A Long Island doctor wants his kidney back or at least to be compensated for it. Why does this sound like the liver donor card skit from Monty Python: Live Organ Transplant (video)? Talk about going to extremes … you broke my heart, I want your kidney!

What better way to show the ugliness of divorce than to use the example of Dr. Richard Batista and his soon to be ex-wife. Its the divorce case of a Long Island doctor and his wife that just exemplifies the riches to rags story of their marriage and how a doctor uses extremes to exact a measure of flesh from his estranged wife. So much for just wanting the house and the kids, Dr. Richard Batista wants his wife’s kidney that he donated in 2001 as well.

Do you promise to love, honor, obey and share organs for as both as you long shall live?

The publicity stunt by the good doctor will most likely fall on legal deaf ears as one cannot ask for payment for a donation. A gift is exactly what it says it is … a gift. As most all legal experts assert, Dr. Batista does not have a kidney to stand on as a kidney is not a marital asset.

 It’s a touching tale and one that has been met with ridicule from area divorce attorneys.

“She ripped out his heart, but he doesn’t get to rip out her kidney,” says Lisa Bloom, a legal analyst for CBS’ The Early Show.

Calling this a publicity stunt by the scorned husband, Dr. Richard Batista, Bloom says there is absolutely no chance his soon-to-be ex-wife, Dawnell, will have to give her new kidney back.

“He wants his pound of flesh,” Bloom said, but “he’s not going to get it by way of the kidney.”

For his part, the doctor said he would accept $1.5 million in compensation.

Long Island doctor Richard Batista’s wife, sued over kidney, fires back

Dawnell Batista’s estranged hubby, Richard, went public this week with this tale of woe: He donated his kidney to his wife and then she cheated on him.

Her lawyer, Douglas Rathkopf, told WABC-TV to wait for her side of the story.

“The facts aren’t as represented by Dr. Batista,” the lawyer said. “We will be addressing the issues before the judge within the next few days.”
