Another case of a teacher-student inappropriate relationship with a a twist, throw in illegal immigration to the mix.
It started out as police hunted for a 25 year old teacher and her former student who were last seen on October 35, 2007. The parents of Fernando Rodriguez reported their son missing Saturday after he was last seen late Thursday.
Kelsey Peterson, a 25 year old sixth-grade math teacher and basketball coach at Lexington Middle School, was arrested in Mexico after fleeing with a 13 year old boy. Kelsey Peterson and the 13 year old boy are suspected of having a sexual relationship. An arrest warrant ad been issued Monday charging Peterson with kidnapping, child abuse, and contributing to the delinquency of a minor. Following the two being located, the 13-year-old boy, Fernando Rodriguez, was reported to be in the care of relatives in Mexico.
A female teacher was in FBI custody yesterday as federal and local prosecutors sought to determine how they would handle charges alleging that she ran away with a 13-year-old boy, taking him across the border into Mexico.

The story gets even more peculiar as even though 13 year old Fernando Rodriguez was released to family members in Mexico, he may not be allowed to return to the United States. Why? Fernando Rodriguez was an illegal alien in Nebraska attending 8th grade. Once again, your hard earned tax dollars at work.
A 13-year-old student with whom a middle school teacher is accused of fleeing to create a romantic life in the boy’s native Mexico may be required to stay there.

A 13-year-old illegal immigrant who fled to his native Mexico amid a sex scandal with his schoolteacher could be eligible to return to the United States under a new visa the U.S. government started granting the week before he disappeared.
The visa helps illegal immigrants who are victims of sex crimes. If the boy, who spent most of his life in Nebraska, qualifies, he could stay legally in the United States for four years and eventually apply for permanent residency. It also would extend temporary residency to his parents and his unmarried siblings under 18, if they applied for it.
UPDATE II: Document: Boy in Teacher Sex Case Is 13
A birth certificate provided by a Mexican police officer who found a schoolteacher and the boy she is accused of having sex with shows that the boy is 13, contradicting claims from her lawyers that he may be older.
The certificate provided to The Associated Press by officer Alfredo Arenas Moreno shows the boy was born in January 1994 in Penjamo, Mexico.
“The document is real, recognized by the state government of Guanajuato, Mexico,” Arenas said in an e-mail. Arenas, who heads the Baja California state police international liaison unit, said he got the certificate from the FBI.
The lawyer for Kelsey Peterson, 25, suggested earlier this week that the boy might be 16 or older – too old for a statutory rape charge against Peterson. Statutory rape charges had not been filed in the case, but state and federal prosecutors have said they might add charges against Peterson.
