Rush Limbaugh’s Doctor-Patient Confidentiality Upheld

 

Like Rush Limbaugh or not, Judge Crow’s ruling regarding Doctor-Patient confidentiality is correct and a godsend to all. That is one genie that everyone does not want let out of the bottle. This is a larger issue than a witch hunt focusing on the political icon like Rush. Such a ruling would affect every single person out there as being fair game for any over zealous prosecutor or any prosecutor for that fact. That is one precedent that none of us could afford to have.

Roy Black, Rush Limbaugh’s attorney, issued the following statement:

Judge Crow’s ruling upholds our argument that the State cannot breach doctor-patient confidentiality just because it has obtained some medical records, and thus the state cannot ask the doctors its questions posed to the court during the hearing.

Judge Crow’s decision prohibits the State from questioning Mr. Limbaugh’s
physicians about “the medical condition of the patient and any information disclosed to the healthcare practitioner by the patient in the course of the care and treatment of the patient.”
