Support for Obamacare Hits New Low as Court Ruling Against Federal Mandate to Purchase Insurance Unconstitutional

Obamacare fails in the courts and with “We the People” …

It is no surprise that on the day that on the very day that Virgina U.S. District Court Judge Henry E. Hudson ruled that a key provision of the nation’s sweeping health-care overhaul is unconstitutional, it is no coincidence that support for Obamacare is at a new low.

In a 42-page opinion, Hudson said the provision of the law that requires most individuals to get insurance or pay a fine by 2014 is an unprecedented expansion of federal power that cannot be supported by Congress’s power to regulate interstate trade.

“Neither the Supreme Court nor any federal circuit court of appeals has extended Commerce Clause powers to compel an individual to involuntarily enter the stream of commerce by purchasing a commodity in the private market,” he wrote. “In doing so, enactment of the [individual mandate] exceeds the Commerce Clause powers vested in Congress under Article I [of the Constitution.]

The overreaching government health care plan also finds itself with a new low in support. A news  ABC News/Washington Post poll finds support for the landmark legislation at a new low at 43% in favor and 52% opposed. It was said by Obama and the Democrats that the people would learn to like Obamacare. How wrong they were.

The law’s never been popular, with support peaking at just 48 percent in November 2009. Today it’s slipped to 43 percent, numerically its lowest in ABC/Post polling. (It was about the same, 44 percent, a year ago.) Fifty-two percent are opposed, and that 9-point gap in favor of opposition is its largest on record since the latest debate over health care reform began in earnest in summer 2009.

More also continue to “strongly” oppose the law than to strongly support it, 37 percent to 22 percent.

Rasmussen’s polling is even more bleak for Obama’s health care boondoggle. Support for the repeal of Obamacare is at 60%, while only 34% are opposed.

 Wake Up America brings up a very good point with regards to if Obama plans to do an appeal that will wind up in the US Supreme Court right about the same time the 2012 reelection will take place. Obama and Democrats hardly want Obamacare as an issue in 2012. Within hours of the legal  victory, Virginia Attorney General Cuccinelli called for the case to be fast-tracked up to the Supreme Court . is it an wonder why the Obama administration, didn’t plan to push the case to the high court early.

If the Obama administration takes this all the way to the Supreme Court, it could signify that this battle over Obamacare will tread on the 2012 elections and that does not bode well for Barack Obama’s reelection chances.

UPDATE I: No Media Bias Here … WAPO fails to publish their own poll on Obamacare’s new low. The poll referenced above that shows the continued dwindling support for Obamacare failed to make the Washington Post according to Newsbusters even though is was an ABC-Washington Post poll. Go figure.

A new ABC-Washington Post poll found ObamaCare sunk to its lowest popularity yet: 52 percent opposed, and only 43 percent in favor. ABC mentioned the poll without fanfare at the end of a Jake Tapper report on Monday’s World News, and Tapper added this was the health law’s “lowest level of popularity ever.” But Tuesday’s Washington Post reported not one sentence on the poll in the paper – even as they reported in the paper that the same survey found Obama’s tax-and-unemployment-compensation deal has “broad bipartisan support.”

This is the same Post that highlighted the news on Page One on October 20, 2009, when they found a “clear majority” in favor of a socialist “public option” — amid charges they oversampled Democrats.
