Kansas Preemption On Gay Marriage

As reported earlier more and more polls are showing a swing to create a Constitutional Amendment against Gay marriage. On Tuesday, Kansas voters will decide whether to approve a constitutional amendment prohibiting gay marriage.

Gay marriage is already banned under Kansas law, and the law is not being challenged by anyone. But supporters of the ballot measure say the ban must be put in the Kansas Constitution to insulate it from legal challenge.

Kansas would become the 18th state with such a prohibition in its constitution; 13 others approved bans just last year. Alabama, South Dakota and Tennessee plan elections next year on constitutional bans, and proposals are pending in 13 other states, according to the National Conference of State Legislatures.

This is a continuation of the backlash of having unelected black robed people make law. The law of unintended consequences is that gays may wind up in the end with even less afforded to them than if they just accepted civil unions. The public opinion is certainly not with gay marriage.
