Federal Judge Roger Vinson Declared Obamacare Unconstitutional … Uses Obama’s Own Words Against Him

OBAMACARE DELT CRUSHING BLOW …

As speculated earlier today, a second judge has ruled Obamacare unconstitutional. Federal Judge Roger Vinson ruled today that President Barack Hussein Obama’s health care law is unconstitutional. To add insult to “health care” injury, the federal judge used Obama’s past words against him.

In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, when the then-Illinois senator argued there were other ways to achieve reform short of requiring every American to purchase insurance.

“I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that, ‘If a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of his 78-page ruling Monday.

Judge Vinson, a federal judge in the northern district of Florida, struck down the entire health care law as unconstitutional on Monday, though he is allowing the Obama administration to continue to implement and enforce it while the government appeals his ruling.Hey Barack, words do have consequences don’t they and you do not get to have it both ways. Actually, as stated by Weasel Zippers, some one just got their butt handed to them. During the Democrat primary, Hillary Clinton’s insurance plan required that purchase insurance, Obama’s did not. Since the passage of Obamacare, the president has been singing a different tune and defending the government forcing Americans to purchase a product and claiming regulation authority for inactivity. During the presidential campaign, one key difference between Mr. Obama and his chief opponent, then-Sen. Hillary Rodham Clinton, was that Mrs. Clinton‘s plan required all Americans to purchase insurance and Mr. Obama‘s did not.

Congress eventually included the individual mandate in the bill it passed, and Mr. Obama signed that into law in March. Since then, he and his administration have defended its constitutionality, arguing the mandate is the linchpin that brings in more customers to insurance companies, which in turn allows those companies to expand the availability and lower the cost of coverage.

However, Judge Vinson did not just strike down the federal mandate, he struck down the entire health care law, Obama’s crown jewel, as unconstitutional.  Judge Vinson concluded that the federal mandate insurance requirement was so “inextricably bound”to other provisions of Obamacare that its unconstitutionality required the invalidation of the entire law. OUCH! What is the LEFT to do, as they are all whine and no legal argument?

But unlike a Virginia judge in December, Judge Roger Vinson of Federal District Court in Pensacola, Fla., concluded that the insurance requirement was so “inextricably bound” to other provisions of the Affordable Care Act that its unconstitutionality required the invalidation of the entire law.

“The act, like a defectively designed watch, needs to be redesigned and reconstructed by the watchmaker,” Judge Vinson wrote.

US Senator Chucky Schumer said during a CNN interview that “we have three branches of government, we have a House, we have a Senate and we have a President. ARE YOU KIDDING ME?  How could a sitting Senator say anything so ignorant? Can you imagine if Sarah Palin or GWB made such a comment? The MSM would be discussing it 24/7. But when a liberal Democrat makes such an ignorant comment, it’s as thought it was never said.

By the way Chucky, just so you know the three branches of government are the executive, legislative and judicial. UNREAL!

And all three of us are going to have to come together and give some, but it is playing with fire to risk the shutting down of the government, just as it is playing with fire to risk not paying the debt ceiling.

Florida Federal Judge Roger Vinson to Rule on Obamacare Constitutionality Today

Could today be another legal blow to Obamacare?

Florida Judge Roger Vinson of the US District Court in Pensacola is expected to rule on the constitutionality of Obamacare today. The plaintiffs represent 25 other U.S. states. From Reuters comes the following:

A Florida judge could on Monday become the second U.S. judge to declare President Barack Obama’s healthcare reform law unconstitutional, in the biggest legal challenge yet to federal authority to enact the law.

The judge, Roger Vinson of the U.S. District Court in Pensacola, Florida, was expected to rule on a lawsuit brought by governors and attorneys general from 26 U.S. states, almost all of whom are Republicans. Obama is a Democrat.

The plaintiffs represent more than half the U.S. states, so the Pensacola case has more prominence than some two dozen lawsuits filed in federal courts over the healthcare law.

Will the Florida judge follow suit with the recent ruling in Virginia? Last month, a federal district judge in Richmond, Virginia struck down that central provision of the law in a case in that state, saying it invited an “unbridled exercise of federal police powers.”

Kathleen Sebelius Compares Right to Health Care With Right to Own TV, what?

Kathleen Sebelius, the secretary of HHS when asked recently where in the US Constitution the government had a right to make people buy insurance said, “she was not a lawyer …”. She basically was unable to defend the very law that she is supposed to be in charge of. What? How is some one in charge of the government take over of health care and not able to defend the government’s position? Sebelius punted to the attorneys. Ever wonder what is wrong with Washington?  To make matters even more bizarre, Sebelius compared the right to own healthcare to that of a TV. WTF!!!

Isn’t it a choice to own a TV, not a government mandate?

Fugitive Cop Shooter David Durham’s House Located In NEW Kyron Horman Search Grid

Officer Steve Dodds was alledgedly shot more than once at close range while the incident was recorded on his patrol car dash cam. Dodds is in critical but stable condition. Dodd’s stopped David Anthony Durham for speeding Sunday evening after he left a co-worker’s party without his date, but not without his dog, Huckleberry.

Huckleberry has been recovered by police with only a minor leg injury.

New Search Resumes for Missing Oregon Boy, Kyron Horman in Multnomah County

Kyron Horman has been missing since June 4, 2010 when he disappeared from Skyline School after his stepmother Terri Moulton Horman had driven him to school early that morning for the school science fair. There has been no contact with the then missing 7 year old boy since.

However, the search resumes for the missing Oregon boy this weekend as searchers are focusing on two locations in the west hills: north and west of Portland, OR.  Search teams renewed their efforts this Sunday in the pursuit to find Kyron Horman in rural Multnomah County. According to investigators, there was specific intelligence led them to the areas they are presently searching. As stated by Multnomah County Sheriff’s deputy Eric Gustafson, “None of the searching we do is random, We don’t throw darts at a board and say, let’s search here.”

The Multnomah County Sheriff’s Office released a statement saying  that the search for Kyron Horman is underway.

Search teams include Multnomah County Search and Rescue and its partners, North Oregon Regional Search and Rescue, four regional canine search teams and Mountain Wave Communications.

The new search near Northwest Skyline Road is supposed to be as follow as reported at The Oregonian:

About 15 searchers from the Mountain Wave Search and Rescue Team were setting up in a gravel turnout of Northwest Skyline Road, in a remote area near Moreland Road and a field where horses were grazing. Thick vegetation also covers the ground near the area. Team members say they cannot comment about the search.

Between 40 to 50 search-and-rescue workers, along with as many as seven cadaver-detecting dogs, are combing the dense forested area around turnouts, trailheads and gated logging roads along a stretch of Northwest Skyline Road, south of Rocky Point Road and a gravel road farther north in the Dixie Mountain area.

Chris Matthews’ Priceless Gaffe: He Says Palin & Bachmann are Stupid, Yet says Panama Canal is in EGYPT!

According to Chris Matthews, De”Nile” is not just a body of water is Egypt, so is the Panama Canal.

MSNBC’s Chris Matthews has previously attacked Sarah Palin and Michele Bachmann for being stupid; however, we are presented with the brilliance of Chrissy Matthews in telling us that the Panama canal is in Egypt. Really Chris? Who is the mail order bride now? or as the Left Coast Rebel states, “who’s the bubble head now?” Hey Chris, does it give you a tingly feeling up your leg as well when you provide us with examples of you knowledge? How mazing is it as Matthews is lecturing us as to the world importance of Egypt, he makes such an ignorant comment that it was home to the Panama Canal rather than the Suez? Seriously, how does Panama even come to one’s thought process?

As stated by Hugh Hewitt, Matthews does not get the benefit of a gaffe or a misspoken word, even though there is a double standard, because he and his MSNBC network have made it known to all that they are all so much smarter than us.

How gafftastic is it that Matthews cannot figure out that the Panama Canal is actually in, um,  Panama? Up next for Chris Matthews is … who is buried in Grant’s tomb, where is the Great Wall of China located and when was the Battle of 1812 fought?

Another Search in Myrtle Beach, SC … Brittanee Drexel has Been Missing Since April 2009

17 year old Brittanee Marie Drexel has been missing since Arpil 25, 2009 in Myrtle Beach, SC while on Spring Break. A large scale search of police and volunteers has begun this weekend for the missing Chili teenager, Brittanee Drexel. More than 200 people are expected to search for missing  Brittanee Marie Drexel. The search is to  focus on Old Georgetown Road in Charleston County, and involve crews on horseback and with cadaver dogs.

Police and volunteers in Myrtle Beach will conduct a large scale search this weekend for missing Chili teenager, Brittanee Drexel.

Drexel, who was 17-year-old at the time, went missing while on spring break in Myrtle Beach in April 2009. She was in Myrtle Beach without her parents’ permission.

The search focuses on McClellanville because a cell phone tower there received a signal from Drexel’s cell phone after she disappeared.  Brittanee Drexel was staying at the Bar Harbor Hotel on Ocean Boulevard when she went missing. She was seen leaving the hotel on surveillance video at 8:15 p.m. to visit friends at the Bluewater Resort. Drexel was recorded on video surveillance leaving the Bluewater Resort and thought to be  headed back to Bar Harbor, but never arrived.

UPDATE I: 150 continue search for missing teenager.

At least 150 people searched three miles of wooded road in Georgetown County on Saturday in the hopes of finding a clue to the whereabouts of Brittanee Drexel.

The search will continue today with at least 30 more people, said Monica Caison, with the CUE Center for Missing Persons in Wilmington, N.C., which organized the search

No significant finds were made on Saturday, but Brittanee Drexel’s mother, Dawn Drexel, said she is optimistic.

“I’m hopeful that they’ll get a tip called in or something that will bring us closer to what happened to Brittanee,” Dawn Drexel said.

Oops, President Barack Obama Confuses Iraq & Afghanistan … “Combat Operations in Afghanistan Have Ended”

During a recent interview, as reported by the Politico, Obama made a complete muddled mess out of  out of his plans for withdrawing troops from the region. The Commander in Chief stated, “Combat Operations in Afghanistan Have Ended.”Really, who knew? I guess we can blame the gaffe on Obama’s teleprompter because we all know that the MSM will never question him on his glaring mistake. Doesn’t it instill confidence in America that their president does not know the difference between Iraq and Afghanistan? This coming from the man who the media calls the smartest president ever.

Who needs VP Joe Biden for gaffes when we have Barack Hussein Obama …

“As I said, we will be out of Afghanistan by the end of this year… Combat operations in Afghanistan have ended.”

TNT Network Apologizes for Tracy Morgan’s Comment About Sarah Palin

TNT should be ashamed for even bringing up the topic … like they didn’t think the answer would digress to vile piggery. Isn’t it something that the age old question of “Ginger or Mary Anne” would in 2011 digress to the gutter of a “masturbation” comment. We’ve come a long way baby, not.

The TNT network has apologized for the cruse and disgusting comments made by 30 Rock and SNL cast member, Tracy Morgan. The uncalled for comment was made during TNT’s “Inside the NBA” pregame show between the the Miami Heat and the NY Knicks. Tracy Morgan was asked by co-hosts Kenny Smith and Charles Barkley, ” “[Morgan's] the only one who can settle it. Tina Fey or Sarah Palin?”  Morgan’s lack of judgement response was the following … “Yo, let me tell you something about Sarah Palin. She’s good masturbation material.”

The statement from TNT was as follows:

“It’s unfortunate Mr. Morgan showed a lack of judgment on our air with his inappropriate comments. We apologize for any embarrassment or offense it may have caused.”

Yet another example of why not to give a live microphone to some one with no jusgement 

During yesterday’s live broadcast, co-hosts Kenny Smith and Charles Barkley handed 30 Rock‘s Morgan a microphone and asked him to settle a bet: Tina Fey or Sarah Palin? “Me and him have this argument all the time, ” crowed Smith, referring to Barkley. “[Morgan's] the only one who can settle it. Tina Fey or Sarah Palin?” They were clearly not asking which woman was smarter or faster in a race.

Just curious TNT, you are a sports network doing a pre-game show in Madison Square Garden with a much hyped game between the Heat and the Knicks and you felt the need to delve into raunch? Lebron and Wade against the surprising Knicks who have suddenly found game this year and this is the direction you took the conversation? Shameful. It’s rather a lame apology when you had to have known that the direction of one of your hosts asking  Sarah Palin or  Tina Fey would lead into the gutter. In many respects I have to Agree with Anne Althouse, Tracy Morqagn did exactly what one would expect of him. It is your two co-hosts and your director that should be apologizing for taking the TNT pregame show into the gutter. Shameful indeed.
