Does Jose Baez know the Florida statutes?

Casey Anthony defense attorney, Jose Baez, has filed a motion for a protective order that Padilla_leonard_hatbars privileged testimony of Bounty Hunter Leonard Padilla, Tony Padilla, Tracy McLaughlin and Robert Dick. Padilla and his nephew posted a $500,000 bond to bail Casey out of jail last summer.  Baez’s latest efforts in preventing Leonard Padilla and his employees from acting as witnesses for the State of Florida against Casey Anthony makes one wonder what is Baez afraid of? How much did his client Casey Anthony, accused of murdering her daughter Caylee, say infront of Padilla and company?

Baez argues that Padilla and his employees were working for him at the time so their statements made to the police about what they heard from Anthony are privileged and should not be released to the public. He also says that attorney-client privilege should ban Padilla and his employees from being witnesses for the state.

However, is such a confidentiality agreement worth the paper is was wrote on?

Defense attorney Richard Hornsby in a WESH article says no. He stated that such an agreement is worthless because Florida statutes do not allow attorneys and bail bondsmen to enter in to those types of confidentiality arrangements. One would think that Baez would have known this and advised his client to remain quiet as nothing what she said was protected and privileged.

“Jose Baez should have never had a reasonable expectation that anything she said would be confidential or fall under the attorney client privilege and that’s a big problem,” Hornsby said. “He should have advised her right away — don’t say anything to anybody.”

Another motion filed on Thursday was to ask the Circuit Judge Stan Strickland to put off the trial in her check-fraud case. Cry me a river Baez. No one forced you to take the Casey Anthony defense case and all the legal baggage that came with it. You are too busy? Who cares, your client has committed numerous criminal acts and if you are not up to the defense, get out.

Attorneys Jose Baez and Andrea Lyon argued that they’re too busy preparing for Anthony’s first-degree murder case to handle a fraud trial. Anthony faces execution in the death of her daughter, Caylee Marie Anthony. The trial is delayed until next year at the earliest.
