Last night IRS Commissioner John Koskinen testified again before the House Oversight and Government Reform Committee about the loss of former IRS official Lois Lerner’s emails. US  Rep. Trey Gowdy (R-SC) simply shredded IRS Commissioner Koskinen during the hearing and handed Koskinen his lunch, or in this case because of the time of day, his dinner. Gowdy provided Koskinen a lesson in Criminal Law 101. The Congressman methodically and astutely lit into the IRS Commissioner as he destroyed Koskinen’s comment that “there was no evidence of any criminal misconduct.” Koskinen was forced to say that there was any wrong doing.

Spoliation of evidence is when a party fails to preserve evidence that there is a negative inference that the jury can draw from their failure to preserve the evidence. You with me? If you destroy documents that the jury could infer those documents weren’t going to be good for you. If you fail to keep documents a jury could infer that these documents were not going to be good for you. [...] When a party has a duty to preserve the evidence or records and they fail to do so, there is a negative inference that is drawn from their failure to preserve the evidence.”

What happened to John Koskinen, the “turn around” specialist brought in to fix the IRS? At the 4:20 mark of the video below, IRS Commissioner John Koskinen and major Democrat donor provided Demcorat talking points that the GOP is obsessed with the White House. He would also later blame lack of IRS funding for the ills of the IRS.   Trey Gowdy would go on to debunked Koskinen’s words. What is most telling in this exchange is that the IRS Commissioner, who was not a part of the corruption and the IRS targeting of Conservative non-profit groups, is acting in a political manner regurgitating Democrat talking points. Isn’t this what the IRS was originally accused of … acting as a political arm of the Democrats and the Obama White House? Powerline expands on this point as they state, “IRS Commissioner John Koskinen is known as a “turnaround specialist” who helped rescue failed or failing enterprises. Unfortunately, it is clear from Koskinen’s strident testimony before Congress that he has no intention of turning the IRS around.”

The IRS Cancalled the Contract with Email-Storage Firm Sonasoft Weeks After Lerner’s Computer Hard Drive Crash

If it was not bad enough that the computer hard drive crashed of former IRS employee Lois Lerner weeks after Congress made inquiries into IRS-gate, or that her hard drive was deemed irreparable and it was destroyed, now we learn the IRS cancelled its longtime relationship with Sonasoft, an email-storage contractor, just weeks after ex-IRS official Lois Lerner’s computer crashed and shortly before other IRS officials’ computers allegedly crashed.Imagine that, cancelling the contract with the email archiving company when it is no longer a good thing to save emails.

Really? If one was to present this transcript to Hollywood for a movie it would be rejected as being too unbelievable.

The Internal Revenue Service (IRS) cancelled its longtime relationship with an email-storage contractor just weeks after ex-IRS official Lois Lerner’s computer crashed and shortly before other IRS officials’ computers allegedly crashed.

The IRS signed a contract with Sonasoft, an email-archiving company based in San Jose, California, each year from 2005 to 2010. The company, which partners with Microsoft and counts The New York Times among its clients, claims in its company slogans that it provides “Email Archiving Done Right” and “Point-Click Recovery.” Sonasoft in 2009 tweeted, “If the IRS uses Sonasoft products to backup their servers why wouldn’t you choose them to protect your servers?”

Sonasoft was providing “automatic data processing” services for the IRS throughout the January 2009 to April 2011 period in which Lerner sent her missing emails.

Sorry, but this is too much to even attempt to believe. As stated at The Jawa Report, “the IRS scandal alone should be enough to bring down any administration (and would if this were a Republican administration.)”. The daily discoveries of what the IRS did are not mere coincidences, but instead a deliberate and concerted effort to eliminate evidence. It is a sad state of affairs in the United States when we have a government that is unaccountable to the People, can operate in such a manner that is above the law and a media that could care less to get to the bottom of the story because of the White House currently being occupied by a Democrat.

IRS Commissioner John Koskinen Does Not Think an Apology is Owed to Congress or We the People

The height of contempt and arrogance … IRS Commissioner John Koskinen does not think that an apology is owed for the lost Lois Lerner emails and the stonewalling by the IRS.  Koskinen said he didn’t inform Congress immediately because he wanted to find out the full scope of the situation before reporting to them. But some how the Treasury Department and White House were notified in advance of Congress and the American people.

Internal Revenue Service Commissioner John Koskinen said Friday that he does not owe an apology for computer crashes that resulted in the loss of emails connected to an ongoing probe.

“I don’t think an apology is owed,” Koskinen said during a tense hearing with lawmakers on Capitol Hill. “Not a single email has been lost since the start of this investigation.”

Last week, the IRS acknowledged that the computer of Lois Lerner, the IRS employee at the center of the probe, experienced a hard drive crash in 2011, making some of her emails inaccessible for the investigation. Koskinen said the IRS is taking measures to restore the emails and noted that the loss took place before the investigation began.

The IRS stated on Friday that they lost and cannot locate many of Lois Lerner’s emails prior to 2011 because her computer crashed that year. Image that, what a coincidence. House Oversight Committee chairman Darrell Issa (R-CA) suggesting the Obama administration is being dishonest by saying these emails are lost stating, “Isn’t it convenient for the Obama Administration that the IRS now says it has suddenly realized it lost Lois Lerner’s emails requested by Congress and promised by Commissioner John Koskinen?” Ya think? Issa went on to comment,  “Do they really expect the American people to believe that, after having withheld these emails for a year, they’re just now realizing the most critical time period is missing?” WHAT A JOKE. Imagine telling the IRS that you lost the necessary paperwork in a computer crash that they are requiring, which is more plausible than an email.

So let’s understand this … the government & NSA has a right to look at your emails, but some how they can’t retain their own? Who honestly believes this bullshit?

The Internal Revenue Service says it has lost a trove of emails to and from a central figure in the agency’s tea party controversy.

The IRS told congressional investigators Friday it cannot locate many of Lois Lerner’s emails prior to 2011 because her computer crashed that year. Lerner headed the IRS division that processed applications for tax-exempt status.

The IRS acknowledged last year that agents had improperly scrutinized applications for tax-exempt status by tea party and other conservative groups.

“The fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to congressional inquiries,” said Rep. Dave Camp, R-Mich., chairman of the House Ways and Means Committee. “There needs to be an immediate investigation and forensic audit by Department of Justice as well as the inspector general.”

The Ways and Means Committee is one of three congressional committees investigating the IRS over its handling of tea party applications from 2010 to 2012. The Justice Department and the IRS inspector general are also investigating.

I could not agree more with Powerline and their post, Obama Administration’s Claim that Lois Lerner’s Emails Are “Lost” Is Ludicrous. Actually, it is beyond ludicrous, it is an outright lie. Who honestly thinks that emails are kept on your hard drive? They are collected and saved on an email server that has a redundancy of backups. Do they really think we are that stupid? If Lois Lerner’s emails really do not exist, then some one would have had to gone to the email servers and the back up tapes and purposely deleted them. There is a thing in corporate America and government called “DRE”. That is short for “Disaster Recovery Exercises”. All do it to prepare for catastrophic events like fires, floods, earthquakes, hurricanes, etc to ensure that there is no data lost in case of a disaster and that business can get back up and running ASAP. I should know, I have participated in them for the past 4 years to ensure such efforts are effective. Guess what … emails are apart of that to check list.

The Obama administration’s claim that the IRS has “lost” two years of Lois Lerner’s emails is implausible to anyone who understands how email systems work. This is what the administration said:

This statement, on its face, is silly. Emails are collected on email servers. Each user (e.g., Lois Lerner) has an account on an email server, where that person’s emails are collected. It is common for emails to be deleted from the user’s own desktop or laptop computer, but no one worries about that. When it is time to collect emails–something I do all the time in my law practice–you go to the email server and pull out the user’s entire account. A crash of the user’s computer is irrelevant and will not cause emails to be “lost.”

Further, emails are universally backed up in some other medium, often electronic tape, for long-term storage. Thus, even if an email server is destroyed, or all emails are deleted from a server after a specified length of time, the emails are still recoverable from back-up storage media.

These people are nothing but liars. The IRS would destroy you if you ever came back and said, you did not have the data they are looking for because it is lost. Now that’s what they are claiming … BS!!! This is simply a coverup because it is obviously that there are damning emails that connect the IRS’s Lois Lerner to the Obama White House. If this is the way that government agencies like the IRS are going to conduct themselves and act in a political manner against Americans, no matter if they are on the right or the left, then they must be dismantled and be ended permanently … if a government agency is going to act this rogue, they need to be abolished.

Republican House members let loose yesterday on IRS Chief John Koskinen with regards to Lois Lerner’s emails and the investigation into the IRS scandal in targeting Conservative organizations and Tea Party groups vying for non-profit status. The IRS has to date refused to comply with the subpoena to produce all of former IRS employee, Lois Lerner’s emails. Issa repeated the threat to hold Koskinen in contempt of Congress if the documents are not produced to the committee.

A chief Republican inquisitor of the Internal Revenue Service tea party controversy hammered the new agency commissioner on Wednesday, accusing him of being more concerned with averting political fallout than cooperating with congressional probes.

House Oversight Committee Chairman Darrell Issa and IRS chief John Koskinen sparred over the pace in which the IRS is shipping documents to the panel, one of several probing the matter.

“Does a nonpartisan or nonpolitical agency withhold documents requested during a congressional investigation? The IRS does and did,” the California Republican said, calling the pace of document production “dismal.” “You’ve been more concerned with managing the political fallout.”

Rep. Trey Gowdy (SC-R) just shredded  IRS Chief John Koskinen and stated to the IRS head, “I want the subpoena complied with and I want the subpoena complied with in a timely fashion.” Then Gowdy said, “whether or not you think we need something, or we outta have it, or we are on a wild goose chase, frankly I could care less what you think about that. Our subpoena is our subpoena. If you do not like it, move to quash it, otherwise comply with it!” Why is guy did not primary challenge establishment GOP candidate Lindsey Graham in SC puzzles  me.

Rep. Jim Jordan Grills IRS Commissioner on Targeting Scandal: ‘We Don’t Want the Excuses Anymore’

Rep. Jim Jordan (R-OH) said at the hearing, “We don’t want the excuses anymore, You’re not working fast enough. It’s that simple.”

An IRS official said Wednesday that it could take years before the agency is able to turn over to Congress all documents pertaining to the improper targeting of conservative groups.

“What they want is something that’s going to take years to produce,” Internal Revenue Service Commissioner John Koskinen said during a House Oversight and Government Reform Committee hearing on Wednesday.

The commissioner’s remarks were made in response to specific questions asked by Republican lawmakers on the committee.

Republicans have accused the IRS of stonewalling their investigation by intentionally delaying the release of certain agency documents.

I will say again, can you just imagine if a party ever responded to the IRS in this manner in provided requested documentation? This is the reason why the IRS needs to go bye-bye and a flat or fair tax needs to be implemented. How can Congress have a lawful means to demand emails and yet the IRS stonewalls and does not comply. Then they are allowed, on the honor system, to provide the emails. Juxtapose that with the tax payer being audited is guilty until proven innocent and you have no right not to produce anything.

The IRS fears no consequences ever … this is the reason why such a tyrannical government agency has to be replaced. Never in a million years would The Founding Fathers ever have approved of such an entity.
