A lawsuit brought by PETA claiming that the Orcas at Sea World were slaves and were entitled to protection under the 13 amendment has been dismissed. U.S. District Judge Jeffrey Miller dismissed the case and the latest publicity attempt by PETA stating that  ‘slavery’ and ‘involuntary servitude’ are uniquely human activities, and should not be applied to non-humans. PETA billed it as a landmark case, the rest of us just refer to it as dismissed.

A federal judge in San Diego dismissed an unprecedented lawsuit seeking to grant constitutional protection against slavery to a group of orcas that perform at SeaWorld parks, saying the 13th amendment applies only to humans.

U.S. District Judge Jeffrey Miller stopped the case from proceeding two days after he became the first judge in U.S. history to listen to arguments in court over the possibility of granting constitutional rights for members of an animal species.

“As ‘slavery’ and ‘involuntary servitude’ are uniquely human activities, as those terms have been historically and contemporaneously applied, there is simply no basis to construe the Thirteenth Amendment as applying to non-humans,” Miller wrote in his ruling.

7 year old Brittney Baxter is a hero after her quick thinking yesterday in an attempted kidnapping at a Georgia Walmart. Thomas Andrew Woods, an ex-con convicted of voluntary manslaughter, was on probation just could not help himself. The 25 year old ex-con was taken into custody in the attempted kidnapping of Brittany Baxter. Had it now been for the little girl’s quick reaction to resist the abduction by kicking and screaming when the felony dirt-bag attempted to drag her out of the Walmart, who knows how tragic this story would have become. Actually, we know how bad it would have been.

Thomas Andrew Woods, 25, of Austell, was taken into custody and questioned before being arrested Wednesday afternoon, Bremen Police Chief Keith Pesnell told the AJC.

“We’re pretty confident we’ve got the right guy,” Pesnell said.

But as Woods was being led in handcuffs from the police department to a patrol car, he told reporters that the police had the wrong man.

“I was never there,” Woods said.

According to police, Woods started talking to Brittney Baxter in the toy aisle of the Wal-Mart and then grabbed her and put his hand around her mouth.

But Brittney kicked and screamed, and the man let her go, police said. Neither she nor her mother, who was nearby in the store, was injured.

From the files of once a piece of law breaking scum, always a piece of law breaking scum, Thomas Andrew Woods was released in October 2011 from the Wheeler Correctional Facility, where he had been since April 2007 following his manslaughter conviction in DeKalb county. Nice, glad to see he learned advanced child sex predator in prison. Let’s hope they lock this POS, oh sorry, alleged POS away and throw away the key. Anyone that would attempt such a brazen kidnap attempt should never be allowed near the general public.

The day started as a Romney GOP Primary momentum with wins in Florida and Nevada and ended in the most unlikely Rick Santorum Hat trick with wins in Minnesota, Missouri and Colorado. Is Santorum the latest flavor of the month or a viable candidate to run against Barack Obama? The GOP primary has taken another turn. Who would have thought at this point that Santorum would have had more wins than Romney t this point in the race?

Rick Santorum had a breakthrough night Tuesday, winning GOP presidential contests in Missouri, Minnesota and Colorado, all of which is expected to breathe life into his struggling campaign and slow Mitt Romney’s march to the Republican presidential nomination.

The Santorum triumphs promise to, at least temporarily, alter the face of the campaign going into the crucial “Super Tuesday” contests, as the caustic tone of the primaries is expected to continue and intensify. Romney and his allies have signaled that they will use their financial advantage to launch stepped-up attacks on Santorum and on former House speaker Newt Gingrich, the other main challenger.

Cal it what you want, sweep, hat trick or trifecta … what Santorum accomplished last night was impressive. However, the only fear of a Santorum-Obama match up are the words that actually came from Rick’s mouth when discussing an election without negative ads and being outspent in advertizing 5 to 1. Conservatives and Republicans have to take a realistic look at this and know that Obama is going to outspend any GOP candidate and as for negative ads, forget about it.

However, one thing is for certain, maybe its time for Newt Gingrich to get out of the race and Santorum is the people’s conservative choice. Gingrich is in trouble, maybe its time to fade into the sunset. Santorum is now the non-Romney candidate.

Fisker Automotive, a California based electric car start up company that received $529 million in loans to produce two lines of plug-in hybrid cars, is laying off workers in Delaware and California. Wow, who could have predicted that this would have been a waste of tax payer money? After all, as the Lonely Conservative reminds us the electric car goes for such a paltry cost of $100,000.

Delaware’s News Journal reports that Fisker Automotive, a California-based electric car start-up company, is laying off an undisclosed number of staff to try to reserve enough capital in order to qualify for more federal help from the Department of Energy, according to a Delaware state development official.

“They’re trying to preserve the cash that they have,” said Alan Levin told the News Journal. “And unfortunately, until they meet the milestone that DOE continues to set … they’re not able to access the additional capital that they need.”

The company also came under fire last year for taking federal loans while producing cars in Finland. Company officials told ABC News at the time that “there was no contract manufacturer in the U.S. that could actually produce our vehicle.” The company was working on reopening a shuttered General Motors plant in Wilmington to produce vehicles — an effort that top Obama administration officials lauded.

So lets get this correct. Obama’s answer to US jobs and the economy is wasteful spending to “green” companies like Solydra and Fisker … but The One says no to the  Keystone XL pipeline. We all know that Obama’s funding of these companies had nothing to do with jobs and everything to do with politics. Obama must go in 2012.

The FBI warned Monday that anti-government extremists opposed to taxes and regulations pose a growing threat to local law enforcement officers in the United States. Hmm, just who are they pointing at? It sounds an awful lot like the Tea Party doesn’t it?

Anti-government extremists opposed to taxes and regulations pose a growing threat to local law enforcement officers in the United States, the FBI warned on Monday.

These extremists, sometimes known as “sovereign citizens,” believe they can live outside any type of government authority, FBI agents said at a news conference.

The extremists may refuse to pay taxes, defy government environmental regulations and believe the United States went bankrupt by going off the gold standard.

Routine encounters with police can turn violent “at the drop of a hat,” said Stuart McArthur, deputy assistant director in the FBI’s counterterrorism division.

The FBI would target concerned citizens doing their duty to question their government and actually want responsible spending and taxes as opposed to an Occupy Wall Street protect movement that has promoted anarchy and violence. Susan Powell and sons, 7 year old Charles &  5 year old Braden … Rest in Peace

The case of missing Susan Powell just went from the sad to the horrendous and horrific.Josh Powell, the prime suspect in the disappearance of his wife Susan Powell who went missing in 2009, has killed his two children in a murder-suicide, setting his home on fire. The children were dropped off by a social worker for a supervised visit. Josh Powell then slammed the door closed not letting the social worker in the home and then did the unthinkable.  There was an explosion and fire engulfed the home killing all inside. Authorities are saying that this was not an accident.

“I just heard a huge explosion,” neighbor Ryan Mickle says. “It shook my house and then I ran outside and the whole house was on fire almost immediately.”

Inside, officials found the bodies of Powell and his two young sons, seven-year-old Charles and five-year-old Braden.

“This wasn’t an accident,” Ed Troyer, of the Pierce County Sheriff’s Department, declared. “This was Josh Powell, who we believe killed his kids and himself … dead in the fire.”

About ten minutes before the fire started, Powell reportedly sent his attorney an email that read, “I’m sorry. Goodbye.” Then, just minutes after his children were dropped off by a social worker for a supervised visit, the explosion occurred.

“He grabbed the kids,” said Troyer, “locked her out of the house, and immediately, the house went up in flames. … We believe that the house fire went up so fast that accelerants were used.”

As reported at CNN, Josh Powell sent a three-word e-mail to his attorney, “I’m sorry. Goodbye.”

This should make everyone think twice about any type of child visitation to a parent who is accused or under suspicion of a crime when it comes to a missing person or murder. Maybe all supervised visits should now be in public places and not in homes. Our hearts and prayers go to the families who have to cope with this heinous act.

Ya think? Of course sadly the questions come a bit late now, don’t they? One would think that in the future, parents who are prime suspects in serious crimes like missing persons and murders that they either would not be allowed visitation at all or any supervision would be in a public location or controlled environment.

The Nevada Caucuses took place Saturday and Mitt Romney was declared the winner; however, they have still yet to count all of the caucus votes. What is going on with the caucus system in the US. First Iowa was a fiasco in that they declared Romney the winner, only to later learn that Santorum won. However, in Nevada Romney will still be the winner as he was up big with about 73% of the voting counted, the problem is that the final 25% counting. Whether they want to get the vote counts correct or not to avoid the embarrassment to Iowa, the fact of the matter is that the lack of timely counting still leaves egg on Caucus system faces.

And, still, party officials in Nevada’s largest county continue to count the vote.

“We are going to get this right,” Clark County Chairman David Gibbs told the Las Vegas Sun today. “If it takes us a little bit of time to get it rights, we are going to take the time.”

As the GOP primary candidates look to future states, Romney appears top be up in Colorado, Arizona and Michigan … however, the race is too close to call in Minnesota.

Bill Maher on HBO’s ‘Real Time’ stated something that many of us have known since the inception of the Occupy Wall Street protests. Mahr found himself agreeing with Newt Gingrich that they should … “get a job.” He then went on to say, “… but now it’s just a bunch of douchebags who think throwing a chair through the Starbucks window is going to bring on the revolution”.

Actually, the reality is that #OWS has been doing this all along, the MSM just never covered or reported the rapes, assaults, murders, pimping out young girls, stalking of children, sexual assaults, vandalism or overall “douchebagedess” of the movement who Time magazine called their “People of the year”. Sorry, but who could have missed that these folks were anarchists and undesirables from the outset as they continually disobeyed the law, attacked the police and simply wanted to cause chaos. Oh yeah, because threatening the police, harming the elderly and threatening to torch NYC to the ground is a positive message of financial inequality.

All the protesters have done is cost tax payer’s millions.

Everyone knew from the outset what this movement was about; however, it has now escalated and the popular opinion of the OWS movement continues to fall and the rats are jumping ship.

With early results being counted in the Nevada Republican Caucuses, former Massachusetts Governor Mitt Romney appears well on his way to an easy and overwhelming majority victory in Nevada. According to CNN, with 3% reporting, Romney 52%, Paul 20%, Gingrich 19% and Santorum at 9%, Romney will win gig in Nevada with Gingrich a distant second and possible third. Although, Ron Paul has already left Nevada and is in Minnesota giving speeches. What’s up with that?

Mitt Romney is actually doing better than pre-Caucus polling. In 2008, Romney won the Nevada Caucus with 51.1% of the vote.

UPDATE I: The following is quite amazing for Romney, if the majority voting margin continues … as per the AP,  Conservatives accounted for about 4 in 5 voters in the Nevada Caucus and around 3 in 4 Nevada voters said they were tea party supporters.

UPDATE II: 10% reporting, Romney 48%, Paul 21%, Gingrich 20%, and Santorum 11%.

What is interesting is that it looks like Nevada will be the second state in a row that dispels Gingrich’s theory that Santorum needs to get out of the race to consolidate the conservative vote against Romney to win. That was not the case in Florida and certainly not in Nevada. So far Gingrich + Santorum only equals 33%. That is 15% less that Romney’s totals so far tonight.
