Deepak and Satish Kalpoe appear to not want their day in Court …
It would appear that Deepak and Sataish Kalpoe are fraidy-scared to come to the United States and be deposed. What, the Kalpoe’s do not want their day in court? Looks that way … Kalpoe’s continue to make excuses for being deposed as Defense counsel claims they are intentionally filling out Visa applications so to be denied access to the United States.
Dr. Phil defense attorneys accuse Kalpoe’s of misleading the Court.
The Kalpoe’s appear to have tried to get two Visa applications denied within 6 months because they thought that it would delay the process. Of course they and their attorneys seem to have misinterpreted the law. Or possibly did not even bother to review it at all.
So Deepak and Satish Kalpoe that they were going to get rich quick by suing Dr Phil and Jammie Skeeters. Since the initial law suit filing, the case has been dismissed against the late Jamie Skeeters. The Kalpoe brothers were suing for defamation of character. Of course our first thought was, didn’t one have to have character first in order to claim defamation?
In motion to compel documents filed with the court the lawyers for Dr. Phil McGraw continued to file motions to compel the Kalpoe brothers to be deposed i in Los Angeles, CA. For three years the Kalpoe’s have come up with ever excuse not to come to the United States to be deposed. Read the Motion to Compel HERE. Defense attorneys are looking to compel the Kalpoe’s to appear in Los Angeles County, CA on or before April 15, 2010 to be deposed. It is hard to believe that Deepak and Satish, so quick to sue have never yet been deposed. Does any one really wonder why?
Did Deepak and Satish really not think they were going to be grilled regarding their conduct and participation in the disappearance and death of Alabama teen Natalee Holloway?
Their actions had everything to do with their character, or lack thereof and would be open to questioning. Exactly what reputation would one have to defame when as a suspect in the death and disappearance of Natalee Holloway, you lie to Aruban and Dutch LE? In the end … this case always ties back to the night that Natalee Holloway disappeared and was never seen again. All questions, whether they be civil or criminal begin there.
The Kalpoe’s claim that they cannot make it to the United States to be deposed by Dr. Phil’s attorneys because they have issues with their VISA’s. It’s no wonder that they were denied by the United States government, especially when from all accounts they were purposely incorrectly and inaccurately filled out by the Kalpoe’s. Dr. Phil’s immigration expert referred to the Kalpoe’s Visa applications as, “two shoddy Visa applications which were defective and contained contained numerous discrepancies, and were predictably denied”. Plaintiffs (Kalpoes) offered the Court no explanation as to why they did not contact an immigration attorney to prepare and file their Visa applications. Hmm.
Defamation of character, eh? These folks intentionally fill out a simple Visa application to suit their purpose not to be deposed.
One would need to read pages 4 thru 8 of the motion to compel to get a full understanding to just how purposely incompetently and inaccurately the Visa applications were filled out. Dates omitted, signatures missing and questions either filled out inaccurately or just not at all. The Kalpoe’s first and second Visa applications have numerous inaccuracies. One might ask, why would there be any at all?
One of the most damning aspects of the motion to compel is on page 6 where it is referenced that Deepak failed to failed to declare in item number 17 on either of his Supplemental Visa applications that he attended the International Christian Academy in Miami, FL in 2004. So that begs the question, how was Deepack able to properly fill out the school Visa application in 2004, yet he struggles to be able to fill out the same Visa application now?
There are so many errors, omissions, inconsistencies and inaccuracies on both Deepak and Sataish Kalpoe’s Visa applications that any normal and common sense citizen could only assume that they were doing this purposely so that the applications would failed and they would not be permitted in the United States. Thus, preventing them from being deposed.
From the outset of this Kalpoe law suit, we said that “pigs get fat and hogs get slaughtered”. From the outset of this law suit the Kalpoe’s and their attorneys had to think that Dr. Phil would settle out of court. This was the proverbial nuisance law suit. A funny thing happened on the way to the Kalpoe’s law suit … Dr. Phil did not settle.
In the end, what is happening with regards to the Kalpoe’s is exactly why we were bewildered initially as to why these two punks would have sued in the first place. What’s the matter, the Kalpoes do not want to answer questions? Maybe it is that they are afraid of Defense Exhibit A-51 was written on February 16, 2008 entitled, “Scared Monkey’s Welcomes Bill O’Reilly & Geraldo Rivera to the Fold as they Finally Embrace the Aruba Boycott and Date Rape in Natalee Holloway Disappearance”.
How could there be a defamation case if Aruba had jailed them and considered them suspects in the murder of Natalee Holloway? Long before there was any tape made by Jammie Skeeters and aired on Dr. Phil, the world knew who Deepak and Satish were. Whether Aruba ever did the right thing and prosecuted Deepak, Satish and Joran Van der Sloot … all common sense thinking people knew who was with Natalee Holloway last, who lied, who tried to cover up the crime and who was responsible for her disappearance and death.
The Kalpoe’s will probably never come to the US to be deposed and the case will be dismissed because at the very least … Deepak and Satish are presently free. If there is an admission to any wrong doing with regards to Natalee Holloway on US soil … book ‘em Damo!
Watch and remind yourself of the many lies, mistruths and inconsistencies from both Deepak and Satish and then ask yourself why they would ever want to come to the United States and odder any thing under oath as it pertains to a missing and presumed deceased American.

If the Phil McGraw recording reflects Jamie Skeeters’ hard drive … I agree. The implication is that Deepak Kalpoe defamed himself. This is the reason that I cannot comprehend why McGraw’s attorneys require case documents from Aruban to defend the defamation lawsuit filed by the Kalpoes. Why can the recording that has been professionally analysed not stand alone as evidence?
Also … why are all the extentions granted to the Kalpoes’ attorneys to comply with the request to produce documents? According to the following article … in February, 2008 … the Kalpoes were given five days by the judge to comply and … two years later this case is still being dragged out.

Former Holloway Suspects Can Sue Dr. Phil
In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.
But the judge gave the Kalpoes’ lawyers another five days to satisfy the document deadline.
“The documents are relevant to the most fundamental issues in this case,” Ferns stated in his ruling. “There is no other (information) which can substitute for the documents sought by the defendants due to the nature of this case.”

No surprises here. We know the Kalpoes could not hold up to a deposition, especially away from the protective veil of Paulus’s friends in high places. What I’m wondering is why on earth would a competent U.S. attorney take on this case when the Kalpoes were already arrested (twice) and discredited by the time Dr. Phil’s show aired? Did they file this case on a contingency basis or did someone offer to pay them to take this case? I do hope the Kalpoes come here to be deposed, but I’m not betting the farm they’ll ever set foot in the U.S. Bravo to Dr. Phil and his insurance company for refusing to settle this case. Prayers for all those whose loved ones are missing or have been lost because of sick cowards like the Kalpoes.
I heard one of the Kalpoe’s call Natalee a whore early on in the case. (Deepak?) Something murders and rapists do to justify their crimes. If they ever did a deposition I would love to hear their reasons for their defamatory remarks of Natalee?
What about blaming the black security guards for Natalee disappearance. I hope this case cost them plenty in lawyer fees.
The Kalpoes must think that the US Court system is as screwed up as Aruba’s. Did they think they can just lie and scam their way out of being deposed and get away with it just like they did in Natalee’s case? Get them under oath or throw the case out and they pay all attorneys fees!

However … I do not believe that case documents will be forthcoming. Aruba would never allow the proof regarding the official coverup agenda that has prevented justice from prevailing for Natalee Holloway for almost five years to be exposed.
Could the Kalpoes attorneys be citing the following legalities in their refusal to produce the documents?
1. The Kalpoes are no longer suspects.
2. The Natalee Holloway case has … from a technical perspective … not been closed.

KELLY: I believe David Koch (ph), one of the attorneys for the Kalpoes actually signed a declaration at the court indicating that even if the court ordered the documents be turned over, they were not going to turn them over, which was sort of, for lack of a better word, arrogant on his part. The court did not necessarily like that.
But I can’t see them both using the courts as a sword and then a shield. They can’t bring this action, they can’t seek damages and not obey the orders of the court and expect their case to go forward.

Nothings changed Natalee was last seen in the car with Deepak, Satish Kalpoe and Joran vander sloot, never to be seen again, and Deepak said they all got together around the pool with Paulus before it was even public or known Natalee was missing to make up alibis to frame 2 black security guards for Natalee being gone.
