Wright was a wonderful man until his pastor became a political liability for him and Obama threw Wright under the bus.
