Sen. Jeff Flake (R-AZ) Says He Will Vote Yes to Confirm Brett Kavanaugh

IT WOULD APPEAR THAT KAVANAUGH WILL GET A POSITIVE VOTE OUT OF COMMITTEE ALONG PARTY LINES …

As reported at CNN, Sen. Jeff Flake (R-AZ) states that he will vote to confirm (video) SCOTUS nominee Brett Kavanaugh. In a statement from Senator Jeff Flake, he said the following:

Flake apologizes to Kavanaugh and Ford at Judiciary hearing yesterday: “The process is imperfect, but it’s the best the Judiciary Committee can do.”

WASHINGTON – U.S. Sen. Jeff Flake (R-Ariz.) today released the following statement:

“After hearing more than 30 hours of testimony from Judge Kavanaugh earlier this month, I was prepared to support his nomination based on his view of the law and his record as a judge.  In fact, I commented at the time that had he been nominated in another era, he would have likely received 90+ votes.

When Dr. Ford’s allegations against Judge Kavanaugh surfaced two weeks ago, I insisted that she be allowed to testify before the committee moved to a vote. Yesterday, we heard compelling testimony from Dr. Ford, as well as a persuasive response from Judge Kavanaugh. I wish that I could express the confidence that some of my colleagues have conveyed about what either did or did not happen in the early 1980s, but I left the hearing yesterday with as much doubt as certainty.

What I do know is that our system of justice affords a presumption of innocence to the accused, absent corroborating evidence. That is what binds us to the rule of law. While some may argue that a different standard should apply regarding the Senate’s advice and consent responsibilities, I believe that the constitution’s provisions of fairness and due process apply here as well.

I will vote to confirm Judge Kavanaugh.”

We shall see. I will believe it when he finally makes the vote.

AZ Sex Crimes Prosecutor Rachel Mitchell Told Republican Following Senate Judiciary Hearing She Would Not Charge Supreme Court Nominee Kavanaugh After Hearing Testimonies of the Kavanaugh or his Accuser Christine Blasey Ford

ARIZONA SEX CRIMES PROSECUTOR RACHEL MITCHELL SAID SHE WOULD NOT CHARGE KAVANAUGH AFTER HEARING TESTIMONIES …

It was high drama yesterday during the U.S. Senate Judiciary Committee hearing as accuser Christine Blasey Ford and Supreme Court nominee Brett Kavanaugh provided testimony during the confirmation hearing of Kavanaugh. But after hours and hours of testimony, did we really learn anything new that we already didn’t know? Did Dr. Ford provide any corroboration to her accusations? Did Kavanaugh crack and provide a lack luster defense? The answers are no, no and no.

In a meeting with Republicans following the hearing Arizona sex crimes prosecutor Rachel Mitchell told them her analysis and that after listening to both Ford’s and Kavanaugh’s testimony, Mitchell stated that this case against Kavanaugh could never be brought to a court room and that she would never charge him.

Brooke Singman of Fox News quoted one source as saying “Mitchell was very clear with senators that based on evidence presented, she couldn’t bring the case ‘anywhere near a court room.’”

As reported at The Politico, Rachel Mitchell told the Senate Republicans that as a prosecutor she would not charge Kavanaugh or even pursue a search warrant.

Then, in the full GOP conference meeting, Murkowski, Collins and Flake offered their colleagues no signal of where they would land, according to an attendee. Rachel Mitchell, a lawyer who was retained by the Senate GOP to question Ford, broke down her analysis of the testimony to Republicans, but did not advise them how to vote. She told them that as a prosecutor she would not charge Kavanaugh or even pursue a search warrant, according to a person briefed on the meeting.

The examination of Dr. Ford by Arizona sex crimes prosecutor Rachel Mitchell for the Republicans, went slow, methodically and pretty much no where. Let me just say I initially thought this would be a mistake and it was. However, even with this wrong type of questioning, it was obvious that Ford’s accusations against Kavanaugh were just that. There was no corroboration or evidence to prove her accusations. In fact, a he said, she said turned in to a she said, they said. All of the witnesses that Ford stated was at the party where she was sexually assaulted all stated that they either had no recollection or no knowledge of any such get together. Even Ford’s long time best friend from high school, Leland Ingham Keyser, stated she was never at any party with Kavanaugh. Christine Blasey Ford went on to say she didn’t expect Leland and a boy, P.J. to remember that party because it not a remarkable party compared to their “more notorious parties” and that nothing remarkable happened to them. HOLD THE PHONE. How about Ford remember? She is claiming something “remarkable” did happen to her yet she can’t remember the time, day, month or really year the party took place. Ford can’t remember how she got to the party or home from the party. I do not doubt that something happened to Dr. Ford in her life. But it was not Kavanaugh. I think Dr. Ford is troubled and needs mental health help to deal with the demons, not a Democrat party of shills looking to use her for their own power.

In the end I think the GOP’s decision to use sex crimes prosecutor Rachel Mitchell was a mistake by Republicans, but it served its purpose. Republicans were cowardice because they did not want to look like a bunch of white men attacking a accusing female. Good grief, grow a set. That is what was do refreshing about judge Brett Kavanaugh’s opening statement defense, then Sen. Lindsey Graham.

WHO WOULD HAVE THUNK IT … LINDSEY GRAHAM RIPS DEMOCRATS A NEW ONE …

Sen. Lindsey Graham (R-SC) went postal during this afternoons Senate Judiciary committee hearing as he could not take any more. Graham was sick and tired of the Democrat political hit job on SCOTUS nominee Kavanaugh. Graham ripped Democrats and said, “What you want to do is destroy this guy’s life. To hold this seat open and hope you win in 2020.”

Sen. Lindsey Graham went nuclear on Democrats.

Directing his anger at California Sen. Dianne Feinstein, the ranking Democrat on the committee, Graham said, “If you wanted an FBI investigation, you could have come to us.”

The remark referred to the fact that Kavanaugh’s accuser, Christine Blasey Ford, had initially sent a letter to Feinstein and Rep. Anna Eshoo, D-Calif., in late July about the alleged assault.

“What you want to do is destroy this guy’s life,” Graham raged about Democrats on the committee. “To hold this seat open and hope you win in 2020.”

“Boy, y’all want power. God, I hope you never get it!” a sneering Graham shouted at Democrats, his face growing red.

“This is the most unethical sham since I’ve been in politics,” he continued. “And if you really wanted to know the truth, you sure as hell wouldn’t have done what you done to this guy.”

Supreme Court nominee Brett Kavanaugh opened up this afternoons U.S. Senate Judiciary Committee hearing with fire works. Kavanaugh defended himself and his character his reputation. He followed up with a scathing rebuke of  committee Democrats and the liberal media. Kavanaugh stated that the confirmation process had become a national disgrace.

This confirmation process has become a national disgrace. The Constitution gives the Senate an important role in the confirmation process, but you have replaced advice and consent with search and destroy. 

Given comments like those, is it any surprise that people have been willing to do anything, to make any physical threat against my family, to send any violent email to my wife, to make any kind of allegation against me and against my friends, to blow me up and take me down? You sowed the wind; for decades to come, I fear that the whole country will reap the whirlwind.

This is a circus. The consequences will extend long past my nomination. The consequences will be with us for decades. This grotesque and coordinated character assassination will dissuade competent and good people of all political persuasions from serving our country, and as we all know, in the United States political system of the early 2000s, what goes around, comes around.

Ranking member Feinstein, members of the committee, thank you for allowing me to make my statement. I wrote it myself yesterday afternoon and evening. No one has seen a draft or it except for one of my former law clerks. This is my statement.

Less than two weeks ago, Dr. Ford publicly accused me of committing wrongdoing at an event more than 36 years ago, when we were both in high school. I denied the allegation immediately, categorically, and unequivocally. All four people allegedly at the event, including Dr. Ford’s longtime friend, Ms. [Leland] Keyser, have said they recall no such event. Her longtime friend, Ms. Keyser, said under penalty of felony that she does not know me and does not believe she ever saw me at a party, ever. Here’s the quote from Ms. Keyser’s attorney’s letter: “Simply put, Ms. Keyser does not know Mr. Kavanaugh and she has no recollection of ever being at a party or gathering where he was present, with or without Dr. Ford.” Think about that fact.

The day after the allegation appeared, I told this committee that I wanted a hearing as soon as possible to clear my name. I demanded a hearing for the very next day. Unfortunately, it took the committee 10 days to get to this hearing. In those 10 long days, as was predictable and as I predicted, my family and my name have been totally and permanently destroyed by vicious and false additional accusations. The 10-day delay has been harmful to me and my family, to the Supreme Court, and to the country.

When this allegation first arose, I welcomed any kind of investigation — Senate, FBI, or otherwise. The committee now has conducted a thorough investigation and I have cooperated fully. I know that any kind of investigation — Senate, FBI, Montgomery County Police, whatever — will clear me. Listen to the people I know. Listen to the people who have known me my whole life. Listen to the people I’ve grown up with and worked with and played with and coached with and dated and taught and gone to games with and had beers with. Listen to the witnesses who allegedly were at this event 36 years ago. Listen to Ms. Keyser. She does not know me. I was not at the party described by Dr. Ford.

This confirmation process has become a national disgrace. The Constitution gives the Senate an important role in the confirmation process, but you have replaced advice and consent with search and destroy. Since my nomination in July, there has been a frenzy on the left to come up with something, anything, to block my confirmation. Shortly after I was nominated, the Democratic Senate leader said he would “oppose me with everything he’s got.” A Democratic senator on this committee publicly referred to me as “evil.” “Evil.” Think about that word. And said that those who supported me were “complicit in evil.”

Another Democratic senator on this committee said “Judge Kavanaugh is your worst nightmare.” A former head of the Democratic National Committee said, “Judge Kavanaugh will threaten the lives of millions of Americans for decades to come.” I understand the passions of the moment, but I would say to those senators: Your words have meaning. Millions of Americans listened carefully to you. Given comments like those, is it any surprise that people have been willing to do anything, to make any physical threat against my family, to send any violent email to my wife, to make any kind of allegation against me and against my friends, to blow me up and take me down? You sowed the wind; for decades to come, I fear that the whole country will reap the whirlwind.

The behavior of several of the Democratic members of this committee at my hearing a few weeks ago was an embarrassment, but at least it was just a good old-fashioned attempt at Borking. Those efforts didn’t work. When I did at least okay enough at the hearings that it looked like I might actually get confirmed, a new tactic was needed. Some of you were lying in wait and had it ready. This first allegation was held in secret for weeks by a Democratic member of this committee and by staff. It would be needed only if you couldn’t take me out on the merits. When it was needed, this allegation was unleashed and publicly deployed over Dr. Ford’s wishes.

Second Kavanaugh Accuser Deborah Ramirez Refusing to Testify Under Oath to Senate Judiciary Committee

WHAT A SHOCK, SECOND ACCUSER REFUSES TO TESTIFY UNDER OATH TO SENATE …

As reported at the Washington Examiner, the second Kavanaugh accuser, Deborah Ramirez, refuses to testify to the Senate Judiciary Committee about her accusations made against SCOTUS nominee. This comes as little surprise that she would testify under oath to the 35 year old  sketchy accusations that she made against judge Kavanaugh while that were students at Yale that the New Yorker published.

I think it is fair to say how credible this story was. Even the New York Times would not go forward with it.

Deborah Ramirez, a Yale University classmate of Supreme Court nominee Brett Kavanaugh, is refusing to talk to the Senate Judiciary Committee about her accusation against Kavanaugh, a GOP lawmaker said Tuesday.

Ramirez lawyer John Clune tweeted Tuesday that “We have been working hard to cooperate with the Senate Judiciary Committee…and they have refused to meet all scheduled appointments.” He said Ramirez wants an FBI investigation, not a congressional investigation, and is willing to “swear to the FBI under penalty of perjury.”

A top Judiciary Committee GOP aide told the Washington Examiner in response to the Clune claim, “The Ramirez legal team has declined to comply with the committee’s established process and investigation and seem to prefer working through the media.”

Clune is scheduled to appear on CNN tonight.

Sen. John Kennedy, R-La., who sits on the committee, said a lawyer for Ramirez told committee staff she would not speak to them about her allegation that Kavanaugh flashed his naked groin in her face during an alcohol-laden party their freshman year. Ramirez made the accusation in a blockbuster Sunday night New Yorker story.
