WOW, Fox News is ruling that the “individual mandate” does not fall under the commerce clause, but instead will remain as a tax. UNREAL. UPDATE I: States can opt out? However, it appears that the Fed have lost the ability to force states to put individual on Medicaid or face penalties. So where are they going to go? It would almost appear that with no Medicaid expansion required, the states that opt out will face no fines. So what would cause all states to just opt out? Is there a penalty if states do not participate? If not, it is a defacto opt out.
I guess we can expect Democrats and Obama to spike the football.
Obamacare now will go from the legal field to the political one.

Let me be the first to wonder when Romney is going to stop running that ad that says “he spent the first 3 1/2 yrs on Obamacare and what has that got us? Well Willard, I wouldn’t quit my day job just yet, ooppps, you all ready did? 6 yrs running for president? SM: Nope, although i disagree 100% with Chief Justice Roberts and his rational in saying that the individual mandate is a tax is not Constitutional … this was probably the greatest gift that Roberts could have given Romney.
Obama will go down in flames in 2012 and so will many Democrat House Reps and Senators who would not have had the law been ruled Unconstitutional. Roberts did what Romney could not, he just energized the Conservative base and Tea Party to back Romney 100%.
You do not have a law where 54% of people want it repealed and win an election. Obama cannot run on this decision. Now Democrats are going to have to answer questions as to whether they are with Obamacare.
The only way to get rid of Obamacare is get rid of Obama and the Democrat Senate in 2012 ,,, which will happen.
