Tennessee man sues Red Lobster for $1 million for falsely accusing him of writing racial slur on receipt … Hires handwriting expert to clear his name.

Devin Barnes is suing Red Lobster and the waitress that served him for falsely accusing him of writing a racial slur “NI**ER” on his receipt in place of writing a tip amount. Barnes is suing the waitress,  Toni Jenkins for posting his personal information on the Internet and for receiving about $11,000 in donations based on the story and the lawsuit is asking for a jury trial and $1 million in damages. Barnes hired a hand writing expert to review the receipt and help clear his name from this damaging accusation. At least two experts believed this to be a hoax. Weeks ago, Barnes’ attorney and pastor, Richard Dugger, hired an independent handwriting expert who compared the receipt with samples provided by Barnes and his wife.

“There is no evidence that neither Devin Barnes nor his wife wrote that hideous statement on the line total, which means that someone else did,” Dugger said.

The incident occurred in September 2013 when Devin Barnes ate at the Red Lobster in Cool Spring, Tennessee. Barnes stated that he was running tight on time, so he had his waitress put the meal into a to-go container. When he paid the bill, he wrote “none” under tip.  What followed would change his life forever.  Toni Jenkins, a Red Lobster waitress, posted on Facebook a photo of a receipt from customer Devin Barnes with his personal information was on a receipt where someone had written the n-word.

In court on Thursday, Barnes filed suit against the waitress, Toni Jenkins, and Red Lobster, claiming that Barnes and his family have suffered because of the situation.

According to the court filing, they have expert testimony from a handwriting analyst to prove Barnes didn’t write the racial slur on the receipt.

Barnes is suing Jenkins for posting his personal information on the Internet and for receiving about $11,000 in donations based on the story.

He also contends the restaurant didn’t do enough to contain the situation.

In response, the restaurant chain said in a statement that, “it is against our policy to post guest information online. Our standard procedure is to suspend the employee involved with pay while we determine what happened. After the completion of a full investigation into this matter, Ms. Jenkins returned to work.”

The lawsuit is asking for a jury trial and $1 million in damages.

But two handwriting experts who looked at the receipt and at writing samples from Barnes, his wife, and Jenkins determined that it was unlikely that the couple had written the slur.

The expert hired by Barnes and his attorney concluded that both Barnes and his wife were unlikely to have written the slur.

Another expert, contacted by The Daily Caller News Foundation, analyzed the receipt, comparing it to a copy of a writing sample from Jenkins. The expert determined that “within a reasonable degree of certainty” Jenkins had written the slur.

Jenkins responded at the time telling TheDCNF that she no longer believed that Barnes had written the word.

She said she would apologize to Barnes but maintained that she did not write the word either.

Asked if she planned to share any of the donations she received with Barnes, Jenkins said “Honestly I would…if there was any left.”

Hopefully Red Lobster and this waitress will be successfully sued to put an end to this crime of “Racism by Hoax”.

House Minority Leader Nancy Pelosi (D-CA) blamed the current VA Scandal taking place during the Obama presidency on former President George W. Bush at her latest press conference as she stated, “Maybe when we go into war, we should be thinking about its consequences and its ramifications.” Really, is this all Democrats have to any scandal or anything bad that happens to blame Bush? This is a bit old 6 years into an Obama presidency. It is sickening that Veterans issues are being politicized. I would dare say that there have been issues, troubles and scandals with the VA in one form or another during the Obama, GWB, Clinton, GHWB, Reagan, Carter, Ford, Nixon, LBJ, etc. presidencies.I can remember hearing about terrible hospital conditions within the VA from days long before GWB was even a governor in Texas. However, in the sick, divisive and partisan mind of Nancy Pelosi and the current band of liberal Democrats … It’s blame GWB time again. I guess they could not blame the Koch brothers for this one. Now the Dems have a new scandal to defend themselves from in the 2014 midterm elections … I know, let’s just blame Bush. Just how many times will they dip into this well of unaccountability?

At some point Democrats and Obama have to take accountability and have to be held accountable for their actions and inaction. Everyone inherits issues from some one and it is up to you to make things better, not just blame some one else because you failed. It is difficult to believe that Obama has done anything with regards to the VA “cooking the waiting list books” scandal when he could not even admit he knew about it. At what point does everything that comes out of the Obama White House just be taken as a lie? NO ONE CARES WHO FAULT IT IS … FIX IT!!!

House Minority Leader Nancy Pelosi, D-Calif., repeatedly put the blame for the Veterans Affairs scandal on former President George W. Bush, while arguing that her party has worked hard for veterans in recent years.

Pelosi took a shot at Bush while saying that the scandal is a high priority for Obama. “He sees the ramifications of some seeds that were sown a long time ago, when you have two wars over a long period of time and many, many more, millions more veterans,” she told reporters during her Thursday press briefing. “And so, I know that he is upset about it.”

The Democratic leader never mentioned Bush by name, but she alluded to him early and often in the press briefing.

“Maybe when we go into war, we should be thinking about its consequences and its ramifications,” Pelosi said while discussing the scandal. “You would think that would be a given, but maybe it wasn’t. And so, we go in a war in Afghanistan, leave Afghanistan for Iraq with unfinished business in Afghanistan. Ten years later, we have all of these additional veterans. In the past five years, two million more veterans needing benefits from the VA. That’s a huge, huge increase.”

This scandal that is currently taking place with the VA cooking the books was known to Barack Obama back in November 2008. So why is he acting like this is some surprise out of left field? Obama, through his mouth piece Jay Carney made the media and public to believe BO just learned of the scandal when it was reported in the news recently. LAIRS!!! They knew about this problem and Vets still died. Um, that is Bush’s fault how?

In his memoir ‘Stress Test’ former Treasury Secretary Timothy Geithner says the Obama  White House wanted him to mislead and lie to Americans about the long term costs of Social Security on Sunday talk shows. SOUND FAMILIAR? According to Geithner, the White House communications director specifically told him not to say that Social Security contributes to the national deficit in an upcoming appearance on the Sunday morning talk shows, even though he believes it does, because it might inflame and anger the Democratic base.   What, say it isn’t so … the Obama Administration wanted their minions to lie to the American people?!?  ‘Pfeiffer said the line was a ‘dog whistle’ to the left, signaling that we [Democrats] intended to protect Social Security. Lies, lies and more lies from the Obama administration that makes everything about politics.

However, before we give Geithner any medals for his truthfulness, maybe he would like to explain why he did not resign? It is a crime what this administration has perpetrated upon the American people. If a Republican presidency had been caught in this many lies and scandals, the MSM would have drummed them out of office.

The White House wanted Treasury Secretary Timothy Geithner to lie on Sunday talk shows to downplay the part Social Security played in driving the deficit, it was revealed today.

Geithner writes in his memoir Stress Test, out today, that the White House communications director asked him to downplay the long term cost of Social Security spending to mollify the Democratic Party’s base.

‘I remember during one Roosevelt Room prep session before I appeared on the Sunday shows, I objected when Dan Pfeiffer wanted me to say Social Security didn’t contribute to the deficit. It wasn’t a main driver of our future deficits, but it did contribute,’ he says.

‘Pfeiffer said the line was a ‘dog whistle’ to the left, a phrase I had never heard before. He had to explain that the phrase was code to the Democratic base, signaling that we intended to protect Social Security.’

Rep. Adam Schiff (D-CA) said on Fox News Sunday with Chris Wallace that he would recommend congressional Democrats not participate in the recently announced Select Committee on Benghazi. Rep. Peter King (R-NY) responded that by doing so would be “terribly arrogant” and “wrong.” King went on to say that, “If Democrats boycott this committee, refuse to take part, the American people are going to conclude, and I think quite rightly, that they feel they have something to hide.” On Friday, House Speaker John Boehner said the House would vote on a select committee to investigate the Sept. 11, 2012, attacks.  Rep. Trey Gowdy (R-SC) will lead a Select Committee investigation on White House Benghazi scandal.

“I think it is a colossal waste of time … I don’t think it makes sense really for Democrats to participate. It’s just a tremendous red herring, and a waste of taxpayer resources … I don’t think it makes sense for us to give this Select Committee any more credibility than it deserves.”

Imagine that, Democrats think it is a waste of time to get to the truth. As stated by Protein Wisdom, “Democrats make it clear: Obama’s political reputation more important than American lives.” I would also add, protecting Hillary Clinton’s bacon.

Rep. Peter King, R-N.Y., said doing so would be “terribly arrogant” and “wrong.”

The call for a boycott was made earlier by Rep. Adam Schiff, D-Calif., during an interview on “Fox News Sunday.” He was responding to House Speaker John Boehner’s announcement Friday that the House would vote on a select committee to investigate Benghazi.

The congressman said Democrats should not give the select committee more “credibility” by joining, dismissing new evidence that Republicans have called a “smoking gun” showing the White House politicized the tragedy.

“I think it’s a colossal waste of time,” said Schiff, also a member of the intelligence panel. “I don’t think it makes sense, really, for Democrats to participate.”

King, speaking afterward with Fox News, said this would be a “mistake” for Democrats as it would show they “cannot defend the administration.”

“If Democrats boycott this committee, refuse to take part, the American people are going to conclude, and I think quite rightly, that they feel they have something to hide,” King said.

Brit Hume & Former California Democratic Rep. Jane Harman Get into Heated Debate Over Benghazi on FOX News Sunday

Democrats cannot explain away the fabricated and intentionally misleading Benghazi talking points without going into hysterics.

Fox News contributor Brit Hume and former Congresswoman Jane Harman (D – CA) went at it on Fox News Sunday after Harmon delivered an arrogant and dismissive lecture on the Benghazi talking. points. Hume pressed Harman to name a single person in the administration who credibly believed that the Benghazi attack was connected to an anti-Islam video. And predictably, she could not do so. Host Chris Wallace interjected and said, “Ben Rhodes talks about the video five times in this memo, five times.” Harmon would finish by saying, “my view on this, having been around at the time, was that this was not deliberately misleading. It turned out to be wrong, but it was not deliberate.” Wrong, it was deliberate.

The Blaze:

“You’re right, there wasn’t a conspiracy in the United States to mount the Benghazi attack,” Hume said. “That’s not the question.”

“The question was whether in the aftermath of the attack, when the administration sent its U.N. ambassador out to explain it to everybody, and she did so falsely, that there wasn’t a conspiracy to create the false talking points that she used,” the Fox News senior political analyst continued. “I’m not talking about the CIA talking points, I’m talking about the talking points used on that program that day, which were monumentally misleading, that since have been shown to be false, and based on no intelligence of any consequence that we know of.”

Harman continued, however, to insist that the administration did not deliberately craft misleading talking points.

“My view on this, having been around at the time, was that this was not deliberately misleading,” the former Democratic congresswoman replied. “It turned out to be wrong, but it was not deliberate.”
