Boston Marathon Bomber Dzhokhar Tsarnaev to be Tried in Civilian Court, Charged with Using Weapons of Mass Destruction Causing Death … Says His Brother Tamerlan was Driving Force Behind Terror Attacks

Suspect #2 Dzhokhar Tsarnaev, the 19 year old who has been taken into custody in connection with the Boston Marathon bombings will not be charged as an enemy combatant. Instead as he lay in his hospital bed after suffering injuries after a shootout with police, Federal prosecutors announced terrorism charges against Dzhokhar Tsarnaev. The surviving suspect was charged with using a weapon of mass destruction and malicious destruction of property. This charge could bring him the death penalty. A grand jury will be convened where other charges will be filed against suspect #2.

The criminal complaint against Dzhokhar Tsarnaev, filed in U.S. District Court in Boston, ended a debate over how one of the first successful terrorist attacks on the U.S. homeland since Sept. 11, 2001, should be handled. Some congressional Republicans had insisted that Tsarnaev be designated an “enemy combatant,’’ which would enable the government to charge him under the laws of war in a military commission or to hold him indefinitely.

White House press secretary Jay Carney rejected that approach on Monday, saying that the suspect cannot be tried in a military commission under federal law because he is a U.S. citizen. “We will prosecute this terrorist through our civilian system of justice,’’ Carney said at a White House news briefing.

As much as many wanted Dzhokhar Tsarnaev to be charged as an enemy combatant, under the laws, it really did make no sense. Like it or not, this dirt bag terrorist is a US citizen. Although I would say that they could have held him somewhat longer and interrogated him with out Mirandizing him under the public safety exception.

As reported at CNN, Boston bomb suspect says brother Tamerlan was brains behind attack. Wow, way to throw your terrorist brother under the bus. Then again, I guess that is appropriate as Dzhokhar Tsarnaev  drove over his brother trying to escape from police and reportedly killing him as police had Tamerlan on the ground handcuffed. Authorities believe that the two brothers acted alone and had no outside terror help. They are  classifying them as self-radicalized jihadists. Really, this from feds who did not act accordingly when they were informed by Russia that the older brother was a terrorist?  Are we really supposed to believe that all the bombs made, the cool, calm and collective nature of how these two planted the bombs and their actions were not supported by a terror network? Really? Did Tamerlan have a job, how did he sustain his lifestyle? Where did the money come to buy the materials to make the bombs? It is truly amazing just how little the feds understand about how terror networks actually work.

Boston Marathon bombing suspect Dzhokhar Tsarnaev has told investigators his older brother Tamerlan was the driving force behind last week’s attack and that no international terrorist groups were behind them, a U.S. government source said Monday.

Preliminary interviews with Tsarnaev indicate the two brothers fit the classification of self-radicalized jihadists, the source said. Dzhokhar Tsarnaev, wounded and held in a Boston hospital, has said his brother — who was killed early Friday — wanted to defend Islam from attack, according to the source.

The government source cautioned that the interviews were preliminary, and that Tsarnaev’s account needs to be checked out and followed up on by investigators.

And a federal law enforcement official told CNN that while investigators have seen nothing yet to indicate the suspects were working with anyone else, a lot of work remains before they can say confidently that no others were involved. That official would not comment on any motive or specifics on what Dzhokhar Tsarnaev has communicated to officials.
