Jose Baez Files Emergency Court Hearing in Casey Anthony Case after remains found of Small Child Presumed Casey Anthony (UPDATE: MOTION DENIED)

The defense attorney for tot mom Casey Anthony has filed and emergency court hearing after yesterday’s discovery of a small child’s remains near the home of missing Caylee Anthony’s grandparents, Cindy and George Anthony.

Kenney-Baden will be joining Casey’s attorney, Jose Baez, in court at 11:30 a.m. Friday morning for an emergency hearing to preserve evidence gathered on Thursday.  The motion was filed by Baez on Thursday afternoon.  We will be streaming the hearing live on MyFoxOrlando.com.

“I’m concerned about my client, period.  We are requesting to have access to this information,” said Baez. “As it [evidence] is being tested, we would like our people present, especially if it’s destructive in nature by the testing.” (Fox Orlando)

Court hearing to be held Friday 11:30 am ET.

During a news conference Thursday evening, Casey Anthony’s attorney, Jose Baez, confirmed that she was upset when she found out about the remains being found and requested a sedative at the jail. Sources described Casey Anthony’s reaction as an anxiety attack.

Baez went to the Orange County Jail Thursday afternoon to be with his client. Later Thursday, he filed an emergency motion to ensure his involvement in the testing of the newly found remains. A hearing is scheduled for Friday at 11:30.

Judge Stan Strickland rules against Casey Anthony Defense motion

The defense team better get used to bad news these days after a child’s body was found yesterday close to the family home of George and Cindy Anthony. The prosecution was bring murder one case against tot mom Casey Anthony prior to “potential” remains being discovered. When the remains are officially ID’d as Caylee’s, Casey Anthony will be facing an even greater mountain of evidence.

Judge Stan Strickland after hearing arguments from both the defense and prosecution has denied the defense motion filed for access to the autopsy of Caylee Anthony. Basically, because no formal ID has been given to the child remains found yesterday, the defense has no standing to insinuate themselves in the private evidence that could turn out to be not Caylee Anthony.  The defense wanted their experts to be present during an autopsy of an individual that they do not know legally to even be that of missing Caylee Anthony.

Defense Team for Casey Anthony denial motion … no soup for you.

Jose Baez and his defense team seem to have their cart before the horse and are assuming that the remains found yesterday are that of missing Caylee Anthony. One wonders why they are so certain that the remains found are Caylee.
