Family of Murdered Border Patrol Agent Brian Terry Files $25M Lawsuit Against ATF over Fast & Furious

The family of murdered border patrol agent Brian Terry has filed a $25 million wrongful death law suit against the federal government and ATF. The law suit claims that the Alcohol, Tobacco, Firearms and Explosives knowingly sold guns to Mexican drug cartels under the Fast and Furious program, guns that were responsible for the death of Brian Terry.

The family of murdered Border Patrol agent Brian Terry has filed a $25 million wrongful death claim against the Bureau of Alcohol, Tobacco, Firearms and Explosives claiming Terry was killed with AK-47s that were knowingly sold under the Fast and Furious gunrunning probe to a straw purchaser for drug cartels.

In a 65-page complaint, served on the government on Wednesday, attorneys for the family claim ATF “wrongdoing” in Operation Fast and Furious.

“ATF’s failures were not only negligent but in violation of ATF’s own policies and procedures,” the complaint claims.

Brian Terry’s family has also filed a claim against the Lone Wolf Trading Company seeking unspecified damages for negligence.

The claim says Lone Wolf knowingly sold “hundreds of weapons” to various straw purchasers and in turn realized “hundreds of thousands of dollars in profits from these sales.”

The claim alleges that “but for defendants’ negligent and illegal sales … Brian Terry would not have been murdered in the Arizona desert on Dec. 14, 2010.”

Attorney General and the feds claim that Fast & Furious gun running program in which an actual AK-47 sold to Mexican drug cartels that was responsible for the murder of the border patrol agent had no causal affect in the death of Brian Terry. Really? Can you say pathetic government cover up? Some one needs to take the fall … Eric Holder.

Video Hat Tip: The Gateway Pundit

UPDATE I: AG Eric Holder set to take the Hot Seat again at Fast & Furious hearing. Will Holder be found in contempt of Congress? This story is starting to spiral out of control for the AG and Obama. As stated at Jammie Wearing Fool, one has to wonder how this scandal will continue to go on smack dab in the middle of Barack Obama’s reelection campaign.

On Tuesday, the committee’s chairman, Rep. Darrell Issa, R-Calif., threatened to hold Holder in contempt of Congress, claiming that the Justice Department has been withholding documents related to the congressional inquiry into Fast and Furious.

“If the department continues to obstruct the congressional inquiry by not providing documents and information, this committee will have no alternative but to move forward with proceedings to hold you in contempt of Congress,” Issa wrote to Holder.

Grim Discovery Made on Falcon Lake on the Texas-Mexico border … Human Remain Found, Could It Be Missing David Hartley? (UPDATE: Remains Not David Hartley)

Are the remains found that of missing David Hartley?

As reported by KWTX, a grim discovery was found by three local fisherman on Falcon Lake on the Texas-Mexico border. Yes, the same Falcon Lake where Tiffany Hartley stated that her husband, David Hartley, was gunned down and murdered while the two were on their  Jet Skis.  Human remains were found what appeared to be a skull and ribcage on the bank of the dammed section of the Rio Grande. The skeletal remains were found  15 miles from where David Hartley disappeared as told by the initial story of Tiffany Hartley. Could this be David Hartley or just one of many killed by the Mexican drug cartels in the area?

On closer inspection, Jones said, it quickly became obvious they had discovered the remains of a human draped in mud-caked clothing with the feet tied together and appeared to be a hole in the rear of the skull.

“It struck us these were human remains we were looking at,” he said Friday, “and it sends a chill down your spine.”

Jones said the first thing that came to mind was David Hartley, the Texas transplant who was gunned down by pirates on the lake in September 2010.

He said he and his friends took a photo and noted the GPS coordinates and then forwarded information to the U.S. Border Patrol.

One of the fisherman, Alton Jones, posted on his Facebook. Really, he posted on Facebook that he found human remains? Dude, TMI!

Jones posted on his Facebook page, “The fishing on Falcon was great. But unfortunately, our fun was over shadowed when we found a dead body on the Mexican side of the lake. We contacted the border patrol and they are notifying the Mexican authorities with the details. The body apparently had been there for a long time, because all that was left was the skeleton.”

Hmm, according to the report it states that the victims feet were still tied together. Just curious, why would a drug cartel bind an individuals feet together after they had supposedly already shot David Hartley in the head on his Jet Ski?

Tiffany Hartley had stated back on September 30, 2010 that Mexican pirates shot her husband who chased them on speedboats across Falcon Lake. As the search went on for David Hartley, the lead investigator in the case was beheaded.  Obviously the drug cartel who control the area did not want this case solved.

Will this finally provide closure for the family of David Hartley or just add to the body count at the hands of Mexican drug cartels?

UPDATE I: Remains found at Falcon Lake  are not those of missing David Hartley.

She told KUSA-TV in Denver on Monday that test results from the Mexican government show clothing on a human skeleton found at the lake recently don’t match what her husband was wearing, and the skull does not have a bullet wound.

Fast & Furious High Powered Assault Weapons Found in Mexico Drug Cartel Enforcer’s Home

Drip, Drip, Drip …

The saga continues of the ‘Fast and Furious’ program that Barack Obama’s Attorney General claims he knew nothing about. More High-powered assault weapons purchased as a result if the ATF’s ‘Fast and Furious’ program have found their way into the hands of Mexican drug cartel members. This time Mexican authorities seized 24 AK-47 rifles, two rifles, Barrett 50-caliber antiaircraft machine gun Browning caliber 30 caliber rifle sniper 308 for a 40 mm caliber grenade launcher and three 308 mm caliber guns. Just another case of a Mexican drug cartel hit man hoarding Fast and Furious weapons … so why hasn’t there been a special prosecutor appointed yet to investigate this scandal?

Reporting from Washington— High-powered assault weapons illegally purchased under the ATF’s Fast and Furious program in Phoenix ended up in a home belonging to the purported top Sinaloa cartel enforcer in Ciudad Juarez, Mexico, whose organization was terrorizing that city with the worst violence in the Mexican drug wars.

In all, 100 assault weapons acquired under Fast and Furious were transported 350 miles from Phoenix to El Paso, making that West Texas city a central hub for gun traffickers. Forty of the weapons made it across the border and into the arsenal of Jose Antonio Torres Marrufo, a feared cartel leader in Ciudad Juarez, according to federal court records and trace documents from the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Many have questioned AG Eric Holder on when and how much he knew about the Fast and Furious scandal. Arizona Sheriffs have demanded an investigation and asked for Holder to resign. However, Holder continues to deny knowledge of the Fast and Furious program and stands by his statements, even though emails state something quite to the contrary. President Barack Obama might want to backtrack on his full support of Eric Holder … yet another reason why not to vote for Obama in 2012.

Can you imagine if a Republican was in office when ‘Fast and Furious’ occurred, the MSM would be billing it as Watergate II.

Police find Decapitated Body of Mexico Newspaper Editor Maria Elizabeth Macias-Castro Who Reported on Drug Cartel Violence

More drug cartel violence from south of the border.

39 year old Maria Elizabeth Macias Castro, the editor of the Mexican newspaper Primera Hora was found dead Saturday morning. Police found her body decapitated and with a note next to it, from the drug cartel responsible. The message stated not to use blogs or social media to report about drug cartels.

Her body was found Saturday morning, according to the attorney general’s office in the northern Tamaulipas state. A message “attributed to a criminal group” was found next to her, the office said.

“The state government expresses its deepest condolences to the relatives and loved ones affected by these lamentable acts,” the office said, adding that it is investigating.

Earlier this month, attackers left ominous threats mentioning two websites on signs beside mutilated bodies in northern Mexico.

Much, much more at EMS News, including them bothering to investigate and report that the “attributed to a criminal group” was the Zetas.

“Fast & Furious” Continues … Third Gun Found Linked to the Murder of Border Agent Brian Terry

The “Fast & Furious” story continues … cover ups and scandals have a way of doing that, don’t they?

According to a FOX News exclusive, a third gun has been found at the murder scene of border agent Brian Terry linked to the ill conceived “Fast & Furious”. Interesting, as per initial federal agency accounts, police only found two guns at the murder scene tied to the scandalous “Operation Fast & Furious”.

Sources say emails support their contention that the FBI concealed evidence to protect a confidential informant. Sources close to the Terry case say the FBI informant works inside a major Mexican cartel and provided the money to obtain the weapons used to kill Terry.

Unlike the two AK-style assault weapons found at the scene, the third weapon could more easily be linked to the informant. To prevent that from happening, sources say, the third gun “disappeared.”

In addition to the emails obtained by Fox News, an audio recording from a Bureau of Alcohol, Tobacco, Firearms and Explosives agent investigating the Terry case seems to confirm the existence of a third weapon. In that conversation, the agent refers to an “SKS assault rifle out of Texas” found at the Terry murder scene south of Tucson.

Is the cover up worse than the crime? What a disgrace that the FBI would try and cover up the truth.  In this case, it might be the same seeing that a US border agent was murdered at the hands of what has to be to most ignorant operation ever put forth with a premise that defies logic. The giving of guns to drug cartels in to track them. What’s next, giving nukes to Iran to see who they eventually wind up with?

This scandal will have legs, even though the liberal MSM seems to not want to cover it. What’s the matter media, afraid that the scandal will go straight to the Obama White House? Is it any wonder why Obama’s Attorney General Eric Holder is denying any knowledge of the “Fast & Furious” debacle. Eventually, some one is going to take the fall, it is just a matter of time to see how far up the food chain this goes.
