    1. Retract What? on October 8th, 2007 9:30 am

      Dana,

Retract what? How is anyone supposed to know what is the truth and what is false when you do an interview?

This attorney knows that it is up to the legal process to determine that, not you. He is an atty, right?

Anything more than that is bullying. There is still a 1st Amendment and just how much precedent on line and in the media as being allowed to interview controversial topics.

You have more than provided equal time seeing that they don’t even want to come on and provide their point of view. Anything more by this would almost be extortion.

The 1st Amendment lives … and there is a reason why it was deemed … #1.

It is not up to an interviewer to determine the truth, they get an opinion and seek to get the truth. However, when is it the opinion of the interviewer what is that of the interviewee?

      Dana,
WTF! IMO they don’t have a leg to stand on.

Is everyone to be SUED who listens to any interview?

IMO HKStern and lawyer are tring to undermine our constitutional rights to Free Speech and Free Press.

Now, I what to buy Rita’s book to find out more.

HKSterm must be trying to win the world’s biggest A-hole, ever contest.

Right on Dana, right on! You have invited the parties taking exception to the broadcast, giving them equal time to make any protest-and they declined. How can you retract what YOU personally didn’t say? I think you made it very clear here, by apologizing for any comments YOU may have made that offended. You should not have to apologize or retract for what someone else said on your show. Why didn’t Howard and his lawyers go after Rita, who actually said the words they take exception to? Why kill the messenger? It’s easy to go after small fish. (Sorry Dana-you are a great guy with a great show, but you aren’t a conglomerate-yet). Why not go after Rita? Because there is probably a big, hairy legal department they would have to deal with. Dana, you aren’t taking the easy way, but imo you are taking the right way. I hope Rita is being supportive of you, since it is her comments that is causing Howard to come down on you.

Howard is a very seedy dark person. His reputation follows him and it is not good. He gives me the creeps.

It’s frightening to think that a radio host, TV host or book store manager would be held accountable for something a guest says when discussing their book. Certainly they can ask for equal time if someone feels they’ve been defamed. Asking Dana to state on his show that Howard K. Stern strongly denies these charges and is filing suit as a result of statements made that he claims are defamatory is reasonable. Asking Dana to retract those statements and threatening or implying action against him or Scared Monkeys is scary. I don’t know the laws of libel or the First Amendment, but there’s something very very wrong here.

I haven’t read Rita’s book and do not plan to do so, was never a big fan. Having said that, Anna Nicole’s talent was what? I’ve never figured that one out either. Didn’t watch a lot of the shows about her on the news. I tried to watch Anna’s show once and didn’t last 2 minutes. The victim to me in this story is the child. The rest are/were adults and it seems the none of the choices they were making were in the interest of anyone, but themselves. The booze, the drugs, etc. They all need to go away and let Larry
Birkhead, who was given custody of this child, a chance to make a decent life for this little girl, something she hasn’t had so far due to all the above stated. Personally I don’t care if Howard and Larry or peter pan were involved with each other last year. It’s a disgusting to me as OJ Simpson writing stuff trashing Nicole after she’s dead and can’t defend herself. Let the police investigate if it was a murder and tell us. About 7 months now and they aren’t calling it a murder.

I love your show Dana and stand your ground. You are not responsible for what your guests and you aren’t the one who needs to retract them if they are false.
