It would appear that Oscar winning actress Reese Witherspoon’s husband James Toth could not “Walk the Line” during the early Friday morning a field sobriety test by police in Atlanta, GA.
Reese Witherspoon, 37, and her husband James Toth, 42, were arrested Friday morning after their car was pulled over by police for not staying in its lane. According to the police report, the driver of the vehicle, James Toth, had droopy eyelids, watery, bloodshot eyes, and his breath smelled strongly of alcohol. Before the field sobriety test began, Witherspoon got out of the car, but was told to get back in by police, which she did. However according to the report, as the test continued, “Mrs. Witherspoon began to hang out the window and mock the officer saying that she did not believe that I was a real police officer. Just what you need to tell Georgia State trooper. Brilliant Reese. The officer stated that Toth told him he only had one drink, but as first reported by Variety, when given a Breathalyzer test, Toth’s blood alcohol level was .139. Oops, not even Elle Woods is going to get you out of that one.

As James Toth was being arrested for DUI, Witherspoon then got out of the car again after being told to return to the car. Witherspoon stated that she was a “US Citizen’ and that she was allowed to stand on American ground.” Yes you are Reese, and the police are also allowed to arrest you, which they did. Reese Witherspoon was charged with disorderly conduct. Toth was then placed under arrest and charged with driving under the influence and failure to maintain the lane.

Variety, which broke the story, reported that police spotted the couple’s silver Ford Fusion weaving in and out of lanes and pulled them over. As officers were speaking to Toth, an agitated Witherspoon reportedly stuck her head out of the window and said she did not believe the arresting officer was really a cop. After stating that she was a U.S. citizen and that she as allowed to “stand on American ground,” Witherspoon reportedly said to the officer, “Do you know my name?,” at which point he responded, “No, I don’t need to know your name.”
