Following Barack Obama’s speech where he proposed a “keep your plan” fix for Obamacare, former Vermont Governor, DNC Chair and Democrat presidential candidate Howard Dean pondered while on MSNBC whether Emperor Obama had the legal authority to even propose such a “FIX” as the law had been passed by Congress. Hmm, many Conservatives are asking the same question regarding Obama’s actions. Wow, does that make Dean a racist?

So what is it with Barack Obama? Does he think because it is called Obamacare that he has the legal authority to change any part of the law he feels by executive fiat? Imagine if a Republican did that with abortion? When Republicans confront Obamacare, they are constantly told that it is the law of the land. Really? If it is, then how come Barack Obama thinks he can just change it himself? Maybe the real probalem with Obama is that he was too busy reading the Communist Manifesto as a youth instead of watching School House Rock and “I’m Just a Bill”.

Someone has finally come out and said it, Andrew McCarthy, a former Assistant US attorney said last night on the ‘Kelly Files,’ that President Barack Obama was guilty of committing serial fraud against the American people.
“If ever there has been a fraud on the entire American people it’s this one. And, I would say, Megyn, this business about, “you want your plan, you keep your plan,” is just the beginning of it … We’re talking about serial fraud on multiple levels and multiple level misrepresentations… This is an ‘in your face’ almost a crude fraud … The remedy the Framers gave us for reigning in executive excess especially if it gets this abusive is impeachment. Impeachment is a political remedy not a legal remedy… This is a big scandalous scheme and the more you look at it, systematic dishonesty is rife all the way through it.”

Victims may also seek redress in civil court.
Fraud must be proved by showing that the defendant’s actions involved five separate elements: (1) a false statement of a material fact,(2) knowledge on the part of the defendant that the statement is untrue, (3) intent on the part of the defendant to deceive the alleged victim, (4) justifiable reliance by the alleged victim on the statement, and (5) injury to the alleged victim as a result.

Fraud is a serious federal felony, usually punishable by up to 20 years’ imprisonment — with every repetition of a fraudulent communication chargeable as a separate crime. In computing sentences, federal sentencing guidelines factor in such considerations as the dollar value of the fraud, the number of victims, and the degree to which the offender’s treachery breaches any special fiduciary duties he owes. Cases of multi-million-dollar corporate frauds — to say nothing of multi-billion-dollar, Bernie Madoff–level scams that nevertheless pale beside Obamacare’s dimensions — often result in terms amounting to decades in the slammer.
Justice Department guidelines, set forth in the U.S. Attorneys Manual, recommend prosecution for fraud in situations involving “any scheme which in its nature is directed to defrauding a class of persons, or the general public, with a substantial pattern of conduct.” So, for example, if a schemer were intentionally to deceive all Americans, or a class of Americans (e.g., people who had health insurance purchased on the individual market), by repeating numerous times — over the airwaves, in mailings, and in electronic announcements — an assertion the schemer knew to be false and misleading, that would constitute an actionable fraud — particularly if the statements induced the victims to take action to their detriment, or lulled the victims into a false sense of security.

A material omission is the intentional failure to state any fact the communication of which would be necessary to ensure that statements already made are not misleading. The concept of material omission is a staple of fraud prosecutions. On Fox News Sunday during the panel discussion, George Will hammered Barack Obama’s first year of his second term as president comparing it to that of Richard Nixon’s second term. Will went on to say that he cannot even use the Clinton pandering of “I feel your pain”. Will opined, “It’s one thing for Bill Clinton to say ‘I feel your pain.’ It’s another thing for Barack Obama to say, ‘I feel your pain that I have caused.’”

OUCH!!! Former White House spokesman Robert Gibbs admitted on MSNBC, ‘The Morning Joe’ that the lie made by President Barack Obama over and over and over (26 times) to sell Obamacare “you can keep your health care insurance” was a big mistake.

71% of Voters Believe It’s Somewhat Likely President Obama or Senior Officials in his Administration Were Aware Before Obamacare was Passed that Health Insurance Costs Would Go Up for Some Americans.” … #You Lie
71% of Americans believe they were lied to about Obamacare …
From the Washington Examiner via a recent Rasmussen poll, that 71% of Americans believe that President Obama and his health care team knew well in advance that insurance costs would surge despite his promises they wouldn’t. Also, 40% want HHS Secretary Kathleen Sebelius to retire or be fired. So not only did they know you could not keep your insurance if you liked it, they also knew the costs would increase as well.
Rasmussen Reports found that 71 percent of voters believe “it’s at least somewhat likely that President Obama or senior officials in his administration were aware long before the law began being implemented that health insurance costs would go up for some Americans.”
Worse for the president: Only 18 percent want Obamacare to move on unchanged, but 43 percent want it repealed and the process started over and another 35 percent want Congress to fix it in a piecemeal fashion.
However, I have to sadly agree with the comments by Debra Heine at Brietbart.com with regards to the apathy and “oh well” mentality that is going on in the United States. We are a government of, by and for the people and ‘We the People” seem more engaged to the celebrity of the day and reality TV.
When the vast majority of American voters can agree they were lied to in order pass a controversial bill on a party line vote that amounts to a takeover of nearly 1/6 of the economy, and a large percent of them say, yeah, so what? – Our country is in deep trouble. According to Rasmussen, 48% of Likely U.S. Voters still approve of Obama’s job performance. Unbelievable.
America, would you stand the hell up for yourselves and take your liberty, freedoms and country back! Pretend like you actually care. The Founding Fathers are shaking their collective heads at the apathy.
In other polling, Rasmussen finds that 51% believe that the “individual” mandate should be delayed, while 34% say no.
