Caylee Anthony is still missing, Casey Anthony has been indicted by a grand jury on murder one and Cindy Anthony appears to be forming a foundation. So why is Cindy Anthony forming a Foundation for Caylee Anthony and for what purpose will it serve? One question would be whether this Foundation is a Private or Charitable Foundation. Or is it a Foundation in registration name only?

The question that needs to be asked and answered is why now is a Foundation being created in the name of Caylee Marie Anthony?

However, is this application for the Caylee Marie Anthony Foundation really a foundation in the 501(c)3 sense that people have known to understand?

Florida, like many states, has long required by statute that any person operating a business under a fictitious name file a certificate in a public office disclosing the true names of the owners of the business. (Some states refer to fictitious names as assumed names.) The purpose for this registration is to provide notice to the public, and especially to creditors, of the identities of persons who are doing business under fictitious names for the purpose of protecting creditors from fraud and deceit. (See Jackson v. Jones, 423 So.2d 972 (Fla. 4th DCA 1982), review denied, 436 So.2d 99 (Fla.1983); 1957 Op. Att’y Gen.Fla. 057-283 (September 17, 1957)).

Until July 1, 1990, the Florida Fictitious Name Statute, Florida Statutes Section 865.09, required that a person engaged in business under a trade name do the following if the trade name was not the proper name or known called name of the person: (1) publish once a week for four weeks in a newspaper in the county in which the principal place of business was located notice of intention to register the fictitious name; and (2) record in the office of the clerk of the circuit court of that county an affidavit signed by all of the owners. “Person” included partnerships and corporations, as well as natural persons. Failure to so register subjected the person to criminal liability, as well as civil liability. However, compliance was no assurance of avoiding civil liability. See Robinson v. Lane, 557 So.2d 908 (Fla.1st DCA 1990), which held an individual liable for a corporate contract even though the individual disclosed she was signing in an agency capacity for “Slender World” and even though the corporation had properly registered that fictitious name under the former F.S.A. Section 865.09.

There is a common misconception that registration of a fictitious name assures the registrant of exclusive rights to the name. The new law clearly states that registration is for public notice only, registration does not give rise to any presumption of the registrant’s rights to own or use the name registered, and registration does not affect trademark, service mark, trade name, or corporate name rights previously acquired by others in the same or similar name. F.S.A. Section 865.09(8). Registration itself does not grant any trademark or other proprietary rights in the name. (However, note that F.S.A. Sections 607.0401 and 617.0401 require that names of corporations be distinguishable from the names of all entities or filings registered and on file with the Division of Corporations.)
Because it is a crime not to comply, Florida businesses continue to have a strong incentive to register their fictitious names. Compliance is easier under the new law since the Division of Corporations promulgates forms and instructions for such compliance. In addition, the information provided by registrants will be more readily available to the public since, in the past, there was not a single state-wide office for filing registrations. The Division of Corporations has shown through its maintenance of computer records on the hundreds of thousands of Florida corporations that it can efficiently handle this task.

      I pray that Tim and TES can find this precious baby.
      It is so sad when total strangers care more for a child than her own family does. I know all about denial, but when the evidence is staring you in the face, you have to accept reality. Let Caylee have a proper resting place. Isn’t that all we wanted for Natalee? Don’t let the same thing happen to Caylee.

      Weird, I would expect the owner of the ficticious name to be a charitable organization, since “Foundation” implies a charitable purpose, not Cindy individually. If you give money to a foundation, you expect it to go to a 501(c)(3) non-profit corporation, i.e., a corporation organized under the tax laws to be non-profit, required to use any donations it receives for charitable purposes. And if she wanted to solicit donations for a charitable purpose, such as searching for Caylee, why wouldn’t she form a 501(c)(3)corporation, which ensures that any donations are tax deductible for the donor.

      What exactly does Cindy intend to do under the name of this Foundation? I don’t care how many ficiticious names she registers, if she solicits donations under this foundation’s name, and puts the money in her pocket, it’s still fraud.

      Cindy Anthony’s intentions are perfectly clear. SHe is forming this so called foundation to raise money for Casey’s legal fees and primarily for her own personal use.

      The Anthony’s address and telephone number is on the application. I suggest we all pay them a visit and give them a call ;-)

      is it possible that this is all something done with advise from an accountant? weren’t the anthony’s in financial crisis before this all happened? i can just imagine that it’s gotten worse. time off work etc…

      my thoughts are that cindy may take a paycheck from the organization for time spent on this case. i wouldn’t take issue with this if the family were more cooperative with tes. they should be interested in finding the baby regardless of her state.

      Cindy wouldn’t even help Tim Miller out by giving him something that belonged to Caylee to help them out with the cadaver dogs….

      The Anthony’s need money to pay their bills and Casey’s attorneys….and they are using Caylee to do it….

      What a joke. The Anthony family has not cooperated with police or helped search for missing Caylee. The entire family should be paying Texas Equusearch and Orange County for the thousands of dollars spent searching for Caylee.

      It just amazes me how Cindy Anthony can sit back and complain that no one is searching for Caylee…when SHE is not searching for Caylee.

      Slap the crap out of your stupid daughter and get off of your ass and look for your granddaughter yourself…quit thinking that it is everyone else’s responsibility to look for Caylee. YOU LOOK FOR HER! And tell your lying daughter to untie the knot in her “missing Caylee” T-shirt – she looks like a moron.

      I can bet you that Tony does not find Casey one bit appealing…and if he does…shame on him.

      Cindy and George and Lee made this monster, let them deal with her.

      Can anyone else file a Caylee Marie Anthony Foundation too?…Like possibly a church or a banking institution or some other entity…

      If so…then hopefully that person or entity can pay Tim Miller and a lots of other folks to look for missing Caylee Anthony…

      I would not give any of my money to any foundation that Cindy Anthony is in control with…because I don’t trust her, or her family in doing what is right by anything…they are just looking after themselves in what they are doing…

      This case could have already been solved and little Caylee would have already been found if the Anthony family would have cooperated fully with the police and investigators, and Tim Miller and a lot of other people in trying to solve this case…

      Anthony is either going to get:

      LIFE w/o possibility of Parole…yay! ROT ROT ROT

      or , quite possibly- the Death Sentence.

      Is the Steel Magnolia crumbling now? I know this sounds cold, but Cindy Anthony also deserves all the bad media attention she gets for trying to lie and cover up for her insane daughter. What the hell is this world coming to? Sad, really but makes most of us angrier than a hornet’s nest!
