Someone has finally come out and said it, Andrew McCarthy, a former Assistant US attorney said last night on the ‘Kelly Files,’ that President Barack Obama was guilty of committing serial fraud against the American people.

“If ever there has been a fraud on the entire American people it’s this one. And, I would say, Megyn, this business about, “you want your plan, you keep your plan,” is just the beginning of it … We’re talking about serial fraud on multiple levels and multiple level misrepresentations… This is an ‘in your face’ almost a crude fraud … The remedy the Framers gave us for reigning in executive excess especially if it gets this abusive is impeachment. Impeachment is a political remedy not a legal remedy… This is a big scandalous scheme and the more you look at it, systematic dishonesty is rife all the way through it.”

Fraud:

A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.

Fraud is commonly understood as dishonesty calculated for advantage. A person who is dishonest may be called a fraud. In the U.S. legal system, fraud is a specific offense with certain features.

Fraud is most common in the buying or selling of property, including real estate, Personal Property, and intangible property, such as stocks, bonds, and copyrights. State and federal statutes criminalize fraud, but not all cases rise to the level of criminality. Prosecutors have discretion in determining which cases to pursue. Victims may also seek redress in civil court.

Fraud must be proved by showing that the defendant’s actions involved five separate elements: (1) a false statement of a material fact,(2) knowledge on the part of the defendant that the statement is untrue, (3) intent on the part of the defendant to deceive the alleged victim, (4) justifiable reliance by the alleged victim on the statement, and (5) injury to the alleged victim as a result.

Fraud is a serious federal felony, usually punishable by up to 20 years’ imprisonment — with every repetition of a fraudulent communication chargeable as a separate crime. In computing sentences, federal sentencing guidelines factor in such considerations as the dollar value of the fraud, the number of victims, and the degree to which the offender’s treachery breaches any special fiduciary duties he owes. Cases of multi-million-dollar corporate frauds — to say nothing of multi-billion-dollar, Bernie Madoff–level scams that nevertheless pale beside Obamacare’s dimensions — often result in terms amounting to decades in the slammer.

Justice Department guidelines, set forth in the U.S. Attorneys Manual, recommend prosecution for fraud in situations involving “any scheme which in its nature is directed to defrauding a class of persons, or the general public, with a substantial pattern of conduct.” So, for example, if a schemer were intentionally to deceive all Americans, or a class of Americans (e.g., people who had health insurance purchased on the individual market), by repeating numerous times — over the airwaves, in mailings, and in electronic announcements — an assertion the schemer knew to be false and misleading, that would constitute an actionable fraud — particularly if the statements induced the victims to take action to their detriment, or lulled the victims into a false sense of security.

A material omission is the intentional failure to state any fact the communication of which would be necessary to ensure that statements already made are not misleading. The concept of material omission is a staple of fraud prosecutions. A good example is the Obama Justice Department’s ongoing and transparently political effort to portray financial institutions — as opposed to government policies — as the proximate cause of the mortgage-industry collapse that resulted in our national economic meltdown. 3 Students Shot Near Brashear High School in Pittsburgh, PA … 16 Year Old A.J. Willet Arrested Charged with 4 Counts of Attempted Homicide

Three students have been shot near the Brashear High School in Pittsburgh, PA . The school is located in the Beechview area of Pittsburgh and has approximately 1,200 students.  The three male victims suffered varying injuries, one was shot in the leg and foot, one was shot in the neck and shoulder and one was grazed in the head. All injuries are considered non-life threatening. The shooting happened between Crane and Lowenhill Avenues around 3 pm,  just moments after classes let out for the day Wednesday afternoon. .

Several people have been taken in for questioning in connection with a shooting that left three students injured near Brashear High School Wednesday afternoon.

According to police, the shooting happened between Crane and Lowenhill Avenues around 3 p.m., just moments after classes let out for the day.

The victims – two 11th graders and one ninth grader – were reportedly walking to a car that was parked on Crane Avenue, about a block away, when the shooting started.

According to school officials, a shooter came out of the woods near the school, shot three students and then retreated into the woods.

UPDATE II: 16-year old Anjohnito (A.J.) Willet, Jr. Antonio was questioned and then later arrested. A.J. Willet was charged with 4 counts of attempted homicide, among other charges.  Willet is due in court Tuesday. He will be charged as an adult. The suspect claims that the shooting was in retaliation of an incident that took place on October 18, 2013 inside Brashear High School where the victim was assaulted and robbed by the individuals that he shot.

Willet is facing several charges, including four counts each of criminal attempt homicide and aggravated assault, as well as a minor not to possess a firearm charge.

Pittsburgh Police Lt. Kevin Kraus told a late evening news conference that Willet was the lone gunman who wounded the three students.

“We believe with the information and the evidence that we have, that we have the one and only shooter, but the investigation is not over,” said Lt. Kevin Kraus, of Pittsburgh Police. “It’s still very active and ongoing.”

19 year old Jared James Abrahams has pleaded guilty to four counts of extortion and one could of an unauthorized access of a computer. Abrahams s facing federal prison time for hacking the webcams of Miss Teen USA Cassidy Wolf and a dozen other young women worldwide and trying to blackmail them by going public with naked photos in the widely publicized “sextortion” case. Jared Abrahams is a former class mate of Cassidy Wolf.  Under the plea agreement, Abrahams faces up to 11 years in federal prison and fines of up to $1 million.

A 19-year-old Southern California computer student is facing federal prison for hacking the webcams of Miss Teen USA Cassidy Wolf and a dozen other young women worldwide and trying to blackmail them by going public with naked photos he secretly took.

Jared James Abrahams of Temecula pleaded guilty Tuesday to four counts of extortion and one count of unauthorized access of a computer.

Court records show the victims ranged from their late teens to early 20s, including some minors, and were located in Southern California, Maryland, Ireland, Canada, Russia and Moldova. The plot lasted from early 2012 until June 2013.

Abrahams threatened to post the illegally obtained photos if his targets did not send him more nude images or strip for him on camera. At least two complied with his demands.

“I hacked several girls’ computers and, using their webcams, took photos of them when they weren’t aware,” Abrahams said in court, admitting that he was aware that he was extorting them.

Two U.S. Mariners Kidnapped & Held Hostage from the Oilfield Supply Ship ‘C-Retriever’ Off the Nigeria Coast Last Month Have Been Released

CNN is reporting that two US citizens who were kidnapped from the U.S. flagged C-Retriever off the Nigerian coast last month have been released. The two freed individuals have only been identified U.S. and Nigerian officials as the the ship’s captain and a chief engineer.

Two U.S. citizens who were kidnapped from an oilfield supply ship off Nigeria’s coast last month have been released, U.S. State Department spokeswoman Jennifer Psaki confirmed Tuesday.

News of the release comes nearly three weeks after armed men stormed the 221-foot U.S.-flagged C-Retriever and kidnapped the two Americans, identified at the time by U.S. and Nigerian officials as the captain and a chief engineer.

The ship, owned by Louisiana-based Edison Chouest Offshore, was attacked October 23 in the piracy-plagued Gulf of Guinea off Nigeria.

The pirate assult on the C-Retriever was first reported at the gCaptain website.

Additional gCaptain sources also indicate that the Edison Chouest-owned, US-flagged platform supply vessel C-Retriever was working in a nearby field off Brass, Nigeria and was also attacked, an incident that our sources indicate was unrelated to the attack on the JTF personnel.  Our source notes that the Captain and Chief Engineer, who are both US citizens, were kidnapped. A very close family friend of the Chief Engineer (who identified himself as his brother, but whos name is withheld at his request) confirmed with us that the FBI is working on the case.

Henry Chao, HealthCare.gov’s Chief Project Manager at CMS Says He Never Saw Memo Uncovered Warning Of “Limitless” Security Risks Of Obamacare Website

Henry Chao, HealthCare.gov’s chief project manager at CMS  in charge of building the federal health care website  testified for nine hours behind closed doors to the House Oversight Committee in advance of this week’s hearing that he was kept in the dark about serious failures in the website’s security. Chao stated that he was unaware of a September 3 government memo written by another senior official at CMS that found two high-risk issues. In fact he testified that he had been told just the opposite. Chao is the individual who gave the go ahead for Healthcare.gov to go live on October 1, 2013; however, it appears that the person in charge of the project was kept in the dark. Chao testified that it was the first time he saw any such memo that said “the threat and risk potential (to the system) is limitless. When asked whether he was surprised he never saw any such memo he replied, “Yeah … I mean, wouldn’t you be surprised if you were me? It is disturbing. I mean, I don’t deny that this is … a fairly nonstandard way” to proceed.

How does somebody not tell the project manager of system vulnerability findings? Someone is either lying or purposely set out to mislead to make sure this was implemented on time irregardless of the risks. The real question is did the Obama administration know this and were they directing the implementation be on time at all cost? Sorry folks, I am a healthcare project manager and I have never heard of anything like this. Heads would roll if anything remotely like this occurred.

“What I recall is what the team told me, is that there were no high findings,” he said.

Chao testified security gaps could lead to identity theft, unauthorized access and misrouted data.

According to federal guidelines, high risk means “the vulnerability could be expected to have a severe or catastrophic adverse affect on organizational operations … assets or individuals.”

The author of the security memo in question, Tony Trenkle, retired from CMS last week. Hmm, so did he retire, did he just have enough, or was he forced out?

The CIO for the Centers for Medicare & Medicaid Services, Tony Trenkle, is leaving CMS, the agency embroiled in the ill-fated rollout of government’s Healthcare.gov insurance marketplace website.

Trenkle, who directs CMS’s Office of Information Services and oversees $2 billion in annual IT spending at CMS, is departing effective Nov. 15 to take an undisclosed position in the private sector. His departure was announced in an internal agency memo released today from by CMS chief operating officer Michelle Snyder.

CBS News has learned that the project manager in charge of building the federal health care website was apparently kept in the dark about serious failures in the website’s security. Those failures could lead to identity theft among buying insurance. The project manager testified to congressional investigators behind closed doors, but CBS News has obtained the first look at a partial transcript of his testimony.

Henry Chao, HealthCare.gov’s chief project manager at the Centers for Medicare and Medicaid Services (CMS), gave nine hours of closed-door testimony to the House Oversight Committee in advance of this week’s hearing. In excerpts CBS News has obtained, Chao was asked about a memo that outlined important security risks discovered in the insurance system.

Chao said he was unaware of a Sept. 3 government memo written by another senior official at CMS. It found two high-risk issues, which are redacted for security reasons. The memo said “the threat and risk potential (to the system) is limitless.” The memo shows CMS gave deadlines of mid-2014 and early 2015 to address them.
