Tim Miller and Texas Equusearch have filed a lawsuit against the family of Casey Anthony in connection to the searches for two year old Caylee Anthony in Orlando, FL. TES searched multiple times for Caylee and claimed to have spent more than $100,000. Miller claims that Cindy and George knew that Caylee was never missing and is seeking damages. Tim Miller says, “TES was used”.
Following Casey’s acquittal on July 5, Miller said he was considering a lawsuit against the family.
The founder of EquuSearch accused the Anthony family of knowing Caylee was never missing, but hiring the group for their services regardless.
“I do regret now, and when I watched opening statements and Jose Baez opened with saying Caylee Anthony never was missing I basically said, ‘damn you’.”
More than 4,200 volunteers went to search for the missing 2-year-old. The 2-week search cost EquuSearch an estimated $100,000.
I was one of those 4200 individuals who took part in the searches for Caylee Anthony in August through September, 2008. The searches took place in numerous locations including Blanchard Park and other areas from cell phone pings.
The law suit alleges that Casey Anthony made “ongoing misrepresentations” to EquuSearch and its founder, Tim Miller. Also, that she failed to correct “materially false information” to convince staff and volunteers to “engage in extensive, costly and time-consuming searches for Caylee.” Texas Equusearch also seeks repayment for services rendered based on “lies, omissions and deceptions.”
The lawsuit details how EquuSearch became involved in the case, beginning with a phone call to Miller from Cindy Anthony, Casey’s mother and Caylee’s grandmother. Miller later met with Casey Anthony, her parents Cindy and George Anthony, and Casey Anthony’s attorney Jose Baez. In the presence of Casey Anthony, the grandparents said Caylee was “still alive” and was not corrected by the toddler’s mother.
The Orlando County Sheriff’s Department is going to go after Casey Anthony for the cost of the investigation for Caylee Anthony based upon the lies that Casey was found guilty of by the jury. However, does that mean that TES will be afforded the same opportunity? Some legal analysts do not believe that the law suit will hold up in court. FOX 26 legal analyst Chris Tritico thinks that because TES is a volunteer organization that they will not have a right to ask for their money back since they do the work for free. Although, was there a fraud perpetuated to bring them to Orlando in the first place? That is the question. Texas Equusearch may be a volunteer search organization that is a 501(c)3, but that does not mean there are not expenses they must outlay to do a search. Let alone the donations, services and goods that were provided by caring individuals.
“It’s a free organization, a charity organization that does work for people for free,” Tritico said. “If that’s the case, they don’t have the right to come in now and say, ‘We want our money back’.”
In the end, this case was like a bad penny. Little help from the family to do organized searches for Caylee. No help from Casey Anthony who according to her defense attorney Jose Baez knew Caylee was dead from the outset. Finally, no justice provided by a jury who seemed to have wanted absolute certitude that Casey was guilty, not reasonable doubt.

I don’t blame Tim. He was used.
They should be able to sue for actual costs, IMO. Will be interested to see how this pans out.
As an aside, growing up I had always heard the term “beyond a shadow of a doubt” in regards to the criminal court; which isn’t the standard and never was. I wonder where that came from?
Hell yes they have every right to pursue this lawsuit!!!!
Maybe the volunteers were working for free, but what would they have been doing otherwise. Their time freely given is worth something if there was no need for it to begin with. People who go out on these searches are giving up their family time and lives for another family and stranger. Shame on anyone who willingly takes advantage of that, all the while knowing it was not necessary to begin with.
i don’t buy the drowning defense in this case but since that is what the defense team went with and managed to win with, and Casey allowed it, then yes she owes A LOT of people A LOT of money. She should be responsible to pay them back for their time!!!!

SM: Who knows how this lawsuit will turn out; however, it needs to be determined if the family asked them to come or did law enforcement? Did TES act in conjunction with LE to search for Caylee? The answer is most likely yes to that.
If any $’s go back to TES, I would presume it would go to the non-profit, not an individual.

On this key point you are mistaken. She was not found guilty of any serious crimes, but she was found guilty on the charges that would be basis of this.
The more I think about it the less I think this could go anywhere. Unless Casey asked for TES personally, I can’t see her being held responsible for costs that TES incurred.
I hope he goes after her and her lawyer Bozo. Since Bozo is saying that she knew all along that Caylee was dead. Her attorney must have known also.
“Beyond a reasonable doubt,” I think this is what was supposed to be said to the jury. The “reasonable” being, what a reasonable adult would conclude considering the evidence. I think TES should be reimbursed for their costs only. This lawsuit should be aimed at Casey. I don’t think her Grandparents knew she was dead. That was all Casey’s doing.
Don’t forget that OJ lost his case when sues for wrongful death. Anthonys will lose this one as well.

you so right when a child passed do to whatever it takes and reacts fast and trys to do what ever it takes to get help…. my daughter passed 2 days after I had her and I was still in hosptial thank god and I had doctors round my baby but I as a mother try to do whatever I could to save my baby girl… Casey needs to pay you back because somewhere there was a family who needed you and your team…

I think that Tim and his organization has the right to sue Casey. She lied along with her parents and JOSE BAEZ. Casey killed her child, and they ALL covered it up. They all knew it and never said anything. Where are these peoples morals?
David.. have your read the transcript that was filed in court yesterday. The Anthonys, along with Casey BEGGED Tim to search for Caylee, and oh.. let’s not forget about Jose Baez. He was there, too. The organization had to have things ie: hotel rooms, food, gas money. TES, had other people ask to help them find loved ones and he didn’t, his team went to Orlando to look for Caylee who was ALREADY dead. Shame on you, for thinking that Tim shouldn’t recoup the organizations monies. Hundreds of volunteers went and searched also. Their time should count for something.
I feel that there is more to the story, that we don’t know about, but the Anthonys, Casey and her attorney know exactly what happened to Caylee.

May: Miller has said he turned down 15+ other families of missing children because he was already in Florida at work on this. It was beyond criminal.
David: Use common sense. Imagine the COSTS involved in a search. Miller specializes in large scale searches involving heavy machinery and even horses. None of it comes cheap. He is suing for what she cost him, knowing Caylee was dead– she admits to that. Her being found Innocent of murder is the entire point of his Lawsuit. He never should have been there.
Tim Miller was in her home. Her whole family spoke with him. Miller has stated that Jose Baez personally asked him not to speak to her without him present. Speaks volumes, no??
There’s not a “fee” for police, sheriffs and other investigative agencies to search for people either; judges don’t charge “fees” either. Yet, some cases have held that those that abuse the services provided by taxpayers can indeed be held liable. EquuSearch should have as much right as any government agency attempting to help the Anthony family who were also lied to.
But, probably like OJ, Casey will do whatever necessary to keep from paying anyone.

If you are to believe the jury foreman, he thought that George was complicit. Either with the crime or the cover-up. That’s what these folks believed. Which can explain the “not guilty” verdict.

SM: I am not sure if it matters whether TES was searching for a live or dead person. The fact was that they knew where Caylee was all along. If Casey knew she was dead on the 16th, she also knew where she was placed.
As for donations, you would be surprised how little $’s donations were received. All you need to do is review the books. Most donations are usually in the form of food, water and equipment.

You have no idea what is allowed and not allowed to be done in the courts. Any one can sue anyone. Civil cases are much different that criminal. You do not have a right to mislead people and waste their time. There are also things called verbal contracts.
Do I think that TES lawsuit is a stretch? Yes. Then again, I never thought that a jury of 12 fools would have ever let a killer out of jail.

hay david, you are way off thinking the public opinion is worse than what casey did. the jury did not follow what is “reasonable doubt”. reasonable means what is the norm for society. what is the normal behavior a mother should have. no mother goes a month not telling anyone her baby is missing. no mother holds a secret that her baby drowned in the pool. no mothers car should smell like death all while her baby is missing. the jury did wrong. this happens. we have the best justice system in the world. but sometimes it does go wrong. it went wrong this time. be man enough to admit it.
If I had the money, I would pay what you are out. My husband and I are retired. We are now trying to find our grandson, who is being kept by his father from a summer visitation in Texas, and we are from Calif. My daughter has contacted the DA, Sheriff Dept. and all the contacts in Texas where we think he is. All the paper work is in place. We just need your prayers. We followed the Caylee’s disappearance and is very sadden of the outcome. I hope we are going to be successful with our grandson. Prayers goes a long way. Thank you
